I would re-read the latest agreement carefully...it says what the old terms were and the new ones...and yes it gets confusing, I had to read it 2 or 3 times. If you want after that, go back and read the original....

they are confusing for a reason I suppose, and usually written 100% by attornies that seem to disguise what they are saying if they intend to or not....I find it is just the way they were trained to write.

Drift...XKEM Nigeria is a whole owned sub. They can pledge a minority interest or even the entire entity if they wish to...again this is as collateral in case of default...or was collteral (not sure if thiswas from the old agreement or new one).

this in no way means that xkem intends to ever sell any of xkem nigeria....and if this were to be called (the collateral that is), the 15% activity would be presented as minority interest activity on xkem's consolidated financials...

all this is/was was an assets pledge...means nothing from where i'm sitting..

FIFO and the IRS...not always, it is their default, but if you have a trading system that ID's specific lots to sell from, that is also acceptable for tax purposes!! Fidelity for example allows you to choose specfic lots when selling, but if you do not choose that option, it defaults you to FIFO.
