California dispensary ruling ‘great’ for marijuana industry
A federal judge in San Francisco has tossed out the last remaining forfeiture action filed against a medical marijuana business in California.
The action, filed against Berkeley Patients Group three years ago by the U.S. attorney’s office in Northern California, was dismissed with prejudice on Tuesday, said BPG’s attorney, Henry Wykowski.
That means the DOJ will not be able to bring the case again, which equates to total victory for the dispensary.
Conference Deadline Approaching“This is good for BPG, but significantly overall this means we have now successfully concluded all four of the forfeiture actions that were filed by the U.S. attorney in Northern California,” Wykowski said. “And as far as I know, there are no coming forfeiture actions against the cannabis industry anywhere in the United States.”
Wykowski was also the lead attorney on the other three cases, two of which were filed against Harborside Health Center and another against Shambhala Healing Center. The Harborside case was dropped in May, and the Shambhala case was dismissed in 2014.
For a period, many believed the DOJ would be successful in running the entire medical marijuana industry out of business by using asset-forfeiture tactics.
“This is great. You’ve got to go back to four years ago when everyone thought this was the end of the cannabis industry,” Wykowski said. “And we fought back and we won.”

California Attorney General Predicts Legal Marijuana Victory

California Attorney General Kamala Harris hasn’t formally endorsed the state’s ballot measure to legalize marijuana, but she is predicting that voters will approve it on Election Day.
“The reality is that I believe the voters are gonna pass that initiative, and recreational marijuana will be legal in the state of California,” Harris said in a Wednesday night debate for the race to replace retiring U.S. Sen. Barbara Boxer (D). “We have incarcerated a large number of predominantly African-American and Latino men in this country for possession and use at a very small scale of one of the least dangerous of all of the drugs in [Schedule I]… We need to end mass incarceration of young people in this country for use and possession of marijuana.”
Harris, a Democrat, has said that her current state position prevents her from issuing an endorsement of the ballot initiative.
Harris’s opponent for the Senate seat, Congresswoman Loretta Sanchez, also a Democrat, touted her co-votes for marijuana law reform legislation in the U.S. House. She also said she has pressured the White House on the issue.
“I have been one to tell President Obama, ‘Stop it already. Let California get this right,'” Sanchez said, adding that a medical marijuana dispensary in her Congressional district is unionized.
Two years ago, Harris literally laughed off a reporter’s marijuana question rather than answer it. More recently, however, she has taken the issue much more seriously, saying there is a “certain inevitability” to the end of cannabis prohibition.
In the Senate debate, she called for marijuana to be reclassified under the Controlled Substances Act. “On the federal level, what we have to do is move it from Schedule I to Schedule II,” she said.
In the House, Sanchez has consistently voted in favor of amendments to protect state medical marijuana laws from federal interference and supported an amendment last year to extend the protection to all state marijuana laws, including those allowing recreational use.
A number of establishment figures in California have begun to line up in favor of the marijuana legalization measure, Proposition 64, whereas almost none spoke in favor of Proposition 19, a measure to end cannabis prohibition which the state’s voters narrowly defeated in 2010.
For example, Proposition 64 itself was drafted by a coalition brought together by Lieutenant Governor Gavin Newsom (D). In 2010, the then-mayor of San Francisco couldn’t bring himself to even issue a public endorsement of what could have been the first successful statewide measure to legalize marijuana.
And a number of prominent newspaper editorial boards — the Los Angeles Times and the San Francisco Chronicle, for example — have endorsed this year’s measure.
Boxer, the retiring U.S. senator that Harris and Sanchez are vying to replace, said that she’s “leaning in favor” of this year’s measure, whereas she opposed the one six years ago.
And while Gov. Jerry Brown (D) has been quick to trash the idea of legalizing marijuana whenever asked about it in the past, he told the Chronicle’s editorial board in a meeting last month that he is “mulling” whether to reverse his position and support Proposition 64.
Surveys have consistently shown the measure earning majority support from California voters.

