Text marketing has only taken off in the last three years (2003+)
Before that it was out there, at the very least since 2000/2001, but texting was only just beginning to hit widespread adoption. I myself only started texting in 1999, and dear old mother sent me her first text message in 2004 (she's my yardstick as to whether any technology has officially become known to the masses) Marketers were dabbling in this tech in the early stages but only now are they serious about text campaigns.
Now then...
Qode really requires people to be using internet services on their phones. We are only at the beginning stages of this ladies and gentlemen. How long will widespread adoption take? Be realistic. Open your eyes and look around around you. It's not there yet by any means. Neom knows this... and above any other player in the space they have the luxury of a little more time to establish themselves. Sure, you and I might surf the net on our phones, or even use Qode right now - but folks, that's only because we are tied so closely to the story that is unfolding.
The next time you see a stranger on the street with their eyes fixed on their phone and you truly do not know if they are texting or surfing... then, and only then, should things really be starting to roll.
Take a step back.

Could you outline the possible ways our patents might be circumvented?
How many teasers were sent out to members already subscibed to his Microcap service? Common sense would suggest those members would easily know what he was talking about.
Not a major issue at all. People have to physically go into the store to use the system. The internet may be involved, but only after the user has scanned the code and had the results sent to B&N's internal servers.
I can't see that there's a way to bypass our IP when scanning codes via a mobile device.
B&N Uses internal servers via an intranet for their in store music.
It looks to me like OP3 are infringing. They are using the internet to resolve the codes.

Waiting is right. For a while, I believed adoption was a matter of months away, but as time goes by and I observe more about how this space is unfolding, my conclusion is that we are still years away. I'll qualify that by admitting it's my 'current' conclusion. Furthermore, that thinking is only for 2D codes, to the exclusion of any projections one might have for the incredible possibilities which RFID might bring.
I remember in 1998 being interviewed by a tech show about the future of this amazing new thing called "the internet". At the time I was dribbling on about the idea of people being able to access the internet wireless anywhere in the world at high speeds very soon.... Has it happened? No. But does anyone seriously believe that mass WiMax adoption will not happen?
The PWC space is, I believe, yet another technology that will happen. Question is, will Neomedia be the dominant player some expect? Granted, we are in a dodgy place financially at the moment (that's putting it mildly!!) but to question Neom's position in this space, and furthermore the space itself would seem to require a wider scope of vision.
Things need to be done right. I for one am happy for any launch to be delayed in order to ensure that not only the product is right, but that the critical mass of consumers and customers are hungry and ready to embrace an application that is truly revolutionary in it's ramifications for the marketing world.
It's up to each of us to determine for ourselves how much of that pie chart in the header of the board will eventually be established under Neom's domain - but at the end of the day... there's a big pie being baked here, and even a modest slice could be tasty.

Now I get 403 and 400 "Page not found" messages.

Sog my friend... It's happening. Just wait until you're running Skype (or similar) on your phone.
Carriers are fully aware of the fact that they will no longer be getting any revenue from phone calls anymore. Where I am, one of the major carriers has announced they are not only going to roll out the infrastructure for a TOTALLY wi-max'ed country by the end of next year, but that your phone will simply be another 'app' on your wimax enable handheld device.
I for one saw this coming back in '99 - that's part of the reason I'm here at least. We are all just a little ahead of the curve, that's all. It's tested my patience for sure, but that's life... :) Even with a Qode launch in the near future, it will STILL be ahead of the curve in terms of critical mass.
As JP and other surfers here will surely testify... you really wanna' ride the wave? You gotta trim. Make sure you are positioned where the centre of power will push you along. Too far in front, and you're not above water for long. In essence, NEOM is at the mercy of public adoption in terms of our timing. Sure we've had to perform a few cutbacks, but I'm looking forward to the day we bash that lip.
