"I don't know if you've looked around rhe OTC lately,"
This stock's price doesn't track with the OTC. It tracks with this Company's operational performance.
I had seen that before and wondered if you had. So a laser surgery fiber is as critical to a laser surgery unit as a coffee filter is to a coffee machine. And the BeaMed fibers are identical to those already in existence.
Do I have that right?
If so, what kind of market size do you expect for this "new" product?
"Trade/Device Name: BeaMed Laser Surgery Fibers"
Do you know what Laser Surgery Fibers are? Does Mack know? How about leavethe?
Isn't that something you should know before you get all stimulated over an approval to market them?
Is talking about a CEO who has gone silent after failing to file not only a required 10-Q but the required Lateness Notification nitpicking?
Is discussing a judgment against a Company for an amount in excess of its liquid assets nitpicking?
Your problem isn't with me.
No wonder LE is in hiding. His stalwart supporters are here saying stuff like....
"the momo building here" on a day after the price went down and did so on less than $20K worth of trading.
"no trips or otherwise share value below .001$"
Dollar sign follows the price now?
And as weak as the share price been it has never been below $.001. That said, tomorrow's another day.
If this CEO was at all confident that the ray gun guys were going to save the day he wouldn't be ghosting his shareholders.
Some of this Company's supporters are doing more damage to it than its detractors ever could. Real investors see your comments and want no part of it.
No filings. No CEO. And soon even those with hope will be gone.
o_g. Are you going to the court website to get your updates or do you have an alert system that you can share here?
It's great that you are so on top of this stuff but I'd like to be, too.
Anything's better than having to wait for the CEO, who as you know has remained mum for some time, so please continue with the board updates.
It was confusing. Maybe there's some rule that requires that the trial witness and exhibit lists are posted with or after the judgment is entered. Maybe it's because there could be additions to those lists up until the time of judgment.
Some system. Took almost 4 years to conduct a very short bench trial.
That's not a witness list for the appeal...it's the original trial witness list.
JMuneducatedO:
The appeal is not a retrial. IPIX has to provide a basis for their appeal and argue it using the facts established in the original trial.
It remains to be seen what they base their appeal on. They may not even have a plan for it. The notice of appeal they filed just serves to avoid running out the 30 day clock that started with the judgment entered on 3/7.
Should've read the following before I wrote the above but it seems consistent with it:
The right to an appeal
If you believe a final decision of a trial court or State administrative agency is legally wrong, you may have a right to appeal the decision. (There is also a right to appeal some types of orders that are not final, called interlocutory orders.).
An appeal is very different from proceedings before a trial court or administrative agency. For an appeal:
You must make all your arguments in writing.
You cannot present witnesses.
You cannot present new evidence.
You usually cannot make new arguments on appeal.
The appellate court will look only at the record that was before the lower court or agency. For an appeal from an agency, the record is the administrative record prepared by the agency. For an appeal from a trial court, the record consists of the papers that were filed with the trial court, exhibits admitted at trial, and the trial transcript.
In almost all cases, the appellate court only considers two things:
whether a legal mistake was made in the trial court; and
whether this mistake changed the final decision (called the "judgment") in the case.
If you disagree strongly with the judge's factual findings, that is not a valid basis for an appeal.
An appellate court will not overturn any factual findings by a judge unless there was no evidence before the court that supported the finding or if the evidence against that finding was so overwhelming that no rational person could make that finding. The appellate court can only reverse the trial court's decision if it finds a legal mistake in the trial court proceedings, or a clearly erroneous finding, that was so important that it changed at least part of the outcome of the case. Because of this heavy burden on the appellant to prove this type of mistake, it is quite difficult to win an appeal.

Something's funky about the last few reporting periods. For starters, one is missing.

"Ipix model Regeneron required 18 years to find a development partner and 20 years to reach a first USD FDA approval. The first 10 Regeneron years included wrong decisions and clinical trial failure."
And in 28 years they made 800 SEC filings without having to file a single lateness notification. Their CEO/founder, who is an MD that has surrounded himself with real medical professionals, still signs their filings certifying the latest 10-K that was filed a month ago.
It's safe to say that Leonard S. Schleifer, M.D., Ph.D. President and Chief Executive Officer of Regeneron has never ghosted that company's shareholders.
Where is that hero of yours?
That's not a serious question.
The latest news from this Company can be seen here:
https://www.sec.gov/Archives/edgar/data/1355250/000147793224000494/ipix_8k.htm
It says that the Company's 2 independent directors resigned and the Company lost a lawsuit, resulting in a judgment for well in excess of its available cash and about which it was indicated that "The Company intends to appeal the decision". It has been suggested that the appeal of a judgment must be filed within 30 days of the judgment...today is day 47. It has also been suggested that the dollar amount of the judgment must be put in escrow or otherwise bonded at the time of the appeal filing.
Here's a really serious question.
What should a reasonable investor do when their Company CEO, when faced with the above, elects to ghost the Company shareholders rather than provide them an update as to whether "The Company intends to appeal the decision"?

