Don't worry about it.
In ASD's patent application, it was more about ideas than product. You can't patent ideas; you can only patent processes and product.
Take the time to read ASD's patent application, and then take the time to read ours. Ours is very detailed; theirs is more like "we think we can use, x, y and z all in the same manner." The problem with their patent is that these processes have been used before for many different things, but until you actually do it for identifying different substances, you really can't patent it.
To put it in another perspective. Supposed I write a patent explaining how I could build a spaceship that could travel through space, entering a blackhole and then suspend or reverse time. These are ideas. Until someone actually does it and proves it, you really can't get a patent on it.
This is my take on it, anyway. I think that this lawsuit isn't a serious challenge to CDEX. In fact, CDEX may want to file a countersuit, as it has the real deal; ASD has smoke and mirrors of something that could possibly work.

It seems as though we're adding new hospitals every couple
of weeks now. I wonder how many we're not hearing about? I imagine that not every hospital wants to publicize that they bought a product.

I'm waiting to "hear" that Yale/New Haven has "bought" a dozen valimed units, myself. Verry bigg, sprawling teaching hospital, so they'd need at least a dozen. And next might come NY Hospital -- even bigger and more sprawling (so they'd need 2 dozen), tunnels connecting buildings and even a few unknown ones (to most peeps) that take you right up to First Avenue -- gotta have an in there to know where they are, though.
Those noteworthy events might even happen while the litigation is being sorted!
