Lawmakers Introduce Bills to Overhaul Federal Marijuana Policies, Bolster Cannabis Industry
Two congressmen have unveiled separate bills today that would overhaul the federal government’s approach to marijuana and allow the industry to flourish in states that have legalized cannabis for medical or recreational use.
Here are the details:
- US Rep. Jared Polis (D-CO) has introduced legislation that would regulate marijuana in a manner similar to alcohol, meaning individual states could decide whether or not to legalize it without fear of federal intervention. Under the Ending Federal Marijuana Prohibition Act, growers in states with cannabis laws would have to apply for a federal permit, and all businesses would have to abide by local marijuana rules to qualify.
The bill, according to a fact sheet released by Polis, also would remove marijuana from Schedule I of the Controlled Substances Act; ensure that federal law distinguishes between individuals who grow marijuana for personal use and individuals who are involved in commercial sale and distribution; and reassign jurisdiction of marijuana regulation from the Drug Enforcement Administration to the newly-renamed Bureau of Alcohol, Tobacco, Marijuana, Firearms and Explosives.
- US Rep. Earl Blumenauer (D-OR) has introduced a bill that calls for the government to implement a federal tax on marijuana sales, which could bring in an estimated $20 billion in taxes a year and would further legitimize the industry. The lawmaker also says he is seeking changes that would let MMJ dispensaries claim common business deductions and remove barriers that prevent cannabis centers from opening bank accounts.
To be clear, the proposals face some stiff resistance from other lawmakers, and it’s doubtful either one will pass this year – or anytime soon for that matter, according to some pundits. But the bills are a strong sign that attitudes toward marijuana are beginning to shift in the nation’s capital, and they will fuel the momentum created when Colorado and Washington State legalized cannabis in November.

5 Promising Ancillary Cannabis Business Opportunities for Entrepreneurs, Investors

Looking to get involved in the marijuana industry but don’t want to take on the sizable risks of actually handling the drug?
Good news: Some of the biggest opportunities in the medical and recreational cannabis markets involve the ancillary side of the industry – for both investors and entrepreneurs as well as professionals who currently run dispensaries or cultivation operations. This includes everything from human resources and professional services to equipment, education, advertising and virtually anything else a dispensary, edibles company or grow site needs to operate.
The potential for rapid growth is huge. Several new medical marijuana markets are coming online (Arizona, Connecticut, Massachusetts, etc.), while the legalization of cannabis in Colorado and Washington State will create a whole new industry. At the same time, there are only a handful of national cannabis-focused companies today. Ancillary businesses in MMJ states such as Colorado and California are just now starting to move into other states, so there’s still a vast untapped market and plenty of room for competition.
“There’s so much opportunity in every single aspect of this industry,” said Troy Dayton, CEO of the ArcView Group, which links investors with promising cannabis businesses. “Right now it’s about taking any business sector out there and looking at how it applies to cannabis.”
Indeed, professionals in marketing, staffing, real estate – you name it – can transition into this business.
Opinions differ on which segments will grow the quickest and which offer the most potential, and it can vary greatly by market. But here are five of the more promising ancillary opportunities from a national perspective:
#1. Cultivation/Hydroponics
Companies that provide growing equipment and supplies – be it lights and fertilizers or climate control systems and advanced all-in-one grow rooms – will be among the biggest beneficiaries of the marijuana boom. This is one of the few business segments that can tap into every state with medical marijuana and recreational cannabis laws – including those that don’t allow dispensaries or commercial cultivation – because individual caregivers and home-growers need hydroponics supplies. Also, the cultivation business is very insular and regional. So there are ample opportunities for national cultivation companies to emerge.
#2. Consulting
Professionals who have worked closely with the MMJ industry in an existing medical cannabis state are in high demand, particularly in fledgling markets such as Massachusetts. Starting a dispensary or grow site is typically very complex, given the varying rules and regulations and many pitfalls involved. Entrepreneurs are seeking people who have been there before and can provide guidance about how to go about the process, opening up the door for consulting companies. “This allows those with real experience in the industry to participate in a larger segment of the market than they would be able to running a dispensary or even a small number of dispensaries,” said Kris Krane of Arizona-based 4Front Advisors, one of several consultancies that is expanding. State and local governments are also seeking consultants to help them craft regulations.
#3. Security
Every businesses that deals directly with marijuana needs some type of security system or plan to prevent robbery and theft. Several states with dispensary programs even have strict rules covering everything from cameras to alarm systems. And you can bet security will be a big part of new regulations on the recreational cannabis industry in Colorado and Washington. The industry requires specialized security solutions, and companies that fill that niche should have plenty of business for years to come.
#4. Legal
Navigating state and local regulations is one of the biggest challenges dispensaries, edibles companies and cultivation sites face. Not only is it difficult to wade through these complex laws on your own, the risks involved are enormous. Legal guidance is a must, and law firms are often the first businesses to crop up in a new MMJ market. In some cases, attorneys that handle criminal marijuana cases expand to the business side of cannabis. In others, legal firms focused on business law move into marijuana. There’s also the possibility of expanding into consulting.
#5. Financial
Anyone who can figure out a way to provide legal, realistic financial solutions has a bright future in this industry. Banks and credit card companies pretty much shut out the industry at the urging of the federal government, forcing dispensaries to seek out other services that can help them handle customer transactions. Some companies are trying novel approaches – such as cashless ATMs – but the industry needs help on many fronts in this area. The big caveat: Unless you have a ground-breaking idea, this is more of a longer-term opportunity, and it might not truly emerge until the federal government eases up on MMJ.

