USA did nearly 80,000 acres of industrial hemp in 2018.

In 2016, under 10,000 acres planted.

Canada planted 140,000 acres in 2017, and most are expecting a 2018 production decline. Why?

Well, obviously, going 10,000 to 80,000 acres in 3 years is why. Canada knows what's coming. The worlds largest consumer of hemp based goods is now producing hemp of its own.

How many millions does the USA consume? Soon to be BILLIONS and BILLIONS?

As the multitude of uses begin to be engineered and tooled in the 21st century, so will the need to increase acreage. Not sure why the comparison to corn and soybean are being tossed in, but hey, corn and soybean are good things too, like hemp.

Hemp Inc and Bruce in hot pursuit, and have been for many years. The laws have finally changed, and some reform still to be finalized, but floodgates swing free in the open breeze, and a spill of hemp dollars awaits.

Who's says dollars don't grow on trees? Maybe dollars were always made out of hemp, and gov needed to outlaw plants' production to deter counterfeit bills?

He said the agency will solicit comments to establish a framework to allow CBD to be put into the food supply and laid out “theoretical frameworks” for CBD regulations.

Rep. Chellie Pingree of Maine, who was part of the group that sent the letter asking for answers, asked for a faster process.

“The timing [is urgent] because so many of our states have legalized hemp and have hemp growers going on it.” Pingree said.

“And as you know CBD is being sold in a lot of places and the role of FDA confuses everyone, I think.”

Gottlieb assured her that CBD regulation is a high priority for FDA.

FDA Plans Hearings on CBD Policy

Following hemp legalization in the U.S., the FDA must now figure out how to regulate hemp-derived CBD as a food and beverage ingredient.

When the U.S. Congress passed the 2018 Farm Bill in December, legalizing domestic hemp production and sales, the Food and Drug Administration abruptly interjected to say that hemp-derived CBD would not be permitted as an ingredient in food or beverages—the very thing that many companies and consumers had been celebrating as Congress cast its votes on the bill. CBD, according to FDA Commissioner Scott Gottlieb, must be treated as any other pharmaceutical compound.

The administration took a hardline stance, but signs are pointing toward a softening approach to setting new CBD policy in the future.

“It’s unlawful under the [Federal Food, Drug, and Cosmetic Act] to introduce food containing added CBD or THC into interstate commerce, or to market CBD or THC products as, or in, dietary supplements, regardless of whether the substances are hemp-derived,” Gottlieb wrote in December. “This is because both CBD and THC are active ingredients in FDA-approved drugs and were the subject of substantial clinical investigations before they were marketed as foods or dietary supplements.” CBD is an active ingredient in the FDA-approved Epidiolex. As such, a precedent had been set on this chemical constituent of cannabis; any products containing CBD would need to work through a “pathway” to FDA approval, which includes clinical trials.

Now, in testimony presented before the House Appropriations Committee on Feb. 27, Gottlieb said that his administration will revisit the CBD question. He said that plans are in the works for a public meeting in April to develop a set of rules for CBD regulation. “I’ll say at the outset that we heard Congress loud and clear with respect to [the Farm Bill]. … We believe it does have therapeutic value and has been demonstrated,” he said. “But I will tell you this is not a straightforward process. There’s not a good proxy for us doing this through regulation.”

Jonathan Havens, partner at Saul Ewing Arnstein and Lehr, told Cannabis Business Times that the rulemaking process at the FDA is complex, and, ultimately, may demand legislative intervention from Congress. The hearing in April will suss out the protocol here.

What’s happening in the immediate sense is that hemp-derived CBD (cannabidiol extracted from a cannabis plant containing less than 0.3-percent THC) is set on a distinct regulatory track from state-licensed cannabis businesses. CBD that’s been tested and is being sold as a concentrate in a licensed dispensary in, say, California, is going to be treated much differently than mysteriously-sourced CBD pens that show up at your local gas station. Even CBD concentrates extracted from legal hemp plants grown on a licensed farm in North Carolina: Because that chemical constituent is under the province of FDA oversight (because of the Epidiolex clinical trials), they can’t be openly sold in the consumer goods marketplace.

“If something is studied in a substantial clinical trial, and/or if it's the subject of an approved drug application, then it's not a permissible dietary ingredient,” Havens said. “The FDA’s position has nothing to do with the [former] federal illegality [of hemp], although I think they would probably tell you that you shouldn't put a federally illegal substance into anything else—and then sell it to interstate commerce—because then you've got a problem on your hands.”