"Continuing to rise on higher than average volume... "?
Takes a sharp eye to spot a 2 day trend.
"What's the next news coming and when?"
Who knows? Maybe it's a Form 15 filing freeing this CEO from the need to make filings that he wasn't making anyway. Would that be seen as good news by people who don't like news or bad news by people who do? Any chance the Company auditors didn't like the review of the 10-Q presented by LE and that accounts for the lack of a filing?
The next news coming should be either the overdue 10-Q or an explanation for its absence. That's what a responsible company would be providing.
What was the pending news that triggered this feeding frenzy just 6 weeks ago?

The statistics clearly indicated that the chances of dying from covid were much higher in the population that didn't get vaccinated and those sample sizes were in the multi-millions.
My story, sample size of one, isn't evidence of anything but in case anyone finds it interesting:
I had two vaccinations and I believe it was 3 boosters (elected to take all the boosters as they became available) with a flu shot at the same time as the last booster (in late November).
On the night before Christmas I had a nasty headache that kept me awake all night along with a fever so I went to the ER in the morning. No sense of smell or taste buds. Diagnosis: CoVid AND the flu. Gave me a shot of something for the headache.
ER Doctor suggested that I could either ride it out on bed rest at home or take the paxlovid route and I chose the former.
Felt like crap for a week, coughing and sputtering, and the smell/taste problem lingered for a month. Still a little weak with the occasional cough.
I'd like to think that the vaccination routine mitigated my symptoms which, at 76, were obviously a concern. While I felt seriously lousy I never had a "come into the light" moment.
As I said we don't learn much from one example but the simple fact is that a shitload of people died and the vast majority of them (by far) weren't vaccinated. They can't tell you their stories.
I'm pretty sure we isn't. In fact I think we be on different continents.
"if Ehrlich had not erased all the press releases from his cobwebbedsite"
That showed his true colors. It was the last blatant example of a failure to act in the interest of investors prior to the recent failure to file a simple Lateness Notification. Both were extraordinary red flags.
Bullshit.
Of course I have a portfolio and I'll share it. The components have 3 things in common....they're all profitable companies that pay a dividend (as shown, along with latest ex-dividend and pay dates) and they don't have any messages from me on their Ihub boards. There have been less than 5 changes in the list in the last decade or so....none in the last 3 years....and the list includes only one real regret.

You can be sure that I will and it already has. I've avoided all the losses that others have collected. You?
Are you still holding any of that Plastic2Oil stuff that you pumped for 8 years until it died? Do you really think IPIX shares are worth twice what those honeys still go for?
At least that CEO played by the rules and filed a Form 15 when it was obvious his company was going nowhere. What do you think of a CEO who just ghosts his shareholders as this one has?

"yet another application for Brilacidin"
Another one? In addition to? What makes you think so?
It doesn't seems to be mentioned at the link or at the study referenced in that link.
Did I miss it?
I see. The only mention of brilacidin that I ever saw on their website was the July 2019 press release. If they ever provided any updates of their own related to brilacidin development (or so much as mentioned the project) I never saw them.
Maybe I'm looking at the wrong website...you continue to refer to the AF website. Maybe if you could provide a link to the "5 IBS- related entries" page(s) I could better understand what you are talking about.
edit: Is this what you're talking about?
https://www.alfasigma.com/research-innovation/
I don't know what you mean by this: "IPIX does not appear in the 5, IBS-related research areas as of this week."
"I am still unsure why there has been no explanation (that I could find) for the disappearance or simple loss of interest in IPIX."
You mean the loss of interest in brilacidin, right? Isn't it reasonable to assume that they couldn't foresee a profitable use for it? It seems they have a significant investment in gastrointestinal treatments already so perhaps they decided to avoid cannibalizing those efforts.
I suspect that If their tests showed promise they wouldn't have dropped the ball.
E)None of the above.
"I thought Alfasigma dropped this? "
They did. The source (https://www.pharmaceutical-technology.com/) is junk and I've said so before.

