Apex Silver Mines Limited (NYSE Alternext US: SIL) has received notice from NYSE Alternext US LLC (the "Exchange") stating that (i) the Company continues not to be in compliance with Section 1003(a)(iv) of the Company Guide in that it has sustained losses that are so substantial in relation to its overall operations or existing financial resources, or its financial condition has become so impaired that it appears questionable, in the opinion of the Exchange, as to whether it will be able to continue operations and/or meet its obligations as they mature (ii) the Company has become subject to Section 1003(c)(iii) of the Company Guide which states that the Exchange will normally consider delisting securities whenever advice has been received, deemed by the Exchange to be authoritative, that the security is without value, and (iii) the Exchange intends to strike the ordinary shares of the Company from the Exchange by filing a delisting application with the Securities and Exchange Commission. The delisting application is expected to be filed on or after February 2, 2009. The Company does not expect that it will appeal the Exchange's decision to delist the ordinary shares.
The Company anticipates that upon delisting of the ordinary shares, the ordinary shares will commence trading in the over-the-counter market.
The delisting of the ordinary shares from the Exchange will not affect the Company's reporting obligations under the rules of the Securities and Exchange Commission.

I am not sure of the exact date - but I do know this much:

Now: Consider this: April, 2009 - 5 million shares will be available for MEC to sell - they will not be happy with these current prices and will be encouraging buying from other members - I would be looking at this in March - try to catch it really low before for the PROMO - and then unload right before they can!
Could prove to be profitable! It helps when they give a date - because then you can put yourself on the right side of the action

If Brian sold out 18 months ago - why did Diversity spend $40,000 trying to figure out how to get Brians shares back?
I spoke to Brian - and he said it was stupid of the company to spend $40,000 trying to screw him out of the money he was owed!
He would have settled for much less - he also told me his shares were escrowed until he was paid - which they never did!
How do you come up with him selling out 18 months ago - when he told me that his shares were in escrow less then 3 months ago?

I actually have about a 1% hope it becomes a Q - but I am 99% sure that when they issue new shares - the old ones are just cancelled instead of traded to the PINKS.
If they would have been delisted first - then they would trade on the pinks even if they were cancelled.
Pinks don't care if there is a real business or not - LOL
Many of the people that buy - when asked what they do - most admit they made the majority playing stocks - of course it was during a time where you couldn't go wrong - LOL!

Which means - they just cancel the old - no hope of ever trading again!