Feds Taking Hands-Off Approach to Marijuana Legalization, Retail Cannabis Businesses?

The silence from the federal government on state-level marijuana legalization is deafening, leaving officials and entrepreneurs in Colorado and Washington in a state of extreme uncertainty.
But there are some promising indications that the feds could take a more hands-off approach to the issue than initially expected. The latest sign came this week, when Washington Gov. Jay Inslee met with US Attorney General Eric Holder to discuss the state’s voter-approved marijuana law. Inslee said the meeting was a “confidence-builder” as the state crafts regulations on cannabis, adding that he’s now convinced Washington should move forward with that process, according to the Seattle Times.
This development, while not conclusive or official, provides the best idea yet of how the government will handle marijuana legalization in Washington and Colorado. One interpretation: The feds won’t interfere too much as long as the states craft responsible regulations governing the cultivation and sale of cannabis and implement safeguards to ensure marijuana isn’t diverted to other states.
That might sound like an overly optimistic view – especially given the federal crackdown on medical marijuana – but it’s plausible. At the very least, the government seems to be taking a wait-and-see approach. The Obama administration did not, as some people feared, come out of the gates swinging and attempt to shut down the programs from the get-go or try to influence the rule-making process.
Of course, everything in this industry can change overnight, as we’ve seen numerous times. But for now, the industry is cautiously optimistic.
“It’s certainly encouraging,” said Aaron Smith, executive director of the National Cannabis Industry Association. “At a minimum, this is a positive signal that the Department of Justice is willing to work with state officials who are bound to uphold the will of their constituents.”
Smith, however, said that the government must outline a definitive policy on the issue to create a stable industry.
“As Attorney General Holder works to develop that policy he should be seeking input not only from state officials, but from the leaders within the country’s existing regulated medical marijuana industries,” Smith said. “The federal government also needs to provide clarity to financial institutions to ensure that the billions of dollars this new industry creates doesn’t end up outside the banking system.”
This is about the best situation the cannabis community could realistically hope for at this point, short of the government officially announcing that it won’t interfere at all (which was not even a remote possibility anyway). In addition to Inslee’s meeting with Holder, the government gave another indication of its position when President Barack Obama said in December that prosecuting individual marijuana users in Colorado and Washington would not be a high priority. He did not offer his take on marijuana businesses in those states. But many cannabis professionals were encouraged by his comments nonetheless for just that reason (he could have, for instance, said he was unequivocally against retail marijuana businesses).
Both Washington and Colorado are moving forward with developing regulations to allow the cultivation and distribution of marijuana for adult use. Retail marijuana shops could be up and running in both states in about a year.

First quater 2013 will be something I'm looking forward to seeing; With the Affiliate Program in Place 2nd Quarter should exceed the first; same with 2013 3rd & 4th Quarters; Revenues will continue to Increase; 2013 Will Show SIGNIFICANT GROWTH; NOW that the websites, and affilates are in Place. Couple that will further exposure through Television ( Cheryl's Reality Show), Print, Internet, Radio, And Last but not LEAST, CELEBRITY ENDORSED CANNACIGS!!

I'LL hold my shares til it doubles from here. I know I will double my money in about less than 3 months imo. Just think about it if you didn't buy at the right time here and now sell for a loss thinking that you can make money somewhere else??? Buy low sell high... These are the lows here people, buy at these levels if you can, there are not a lot of shares available for sale at these levels. Only those who get scared will sell here at these levels. Remember that between 200 million and 300 million shares were traded above .002. Continue to accumulate under .0015 and hold strong, give it some time then sell for a profit, patience pays off.

"My phone has been ringing off the hook since about a week before the election," says Troy Dayton, CEO of The ArcView Group , a San Francisco-based advisory firm that connects investors and entrepreneurs in the cannabis industry. While he's the first to admit that opening a pot dispensary or becoming a grower is full of risk and uncertainty, he also says that with the right seed money, the upside is sky high.

"I focus on the ancillary businesses; the businesses that are surrounding the cannabis industry that don't actually touch cannabis and are federally legal," he says in the attached video. His contacts have included "everybody from entrepreneurs who are just interested in the sector and want to put $25,000 to $50,000 to work, all the way up to billionaires and venture capital funds that are looking to make investments."
