Town increases legal action to halt unlawful fill operation

onto the property.
After a lull in fill activities for
more than a year, neighbouring
residents began witnessing truck
loads of fill again being trans-
ported onto the property and
called the Town to complain.
Council addressed the issue at the
June 3 council meeting and heard
from the Town’s Director of
Planning what measures the
Town has taken, together with
those of the York Regional Police
and the Lake Simcoe Region
Conservation Authority.
Mr. Lenters told council staff
immediately responded and ad-
vised truckers that fill activities
were not permitted and the owner
was issued an order to cease op-
erations.
“That wasn’t complied with,”
Mr. Lenters said and the Town’s
solicitor was then instructed to
take whatever legal steps were
necessary to stop the import of
illegal fill.
“The papers that need to be filed
and served against the owners are
being done now,” he said. “The
Town can’t physically stop it and
it is frustrating because of what is
happening. Nobody likes it but
unfortunately there is a due proc-
ess that has to be taken.”
Mr. Lenters explained that the
property has been the subject of
previous litigation between the
Town and the Ministry of Natural
Resources and there was a deci-
sion by the Superior Court which
issued an order to cease the fill
activities.
Mayor Quirk said residents who
had contacted the Town were
concerned about the environ-
mental impacts of the fill being
brought in.
“There is a lot of concern about
the fill going in there. It hasn’t
been tested, it’s not regulated and
what is it doing to the environ-
ment,” she asked adding, “we
also need to kno
w what can we
do to get that fill out of there...
We need to know how we can
force them to remove what they
have put in.”
Mayor Quirk’s frustration at the
owners “thumbing their noses at
us” and refusing to
stop the work,
prompted Regional Councillor
Naomi Davison to suggest clos-
ing the road but it was agreed a
legal opinion would be needed
before they took that step.
While the property at one time
was owned and operated by
Marvin Blanchard, Mr. Lenters
said there is a question of who
actually owns the property now.
The Georgina Post contacted Mr.
Blanchard and he said, while he
still lives there, he sold the prop-
erty to a numbered company last
fall. “I have no involvement,” he
said. “I have no idea. I’ve washed
my hands of it.”
Staff will continue its efforts to
force compliance through legal
means and will update council
next week on the progress.

After a successful four-year challenge to a large-scale fill operation in the tiny hamlet of Baldwin, area residents were alarmed to see hundreds of dump trucks, once again, making a daily trek through their neighbourhood to the same “illegal” dumping site last month.
Under new ownership, the property, located at 6107 Smith Blvd., has been subject to litigation in the past involving the Town of Georgina, the Ministry of Natural Resources and lawyers representing previous owners Marvin Blanchard and Leonard Rosenberg over fill applications and subsequent dumping activities.
Despite Superior Court and Appeals Court decisions, including injunctions against the dumping of fill, hundreds of trucks have been entering the property during the past month.
That prompted numerous area residents, including Sarah Smithias, to raise the alarm with the town.
“This is a huge environmental issue,” Smithias said, echoing the sentiments of many of her outraged neighbours.
“Not only are they ignoring a court-ordered injunction, but there are literally hundreds of trucks going by my house daily into that property dumping who knows what,” she added.
Concerned about potential threats to the soil, groundwater and nearby river from unregulated and potentially contaminated soil, Smithias reached out to various agencies, including the town, the Lake Simcoe Region Conservation Authority and the Ministry of Natural Resources in hopes they could stop the illegal activity.
“Nothing is being monitored and no one is stopping it,” she said. “This is a serious issue that could impact the entire watershed and that affects everyone, not just our neighbourhood or our community. And even if the fill is clean, it is still being done illegally.”
Those facts weren’t lost on Mayor Margaret Quirk, who said the owners of the property are “basically thumbing their nose at us at this point,” during an update on the situation to council June 6.
Aware of the concerns from the community regarding the potential risks to the environment from unregulated and untested fill going on the property, Quirk said, “right now we are just trying to get it stopped.”
Specific options available to the town were being brought back to council this week, but the town’s director of development services, Harold Lenters, said town lawyers have been asked to take “every step possible as quickly as possible.”
After residents notified the town of the ramped up activity in their neighbourhood May 29, town staff went on site for an inspection, advised the people doing the trucking that fill was not permitted at the site and that there were no municipal approvals for the activity, Lenters said, adding a subsequent order served on the owners to cease was ignored.
“It’s frustrating for everybody because of what’s happening, but, unfortunately, there is a due process that has to be taken,” he said.
“The papers that need to be filed and served against the owners are being done now,."

