No, those were two separate statements. They said that there are no current or pending legal matters, with the exception of being in technical default. I cut down the document to only focus on the pertinent parts.

I completely understand. I'm grinning ear-to-ear over here. I'm up 6K in 1 day 1 hour and 15 minutes. Who can argue with that? I can only imagine what you're feeling, since your holdings dwarf mine.
I dislike the shorters as much as any other long, but make no mistake, it was not stupid. They made a lot of money off of this thing. They've also had pretty good notice to cover. I think their time is over, and anyone that continues to short to keep a lid on this thing is going to suffer.
Maybe they acquired more claims while they were typing up the document. :)

What if CPRK purposely created a short friendly environment for a lender? What if the whole information blackout was to create a chance for this lender to make a significant amount of money as a stipulation for LTF. They would know exactly when to cover, and would also get to ride the pop. I'm envisioning something like this...
MD (to lender): We're going to shut down the mill and make necessary upgrades (with your money) over the winter. The winter is too harsh to get a whole lot done anyway. While the mill is down, we won't release any company information, and we'll need to lay some employees off. This will create a perfect environment for you to short to your hears desire. Once you have made sufficient money, you can exit your position, we'll bring the mill back online, and you can ride these 350M shares through the roof.

No one is denying that their has been dilution. It is one of the facts that we can actually verify with this stock; the other being the number of short sales per day. To say

Short Interest - The total number of shares of a security that have been sold short by customers and securities firms.
Short Selling - The selling of a security that the seller does not own, or any sale that is completed by the delivery of a security borrowed by the seller.
Dilution - A reduction in earnings per share of common stock that occurs through the issuance of additional shares or the conversion of convertible securities.
Dilution is a problem, but should not be confused with short selling. Short selling is actually the cause of additional dilution. Without the price being continually walked down by the shorts, there would not be a need to issue as many shares.
Cover - The act of completing a transaction in order to remove any obligations.
Every transaction must be covered. There may not be a short squeeze; we don't know the total short interest (only estimated based on daily short interest), or at what price you'll be able to cover.
I wish they could give us an idea of total outstanding shorts, or time to cover. I think CO1 has a way to estimate the total outstanding. If close to or more than 50% of the volume in any given day is short sales, and us longs are still buying, then they can't always be covering right away.
I got a good chuckle from our elite chart reader earlier today, when he said that people propagating the myth of short sales have an agenda. For the life of me, I can't figure out what a long (or anyone, for that matter) would gain from recognizing we are being shorted into oblivion.

They say that they won't be able to continue operating without new capital. New capital is more difficult to come by, since they already have so many outstanding loans. Their debt decreased because of a stock cancellation of some sort. I don't really understand it, but check out their latest 10-Q http://www.otcmarkets.com/pink/quote/quote.jsp?symbol=mrib#getFilings if you'd like to try and decipher it. The disappointing part about the debt decrease is that it didn't come from increased revenue; it most likely will not be a continuing trend.
I sunk a small bit of change into this company at a significantly higher price, so I want it to succeed. On the bright side, it looks like they've begun distribution in at least a few U.S. states (CA, PA, and IL). Maybe the new markets will pay off.
I just checked for recent filings. It looks like the CFO resigned on 2/23, but will remain on the BOD. Their 2009 financials leave them at 19M in debt (which is better than that 24.4M at the end of June), but they are still doubtful they can continue as a going concern.

If you've got Mono on a Linux box, it should run fine. I believe everything there is supported in .NET 2.0 or less. I haven't done any development on Unix/Linux for about 10 years (I've never done C# development there), and PHP for 8, so I'm afraid I won't be much help there.

If you're having trouble reading the file, you can import it into Excel and select the pipe character, |, as the delimiter. Ctrl + F will help you search for "CPRK". It is the official short sale record for last Friday provided by FINRA at the request of the SEC. Proof doesn't get any more official than that.

The SEC only requested that FINRA produce the number of shares shorted in a given trading session. They do not provide time to cover, or total outstanding shorts.

Doubtful, because they haven't in the past, but I'm no lawyer. We usually don't know until someone checks the Nevada State website, or calls the TA. Like I said, none of us have seen the articles of incorporation (that I know of), so it could all be in MD's hands.
1. Unless otherwise provided in the articles of incorporation, a corporation that desires to change the number of shares of a class or series, if any, of its authorized stock by increasing or decreasing the number of authorized shares of the class or series and correspondingly increasing or decreasing the number of issued and outstanding shares of the same class or series held by each stockholder of record at the effective date and time of the change, may, except as otherwise provided in subsections 2 and 3, do so by a resolution adopted by the board of directors, without obtaining the approval of the stockholders. The resolution may also provide for a change of the par value, if any, of the same class or series of the shares increased or decreased. After the effective date and time of the change, the corporation may issue its stock in accordance therewith.
2. A proposal to increase or decrease the number of authorized shares of any class or series, if any, that includes provisions pursuant to which only money will be paid or scrip will be issued to stockholders who:
(a) Before the increase or decrease in the number of shares becomes effective, in the aggregate hold 10 percent or more of the outstanding shares of the affected class or series; and

MM's are not short here..they are clearing thier shares,not manipulation ,it called liquity..its why the markets work,it's what the MM's do! Whether UP or down!

State of Nevada allows its public traded companies to dilute up to 250 billion shares..CPRK is one of those companies
I don't want to give anyone advice about purchasing this stock or not. I do not have any more information than anyone else on this board. I bought another 1M shares this week, because it is expendable income. I would not have invested more otherwise.

If you don't have L2 access (which I don't either), you can always go to http://www.otcbb.com/asp/Info_Center.asp enter CPRK, select Level II from the drop down, and click Go. It won't show you L2 for this security without upgrading, but it will show you a list of the most recent sales (15 minutes delayed).
I guess I don't understand your complaint. I've tried to trade and been trapped in several stocks. It has always been my fault, because I tried to chase it. As an investor, you're allowed to get frustrated at management, because they aren't living up to your expectations with your money. As a trader, you're just some guy who tried to make a buck flipping it, and got stuck. There's nothing wrong with flipping, but you have to know this is unavoidable--it is the nature of the beast. You can't win every time, and I'd say 9 out of 10 times, the average person loses. It is a game stacked against the small investor.
Depends on your level of proof. To me, gathering tens of thousands of acres of mineral deposits, building a ~$60M mill, improving said mill, having power lines run to support the mill, acquiring mining permits and equipment, hiring staff, staving off sheriff sales and foreclosures, etc... is proof of intent to make a profitable business. Sure, it has been a rocky start, but I don't believe there is any ill intent. Money may have been mismanaged, but I can't say for sure, since I haven't seen the books.
I'm no MD cheerleader. I've never met him, I've never talked to him, and I have no way whatsoever to gauge him other than what he has accomplished thus far. Come transparency, I'll have a better idea of what kind of manager he is. Even then, the books can only tell so much of the story. I don't even know half the stuff my co-workers have to finagle to get their job done, and I sit right next to them. I do know one thing, he will not get rich, and he will not provide jobs for the community if this venture is not successful. You said previously that you don't care about those things, but your personal wealth goes hand-in-hand with their success.
There is no promise of return when you invest. If someone tells you that they can give you X dollars for every dollar you invest, run away. If someone proves that they have the potential to make money, and you can get in on the ground floor, then pending proper DD and the presence of expendable income, go for it. It is all based upon your personal acceptable level of risk.
