A proposed medical marijuana facility in Lakeshore does not have the municipal services and approvals it needs to start operating — even if it secures regulatory approval from Health Canada, says a town official.
CEN Biotech has erected high security fencing, retrofitted two buildings and made other property preparations at the intersection of Manning Road and North Rear Road.
Company president Bill Chaaban recently told The Star he personally invested up to $5 million in the venture hoping Health Canada would approve its licence application. Company officials have said they are ready to launch operations quickly.
But the property where CEN Biotech is located does not have sufficient servicing to operate what has been touted by executives as potentially the largest medical marijuana facility in Canada.
It doesn’t have the water, hydro and sewage services that will likely be needed, said Steve Salmons, Lakeshore’s director of community and development services.
Getting them will require time and money for approvals and installation, he said.
The nearest sanitary sewer line is several kilometres away on Manning Road near County Road 22 (the extension of E.C. Row Expressway). The water line connected to the site can only service a couple dozen nearby homes and doesn’t have the capacity to feed a large marijuana growing operation.
Upgraded service from Hydro One would also be needed to accommodate lighting demands for marijuana production.
“It’s hard to say what they need because we don’t have a complete application from them on exactly what it is they want to do,” Salmons said. “They have indicated they want to grow medical marijuana on the site. For us, there is no application or proposal.”
Lakeshore council in November passed a bylaw requiring medical marijuana facilities be located on land zoned for industrial use. The CEN Biotech site is zoned for agriculture.
To operate on the current site the company has to apply for an amendment to the bylaw. That process would involve community feedback and meetings that allow the public to learn about and discuss the plans.
“That would take at least six months starting out of the gate,” Salmons said.
Chaaban is appealing the town’s medical marijuana bylaw requirements to the Ontario Municipal Board. He wants CEN Biotech to be grandfathered so it wouldn’t be subject to the new bylaw. An OMB hearing is expected this year, but no date has yet been set.
The medical marijuana company has retained Windsor lawyer Jeff Slopen. He did not respond to a message from The Star.
Salmons said the town has nothing against medical marijuana operators or CEN Biotech. It just wants to ensure municipal rules are followed.
“Initially they were talking small scale of 5,000 square feet, but that expanded to 100,000 square feet,” he said. “The only zoning they have is for agricultural and they have a permit for the fence. That’s it.”
Mayor Tom Bain attended the company’s announcement in 2014 that it would locate in Lakeshore and was initially supportive.
Salmons said Bain did so in his role as vice-president of the region’s economic development corporation and not as town mayor.
“I know there are stories we invited them to invest, but we never did,” he said. “(Lakeshore officials) learned about it in the media just like everyone else.”
