Utah delays law regarding short-sales

NEW YORK (MarketWatch) -- Utah's top securities regulator and the Securities Industry Association on Friday said they agreed to a preliminary injunction against a new controversial new law. The law allows Utah-based companies to collect $10,000 per day from brokers who fail to alert the state securities commission within 24 hours as to how many shares on designated lists of short stocks they won't be able to deliver on time. SIA, the brokerage industry's biggest trade group, said in a statement it would work "with the state of Utah to address their concerns."

NEW YORK (MarketWatch) -- The Securities and Exchange Commission will slash the fees it collects from exchanges in October, but the move will have opposite effects on the two biggest U.S. equity markets, analysts say.

The rule change, announced in May, is expected to save investors -- and the money collected by the SEC -- by $1 billion annually, according to commission projections.
Because the Nasdaq only earned "exchange" status in January, the market was not collecting the fees which are passed on to the SEC at the end of the quarter, Ken Worthington, an analyst with J.P. Morgan Chase & Co.
Though the SEC eventually gets the fees, the exchanges can keep the interest earned on the funds until they are transferred to the government. The transfers are made twice a year on March 15 and Sept. 30. Analysts estimate the exchanges earn an average of 5.5% on the funds.
The NYSE collected $372 million in such fees in the first half 2006. Worthington estimates the NYSE will see interest income fall $1 million by the yearend 2006. But the impact will be greater the coming years with income falling $9 million, or 2 cents a share, in 2007 and 2008.
However, rival Nasdaq should see a gain of $6 million annually, or 3 cents a share. The exchange is expected to collect $888 million in fees next year.