"Please explain why this play is not in the trips considering some say bankruptcy is next? "
I'm not 100% certain of what "the trips" are but the reason the price isn't lower than it currently is is because some knuckleheads find the sub-penny share price attractive and insist on buying them.
How far can "investors" bid up this share price without the benefit of any current information at all?

That comment is almost as brilliant as your last one regarding the lease debacle when you announced that "The 18% interest per annum is excessive and may be grounds for an appeal".
When you were informed that the 18% was a term of the lease (I guess you were as careful in your reading of it as Leo was) you disappeared. Now your reappearance is in support of a post that makes little sense.
"One can spin this how one likes, but it is definitely another achievement before the full approval."
Please explain how this is spin:
I didn't need to include it in order to refute your "So we have approval already" bullshit.
See if you can muster enough gray matter to respond to my point instead of just copying and pasting irrelevant material that you apparently don't understand.
I read that, of course. What's your point?
"Development costs charged by TheraCour were approximately $2,536,000 and $2,369,000 for the years ended June 30, 2023 and 2022, respectively."
Presumably AD earns a salary from TheraCour and that salary is included in those two numbers. Because TheraCour is a private company we aren't entitled to know what that salary is.
If there's a breakdown of the TheraCour charges in the 10K that includes the above quote (is there?) I couldn't find it.

"So we have approval already."
But for what? From your link.....
"Device Description:
The BeaMed Laser Surgery Fibers are sterile, single use, laser delivery devices intended for
medical applications in various fields of laser surgery. They are intended to deliver energy to
soft tissue in contact and non-contact mode during various surgical applications, including via
endoscopes and cytoscopes. The fibers are designed to transmit energy from the laser system
to the treatment site, as well as to transmit a low power laser aiming beam to assist in the
visibilty of the target tissue."
Approval to market the fibers that deliver the energy.
I'll let you or someone else explain how critical that is (it obviously isn't NEW).
There's a machine (old technology) that creates/develops the energy, there's software that drives the machine (the big promise...the potential purportedly under development) and there's the fiber (old technology) that carries the energy to the repair site.
"So we have approval already".......to sell an accessory.
Not evidence of any innovation at all.
Seek help and correct me if I'm wrong.
I'm still stuck on "There are many reasons to be skeptical".
I need to see much more before I abandon my "trust them about as far as I can throw them" perspective. A good start would be a trial that included formal documentation of its progress, a la https://clinicaltrials.gov/study/NCT04784897?term=brilacidin&rank=3&tab=history .
Right now we have the NNVC's CFO making deals with the President at Theracour who happens to be her husband:
https://www.sec.gov/Archives/edgar/data/1379006/000110465924024973/tm246547d1_ex10-5.htm
It'll take some verified efficacy in a trial that isn't conducted by friends and family to shake this feeling.
"Get their drugs to market"? Call me chicken little but I'm still not convinced that that's their intent. I have no basis for that feeling other than this:

"That is the billion dollar question which no one can answer. "
This question? "Why is Brilacidin included in their patents????"
That mighty be a multi-million dollar question if brilacidin was included on a product label. It's not. Until then a suggested use in somebody's patent application isn't worth a plug nickel....unless you want to assign some value to message board fodder.

About Spinogenix
Spinogenix was founded in 2016 with the mission to develop transformative therapeutics for diseases involving synaptic loss and dysfunction. Our drugs, which have nothing at all to do with brilacidin, are designed to regenerate synapses to reverse declines in cognitive and motor function and fundamentally change treatment paradigms by restoring neuronal connections regardless of the underlying cause of synapse loss. Synapse loss is associated with a variety of neurological and psychiatric diseases, such as ALS, Alzheimer’s disease, Parkinson’s disease, schizophrenia, and depression.
Finally....some content.
Interesting. Apparently the failure to file the SEC Lateness Notification when due (Thursday) triggered the downgrade....I believe OTCMarkets would have granted Pink Current status for another 5 days had that filing been made. As you might imagine that action is pretty rare. Most companies file the NT-10Q (there's no charge for doing so) if they intend to file by the end of the 5 day grace period, so this failure suggests either an inability or unwillingness to file.
What could be on this CEO's mind? I remember wondering the same thing when IPIX was downgraded based on failing to file the basic Annual Report with Nevada.