Dump trucks making a daily trek to an "illegal" fill site in Georgina for the past month sparking alarm from area residents over potential environmental effects from unregulated dumping and possible contaminated soil have finally stopped.
According to an update from the town’s development services department at council last week, the owner of 6017 Smith Blvd in Baldwin is now “co-operating” with the municipality after ignoring court orders and requests to cease ever since area residents in the tiny hamlet noticed close to 100 trucks entering the site daily since late May.
Concerned about potential threats to the groundwater and nearby river from unregulated and potentially contaminated soil, resident Sarah Smithias reached out to various agencies, including the town, the Lake Simcoe Region Conservation Authority and the Ministry of Natural Resources, in hopes they could stop the illegal activity.

As of last week, however, there was no trucking activity in or out of the site and the town continues to monitor the situation, development engineering manager Zaidun Alganabi said, adding, “We are working with our lawyers, municipal law enforcement and external agencies to ensure the site is fully restored to its original state with no environmental impacts.”
He added the town does not have knowledge of where the fill came from and there is still fill on the site, based on investigations to date.
"The material will have to be tested before being exported out of the property in order to go to a proper dump site," he said.
Fill activities at the Smith Boulevard site have been a controversial issue dating back to 2013.
It has been subject to litigation in the past involving the Town of Georgina, the Ministry of Natural Resources and lawyers representing previous owners Marvin Blanchard and Leonard Rosenberg over fill applications and subsequent dumping activities despite Superior Court and Appeal Court decisions prohibiting the import of soil to the property.
The town has spent $54,000 to date on legal expenses regarding the property, which was recovered through legal proceedings.

Bawbie. At 1.2B shares as an average x by a $0.016 share price which rounded up is where EAPH closed Friday. $20 million dollar valuation!!! What a joke! What does this company do to even justify a $1M market cap? True value is shell status since nothing has ever happened in many years imo. Shell status on a blood letted pink is maybe $50k. Price should be $.0004. And that is if all current management is fired and baking in a massive reverse split which is sure to come. Penny and a half? What an overvalued pig and no wonder insider pigs have been selling recently.

But I would like to add if I may that I feel that it is only being ignored by two posters of many years with thousands of posts (pretty much 99.9% of their posting history on EAPH) pretty much only spewing pro EAPH nonsense. Both of which have had numerous slip ups where they talk about something that is announced shortly thereafter by the company.
Why has everyone else apparently given up? Seems almost all others over time simply just can't take the lies, pain and losses, but there are two who apparently can and no matter what happens whether the stock is .10, .001 or anywhere in between are purported buyers daily and it is portrayed as a screaming scorching buy, no questions asked. To add, the same thing was said at .09 years ago. Screaming scorching buy. Failed after failed after failed deal. Who would put up with that? I personally think I know. Maybe I am wrong.

How does one even operate a public company without a bank account as announced and made public in the recent Q? Was it seized due to the lawsuits surrounding the CEO? Who was the director that took the $200,000 payment on behalf of EAPH? Now apparently EAPH has to put in their financial statements that they have no control over the funds and could be deemed unattainable? Doesn't a director have a fiduciary duty to act in the best interests of the company and its shareholders? How does a company even put that in their financial statements? THAT IS FRAUD! No if's and's or but's. 100% fraud. Spelled out and accepted by the company that has this person as a director!!!!! What action was taken? None? Proves acceptability by the rest of the board.
What is going on internally? Maybe when the beans were accidentally spilled yesterday by a long standing advocate of EAPH's ihub board poster with questionable insider knowledge that the CEO might be fired, it starts to all make sense now?
