It may well be that the actual agreement with CSHD precludes any later decision to terminate or withdraw. So, the practical effect of the C&D is zero. The fact that there has been no 8-K from CSHD announcing the termination of this agreement lends support to this idea. ANYWAY, that is not whats important. What is important is that RPH follow thru, without further delay, on the audited financials (10-K plus 8-K) and price reset. This is what he has committed to for months. I believe you established over here that on 9/30 a 10K is required for the 6/30/06 FHAL as well as a 10K due within 60 days of the 7/12/06 8K. So, I think we can expect a single consolidated 10K by 9/30. If this is wrong, please let me know -

We somehow need to confirm that CSHD is planning to release a form of 10K by 9/30(consolidated 10k, 10k plus 8K) that includes all of the assets acquired to date. All that they are required to release by 9/30 is the FHAL 10K for 6/30/06. If this drags on past 9/30 without a reset skepticism will appear immediately -

and that is to immediately stop criticizing people who may be smarter, not less smart, than you. This is particularly true on a message board where you don't know with whom you are conversing. Anytime you want to get into an IQ contest I will be happy to oblige you. The fact is that all CHSD is required to file is an audited 10K for the period thru 6/30/06. If it does so, the assets acquired in July and August will not be included. So, how are they going to include these (audited) assets. The best info I have seen indicates that an audited 10K/A is required. If this is not the case, perhaps someone other than yourself can reply and let us know how this is handled -

an important step is being overlooked. Its my understanding that a 10K/A is what is needed to reset. Yet no one has confirmed directly with CSHD that this is what is being prepared. They are preparing something - is it a 10K/A?

Assuming we would have enough buying support at these high levels, the GTCs would be executed at the best available BID price.

But again, I think its a good idea to set your GTCs atleast above the book value..in this case roughly around $30-35...

RPH has committed several times to a pps reset. This is not going to be a "release and evaluate the 10K play" where the stock jumps 200% and then trades from there. The only way this makes sense is with a reset imo
