I have a decent size position in MRMD but its been sideways for months now. I watch RLBD and its been miserable. I am hoping for better things with WDDD than these two.
In my dreams I see us as the next GME or AMC. With our float, it actually wouldn't take that much if we got on Reddit/StockTwits radar. But, realistically, I'll settle for slow and steady appreciation.
Screw "Wash Sale Purgatory". I bought back 1/2 of my position. I'll fill the remaining after the penny traders take a pause. This is not a bet on Thom. I am just willing to see where tis takes me and what I see so far is good. GLTA.

I guess a lot depends on what you hope to get from Plan B. If you want a quick Reddit-fueled pop that lets the long suffering holders get whole, then pump it all over Twits, Twitter etc. Just be prepared for the likely drop when the crowd moves on. If you see Plan B as a means to become a real, respected company and all that entails for long term profitability and growth, then slow and steady should be the idea. Perhaps Plan B can accomplish both these scenarios. FWIW, I am currently in "Wash Rule" purgatory so I don't have a current horse in the race. But my heart is with the long timers. GLTA

Dave, I agree that your analyses on political risk, 101 impact, MSFT strategy etc have been proven correct and you have earned a vindicated "Victory Lap". But, as a practical matter many, if not most, of us were already sufficiently under water by then and faced with a decision to cut losses or hope for a "Hail Mary". In my case, my entry point was .30. I only saw that PPS one more time and I took profits. But, then I could not resist the temptation to "buy the dip" to the point were I was again under water. I can only imagine those who have been here for 10-12 years have much sadder and dramatic stories to tell (White Owl). Fortunately for me it is all "fun money" and a minor portion of my portfolio. I remain "all in" hoping for a miracle Plan B. That said, is it your opinion that the MSFT case should still be pursued at this point? While the ACTVI result is not controlling, the fatal flaw in the patent (non specificity) remains and would persist at the Circuit Court level. Is our only life line a favorable SCOTUS repair of Alice and 101? Appreciate your input.

Even assuming best case and we get a remand, what might convince Casper to change her original decision? It seems she would have to be found to have erred on a fact of law rather than just her judgement call. I listened to the audio and it didn't seem like we got much traction on the Alice Step 2 argument which seemed to be fruitful going in.
One of the judges (female) may have signaled her vote. She said to ACTVI "You may prevail here but it will not be because of anything you did. It will be for what WDDD DIDN'T do." Patent insufficiency.
Could it actually be that, after all these years, the original patent was poorly written or not specific enough to overcome prior art?

WOW. In another case now before the court, the female judge just said "You have no chance to prevail because your argument is stupid". Pretty harsh but revealing as to the vote. Hopefully, we will fare better.

So, best case we win a clear cut victory on appeal (not likely). Worst case, we lose and its game over (quite likely). Middle case, it gets returned to lower court and we are in for months/years of waiting. That said, is there any chance for the MSFT stay to be lifted in Texas? Would MSFT have to agree?
Agree. Based on the paucity of information coming from Thom concerning WDDD, it seems like this could be the case.
It is just another struggling pot company owned by Thom Kidron. I don't believe WDDD holds any shares. So the short answer is no impact.

I suppose when you are a giant, it would make sense to settle both cases and clear the books. Or, Goliath just hopes to stall David into insolvency (which at this point, would not take much). Hoping for the former. Expecting the latter.
So with the suit vs MSFT on hold in TX, MSFT assumes the burden of defending the appeal in MA. Small potatoes if you are MSFT. Just another pesky gnat to swat away?

MRMD killed it on earnings today. Good news for WDDD's investment there.
SCOTUS asked for Solicitor General position on May 3, 2021. Prelogar has been acting in that role so perhaps it won't take forever for her to reply.
Some pundits opine that Biden's position on patent law in general will be clearer by his appointments. So, there are two key ones to consider.
Biden's nominee to head the USPTO is Kathi Vidal but she likely will not face confirmation for several months. She is a product of Silicon Valley. She has been on both sides in patent cases so its hard to get a read on that. While her credentials to lead the Patent office appear solid, it is interesting that she fits the mold of almost all Biden's nominees so far. She is active and holds various positions involving women's rights and also leads diversity initiatives. In a related move, Elizabeth Prelogar was just confirmed as Solicitor General. She fits a similar mold to Vidal. Her office has been asked to provide the government position in American Axle. I have no idea what this means (if anything) to WDDD's case. But, I find it interesting.
Based on my own DD, I have a fairly significant position in MRMD. But, I have read enough of these "analyst predictions" to not get overly excited by this one. First, only one analyst is covering it so it looks like a true outlier. Second, it is not really a "technology services" stock. It is a pure MJ play. I would love to see $2.25 but since it is mired in the .80 range, I doubt I'll see that any time soon. I am patient.

Thanks, Dave. If there is no vendetta, that would be good for all concerned. Just to clarify, I have been investing/trading for well over 30 years. I admit, I took a bit of a "flyer" with WDDD. As such, I tend to listen to those who have been here for 10+ years and try to divine whatever perspective they can add to my own DD which actually encompasses reading the vast majority of the 40,000 posts on this board. FWIW, my own assessment is that this is the classic "all or nothing" venture. Either way, my relatively modest exposure, when compared to the claims by the "wales" on here, will not make or break my portfolio. Good luck to you and all the long-suffering longs!