The FDA has issued stern warnings on this subject, including Gottlieb’s December letter. State and local authorities in some jurisdictions, including Ohio, have preemptively begun confiscating CBD products in stores (not licensed dispensaries).

Despite those warnings from the federal administration, uncertainty is a driving force in how CBD policy is enacted.

“I will tell you that we’re deeply focused on this. We have taken on other hard challenges before,” Gottlieb told the House Appropriations Committee this week. “I think we have a good track record of trying to come to resolution on other challenges. You have my commitment that I’m focused on this one.”

My sentiment is it's nice to see them continue to develop the industry with seals of approval. Just another step in the hemp-boom direction, will serve to strengthen the industry even further.

Not every company going to be on that list, more will be included in the near future, and there will probably be several other "seals" coming, as well; as you mentioned, your industry has several seals of its own.

I've worked with guys like UL in the past. I would expect they will be joining the hemp realm soon, in some capacity, if not already.

NC hemp growing is still under the Pilot Project, and farmers may apply to grow as long as they meet the requirements. Requirements include designation/filing with the IRS as a farmer. The Food and Drug Administration (FDA) is investigating “possible alternative approaches” to regulating CBD products, Commissioner Scott Gottlieb said on Tuesday.

During a speech at a conference hosted by the National Association of State Departments of Agriculture, Gottlieb recognized that many members of the organization were interested in the “regulatory framework for products derived from cannabis.”

He started by reiterating that the 2018 Farm Bill, which federally legalized industrial hemp, “specifically preserved” the FDA’s regulatory authority over products that contain cannabis or cannabis-derived compounds. The agency will continue to take action against companies that make unsanctioned claims about the therapeutic benefits of CBD products, engage in interstate commerce of foods containing cannabis compounds or market such products, he said.

But the commissioner also made a point of emphasizing that the FDA is open to exploring other options when it comes to regulating CBD.

“We’re planning to seek broad public input on this pathway, including information on the science and safety behind CBD. But we know that this process could take time,” Gottlieb said. “So we’re also interested in hearing from stakeholders and talking to Congress on possible alternative approaches to make sure that we have an appropriately efficient and predictable regulatory framework for regulating CBD products.”

That’s similar to comments he made shortly after the Farm Bill was signed into law in December. Gottlieb said at the time that “pathways remain available for the FDA” in terms of permitting cannabis compounds in food and dietary supplements and also to lawfully market and sell products containing CBD across state lines.

But prospective hemp manufacturers are eager to get the ball rolling, and recent state- and local-led crackdowns on foods and drinks containing CBD have prompted federal lawmakers to pressure the FDA for clarification. A bipartisan group of members of Congress sent a letter to the commissioner earlier this month, imploring him to “provide guidance on lawful pathways for food products with CBD.”

Later in his speech, Gottlieb said “it’s important to note that CBD isn’t risk free” and that “there are potential risks associated with its use.”

Companies can continue to “seek approval from the FDA to market human or animal drugs derived from cannabis,” he said, pointing to the cannabis-derived anticonvulsant Epidiolex. And Gottlieb also mentioned that “hulled hemp seeds, hemp seed protein and hemp seed oil” can currently be marketed in human food.

More than just MJ companies from Canada gonna want a piece of the hemp/cannabis pie.

Hemp Inc will need to start showing some decent revs from hemp specifically in order to get a real bid. The assets and supply chain have value as it is today, but consistent revs will certainly get attention from a potential group looking to enter the sector with a known quantity.

That is IF Bruce thinks he's ready to sell. He might not. Could have something bigger in the plans.

How many of the listed state registered processors has the necessary equipment to offer multiple service lines of hemp processing? Any have decortication output capacity the size of Hemp Inc? Servicing multiple states?

LOL, nice try, SEC been stalling on it's own case virtually before it filed the civil complaint years ago. Delay after delay, extension after extension, looking for anything.... but stilll nothing, zip, nada. Shows, too, how they came in with just a few days to file before satutes of limitations kicked in. No factual matter. No evidence. Judge will let it go to trial unless SEC amdits defeat. Sad, too, they would like it go so long on so little. The arguements will undoubtedly shrivel and die in front of a jury, but they'll throw the whole book before SEC goes to its knees.

This whole sector is, and has been a long play. Put your money on the companies actually showing some traction, especially the ones being lead by actual industry leading experts.

Bruce is one of those experts. Not too many people can say they lead a BILLION dollar cannabis distribution.

Stock price setting up for earnings.

M&A's heating up.

Extra-large processing facilities and supply chains take time to fully develop, especially when primary product is heavily federally regulated.