Report: Canada rec cannabis industry could top $26 billion Canada’s widely anticipated recreational marijuana market could become a more than $22.6 billion industry once it’s legalized, according to a new report by Deloitte.
The accounting and consulting firm’s report, scheduled for release soon, concludes that adult-use marijuana will be a huge jump-start for the Canadian economy, the Toronto Star reported. Prime Minister Justin Trudeau is expected to introduce legislation to legalize rec marijuana next spring.
Conference Deadline ApproachingThe report estimates the base retail market could be worth $4.9 billion-$8.7 billion annually based on a survey this summer of 5,000 Canadians, including 1,000 identified as recreational marijuana users, the newspaper reported.
The market could balloon to $12.7 billion-$22.6 billion with the inclusion of ancillary businesses such as infused product makers, testing labs, security and growers.
To meet the demands of recreational consumers, Canadian growers will have to produce about 600,000 kilograms of cannabis annually, a substantially larger amount than what is being currently churned out by the country’s 36 federally licensed medical producers, the report says.
Factor in tourism revenue, business taxes, license fees and paraphernalia, and Canada’s recreational market could exceed $22.6 billion, according to the report, “Recreational Marijuana: Insights and Opportunities.”
The survey also found that 40% of Canadians support rec legalization, while 36% oppose it and 24% are undecided, the Toronto Star reported.
Canadians are also at odds about where cannabis should be sold: 24.7% said it should be sold in pharmacies; 17.9%, privately-owned marijuana retailers; 17.6%; new government-owned marijuana shops; 16.3%, existing government liquor outlets; 11.9%, existing private liquor retailers; and 11.7%, supermarkets.
In advance of the expected rec legalization, a committee drafting the language for the legislation is expected to finalize a draft Nov. 30.

Nine states will vote in November on whether to legalize medical or recreational marijuana, or both.
Leading up to the elections, the industry's penny stocks are trading as if most states will say yes to legalization.
Shares of marijuana firms that trade over-the-counter — not via central exchanges like the Nasdaq — are rallying in the run-up to the votes.
Companies in the industry struggle to get approved to list on the major exchanges partly because marijuana is still illegal under federal law.

The results of the votes next month could be a huge deal for the industry. California's vote is considered the most crucial given the state's size; its economic output in 2015 made it the sixth largest economy in the world, ahead of countries like France.
Earlier in October, Pew Research published a poll that showed that 57% of US adults say marijuana use should be legalized. A decade ago, just 32% were in favor of legalization.
The best companies would stand to profit even more in the industry, which is projected to grow to nearly $21 billion by 2020, according to Arcview Market Research.

Collectively, committees behind marijuana measures on the ballot in nine states have raised $3.25 for every $1 donated to groups trying to sink the initiatives, according to an analysis of contributions to campaigns for and against the proposals.
The data is encouraging for legalization supporters, as the comparatively large amount of money contributed to pro-legalization ballot committees will, ostensibly, provide an advantage ahead of the Nov. 8 election – in terms of further advertising, marketing, education, voter turnout initiatives, etc.
In total, pro-legalization ballot committees have raised $38.7 million, compared with the opposition’s $11.9 million. (The figures include donations in Montana, which has already legalized medical marijuana but is voting on whether to allow commercial production and sales.)
The largest disparity in fundraising between legalization supporters and opponents can be seen in Maine, where pro-legalization committees have outraised the opposition nearly 29 to 1.

Of the nine states with marijuana-related initiatives on this year’s ballot, only Montana’s pro-cannabis committees have been outraised by those in opposition to legalization.

In terms of total dollars raised, the eight ballot committees in support of legalization in California have raised more than any other state – nearly $20 million dollars – dwarfing the $2.4 million raised by the measures’ opponents.
And despite being outraised by legalization supporters, ballot committees in Florida have raised over $3.4 million to fight medical marijuana legalization, more than any other opposition campaign in the country.
In many states, ballot committees opposing marijuana legalization are receiving large donations from just a handful of extremely rich donors.
This year alone, Sheldon Adelson, a Las Vegas casino magnate, has given $2 million to opposition committees in Nevada and $1 million each to opposition committees in Florida and Massachusetts.
Pro-legalization committees, however, are being funded by a more diverse crowd, from individuals, advocacy organizations and, most notably, business interests.
The most current fundraising data available in each state was used for this analysis, but due to the differences in each state’s financial disclosure requirements, the date that constitutes “most recent” varies. The oldest data used in any state, however, is through Sept. 19.
In states where ballot committees are established specifically to support or oppose an initiative for the 2016 election, funding data was used going back to that committee’s inception. In states like Florida – where ballot committees established to support or oppose legalization initiatives prior to 2016 are allowed to use funds from previous election cycles – finance data was gathered going back to the day after the 2014 general election.
