Did it really take judge Pallmeyer since April 2017? How much longer can he need?
In the court filing from November the following is stated:
"On April 4, 2017, the court deactivated Appeal Nos.
2016-2231, 2017-1838 pending the district court’s ruling
on a motion for reconsideration in the underlying proceed-
ings. The parties in all of the above-captioned appeals
now seek to continue to stay all deadlines until November
28, 2017.
Upon consideration thereof,
IT IS ORDERED THAT:
The motion is granted to the extent that Appeal Nos.
2016-2231, 2017-1838 remain deactivated and Appeal No.
2017-1832 remains stayed. No later than November 28,
2017, the parties are directed to inform this court of the
status of the reconsideration motion and how they believe
these appeals should proceed.
Federal judges can take as long as they like to rule, but I've found that Central District judges are usually very efficient and rule quickly, within a week of the hearing date, which they usually vacate since they prefer no oral argument.
I am sure past production from San Felix is plainly stated on the Mexus website or in one of those Lemas reports. Right? So, should be easy to link to it.
That’s why I say it limits the bid. But it doesn’t matter which broker I use to place a bit, as long as they allow me to do so. And it shows up on every site as the best bid (if it is) and it will buy from every seller, no matter which broker, as long as they allow people selling their gers shares registrated at that broker.
Imminent is relative.
I think the problems buying at brokerage firms, just limits the bid. If you sell, you sell to the highest bidder. Or they buy from the lowest seller. The brokerage firm is just in between handeling your end. The one on the buyers side, handels his part. It can be the same firm, but it doesn’t need to be. Else, trading would even be harder. The bid and ask on trading sites all the same. Otherwise you would need to see lots of different bids and asks.
Thanks for sharing. So we have to wait for this part:
Is there anyway to know what's next in the motion for reconsideration? Does the court have a timeplan for this? What are the steps they need to take, or is it just waiting for the judges decision? Any idea what the need to decide also?
Is there anything you maybe can find out on pacer?
One question about the absence of filings and the lack of dilution.
BTZO stopped filing earlier, but still did seem to dilute. Any idea on that?
Wow great information. Any idea on the timeframe we are looking at as soon as the stay is lifted?
Also love the part about the filings.
“
On another note, I recall when the defendants weaponized our public filings. They used information in our financials against us to make some sort of argument to McKinney. Pending motions for attorney fee's and costs are most likely why the strategic, legal, decision to temporarily suspend filings was advised by our attorneys. As a result of the suspension, there has been no dilution.
“
Would he need to for attorny fees with this deal?
“Next, Cantor Colburn LLP ("Cantor") and the Company entered into an amended agreement pursuant to which Cantor agreed to accept 15% of any recoveries from the Company's pending patent litigation in excess of $3.6 million per year in exchange for all services rendered to date and moving forward. “
I would sue KK if I got bored. It’s the result of not filing, so he’s responsible if my wife gets irritated.
I understand how this translates in your opion. And I also think that the sentense “is now producing gold” can be misleading on its own. I however think it’s just a bad choice of words for saying ‘our test pour produced gold, and we expect now to go in full production resulting in more gold soon’. I think the sentense saying they expect more in December points out they weren’t referring to they have now got a tap, which they can open and gold pours out. But that’s how I read it. Yes with today’s knowledge.
After this PR, didn’t they encounter some issues they didn’t forsee? It wasn’t like they did say, every day we pour gold now and sell it. To me it sounds like the production process did start. I understand how some might understand it differently, it’s easy to read it the way I do afterworth, it sounds like they where a bit too optimistic at the least, but lying...
I read about test pours and being close to production, but not about being in full production, that’s why I asked for the recent PRs stating that they are in actual full production. I would love to be better informed, to make better investing descissions, if I’m missing important information.
I’m mostly saying, First I hear, there is prove they lied about producing, but no one is showing me a quote where they are lying about production. Then they say look at the chart... yes it drops, might be dilution, might be people jumping ship, but if they aren’t in production yet (as far as I know) it isn’t strange to me. So, I don’t see why I would pull any conclusion on what will happen soon based on the chart, also do I not see how that proves they have been lying. Since IMI they never claimed they where in production.
But thanks anyway and good luck to you too.
I don’t see how those are connected? Do they have realtime updates now?
Please read my post again. I share it under this one. This is what I read and how I read it. Unless it is a different text you’re referring to, IMO the mine producing gold, doesn’t mean they are in production. If you are referring to another text, please be so kind to share it, so I know what you’re aiming at.
"Mexus Gold US is an American based mining company with holdings in Mexico. Mexus recently joint ventured its flagship property with MarMar holdings of Mexico. The fully owned Santa Elena mine is located 54km NW of Caborca, Mexico. The mine is producing gold. "
You should read "The mine is producing gold" as what kind of metal you can expect. Not, that it is producing at the time it's written.
If you read back in the PR you will read "This milestone was the last step before full production can begin at the Santa Elena mine." It can't be producing gold at the same time as they state they weren't ready yet to produce gold.
Also note they say "The mine is producing gold" and in the PR about the test run they state "announced that staff at the Santa Elena mine have successfully smelted and produced gold"
That's the difference between saying what kind of precious metals the mine has, and what people do as an real action.
Replies:
It's right on their website. They've stated they

I think you got it the wrong way around. Some say Mexus claims they are in production, but they aren’t. I’m thinking Mexus didn’t say that. They have said they are close to production, and they soon will be. The difference is, saying they have lied, makes them less trustworthy. I say that as far as I see it they didn’t lie, and there is no reason to trust them less because of that.
Where do you think I got the quotes I shared?
Can you please supply what to look for? I only see the sentenses I’ve quoted. I would love to see the claim, as well as the context.
If you are referring to a statement like in this PR:
"Mexus Gold US is an American based mining company with holdings in Mexico. Mexus recently joint ventured its flagship property with MarMar holdings of Mexico. The fully owned Santa Elena mine is located 54km NW of Caborca, Mexico. The mine is producing gold. "

That's the difference between saying what kind of precious metals the mine has, and what people do as an real action.
I'm looking for the PR's where they stated they where producing. Can you please share them? I only see statements where they say they are CLOSE to producing.
Somewhere in the posts of 2017 you can find some info about KK’s beach appartment, his travels, his expensive lifestyle. Andvalso his instagram account. He is still living like a rich man.
But that’s the thing. Some might think it might make newbies think, they need to sell. I’m not saying they will. But it is more logical then selling 400 shares because you’re fed up with them
What about somebody trying to get the price down to get more shares at a lower price? To fool others to sell? Cheap way to do it.
A typo by someone who made a buy.

I agree on your post, let's not get dragged away.
so the SEC could agree with me and say that Kevin's failure to file was directly responsible for an unreasonably low price.
Whatever the rules are, KK knows them and will work them to his advantage.
It seems like you're avoiding my question. Any reason for that?
I happen to believe that we need to be patient any way, and that the only filing in our interest will be made by the court, saying GERS has won the lawsuit. Ofcourse GERS also filing would help, but no rush. Time enough between the stay being lifted and the outcome of the appeal for KK to take some steps. Or for us, if you like.
Never thought the cure could be worse then the disease?
I don’t think the sec makes you choose the penalty that motivates them best without harming investors interest.
What was the effect on these companies? More wanted to invest in them, because the sec criminalised them?
What would the sec (need to) do in your opinion as a penalty?
Could it be they delist GERS fromthe OTC? Stop them from trading publicly? Who would that harm or serve? The one who is about to receive millions anyway in this lawsuit, and holding shares which aren't traded on the open market? Or the common share holder like you and me, who might nog be able to buy or sell any GERS shares?
Or do you think the SEC can turn KK into a saint?
I know it, MXSG is doing it probably all wrong. Obviously some seem to know better. I can't wait for mining company startups by those who know what's so wrong a Mexus, I would buy shares of their companies straight away. I wonder why they don't work for Mexus.
Yeah I know
That's why you should always say "Read my lips..." when you are lying. Then they are looking in the wrong direction LOL
Yes, but 10x to 100x is far from counteracting the reverse splits. One at the most.
EDit: Okay make it two, since the SP didn't really drop after the last R/S
With all due respect, but I can't see how GERS would "counteract the six reverse splits". I believe in GERS and I believe they can easily get above $1
By the way, they went through 7 reverse splits. You'll find them here and add the 1:100 split from April 4th to that list.
To reverse that it would need to bring the share price from $0.1 to $15,000,000,000,000 per share.
Do that times 20 million to calculate the market value and that probably only represents 20% of the value of GERS.
It isn't that GERS did drop in price because of the reverse split, it was the dilution that did that, and the money acquired with the dilution is all used and lost. But the money used, doesn't represent the total value of what it would be if there would have been no R/S
Because I can have a photo, which represents an art value of $1000, I can decide to make another, which could cut the price in half, but it doesn't need to do so. However, if no one is interested in buying the second photo, the price of the both in total could drop way below the price of first one.
So it could be the total now represents a value of $10,-
It's a bit the same with share prices and market value. When you dilute, the price could drop way more, especially if the money gained from selling the new shares is lost. People loose trust, and it ends up dropping in a free fall, which happened to GERS in the past.
It sounds to me as they are close to production again. Of course, things can always go wrong again. But from this PR I would say that we should expect more positive news this month. I think one should not care too much it doesn't move the needle straight away. If the problem is fixed and they come to production, and if the other projects are moving forward too, it will move up. I'm not in a hurry, as long as it is a few steps forward, until we go a step back. It might not move up in a straight line, but two steps forward, one step back is fine with me.
If you are behind on one 10-K, do you then still need to file an NT 10-K for the next year?
