A letter needs to be sent to management to let them know that this is totally unacceptable and if it goes thru then further action on behalf of the shareholders will follow. NO more being led blindly by the nose to slaughter!!
Or, they could be waiting for the USPTO ruling that will absolutely seal the deal in regards to who owns what.
Why rock the boat now when there is still uncertainity regarding the patents, I personally think that IM is well aware of who is infringing and plans to deal with them in the very near future.
krays, there have been several comments by prominant people in the industry, all of them say the same thing. I wonder how long it will be before ctia realises their mistake and corrects the problem?
Jonsie, not saying that Virgin ever paid us for a license, just stating that as big as they are compared to what NEOM was back then I'm sure that they looked at our patents very closely before they conceded and "purchased" a license.
I totally agree that the only settling we have seen is the pay packages of all the former C.E.O'S, C.F.O'S etc as they exit the company. I want a job where I can go in, not do a damn thing except grind the PPS down and then get handed a ton of money when I leave.
Ninja200 you are absolutely correct IMO. Any carrier that is pre loading any reader is a good start and with the Papa Johns trial along with ATT, well I hope that we hear soon that the neoreader is going to be pre loaded onto the ATT phones.....
But don't you also think that "Virgin" has a legal department that also looked into the patents prior to them settling?
I agree this is terrible news. I have told myself that I will give the "boys" til the end of the year to show us something, anything that is promising, if not then I will cut my losses and play elsewhere.

CTIA White Paper on Mobile Barcodes Part 2 – Bena Roberts turns green

OK. So I went to CTIA knowing about mobile barcodes but a stream of events plus talking to founders of DataMatrix codes has left me feeling a bit like a guru.
I spoke to Scanbuy for its side of the CTIA saga. I got a response but was asked not to publicise it? I also got an email about the white paper sent to friends and key partners from Scanbuy via a Scanbuy fan and good friend of mine. I was also asked not to publish that.
So, here I am in a strange situation. I want to provide neutral reports of analysis and commentary on the mobile barcode paper. I have read it so many times now and have spoken to the leaders of the major mobile barcode companies (plus emails with Scanbuy).
So what do I think?
Well. I haven’t changed my mind. The paper is very strange and adopting EZ codes and the potential of a license fee approach is stupid.
Now – don’t get me wrong. If you read back far enough and also on http://www.pushingthebarrier.typepad.com you will see that I used to hate NeoMedia. I thought Chas was very angry in the early stage of the company and I wrote at length about how the license fee will kill the market not allow it to grow.
Since then –NeoMedia has changed its approach – become open and killed the license fee model. The goal now is for one common adoption standard of 2D codes and universal readers. This is a great model to have. I now after about a year like NeoMedia and the company has worked very hard to get me involved as well – as blogger/press/analyst attention is vital.
The fact that Scanbuy is not being overly bullish or shouting about this and not allowing me to respond or publish responses - troubles me. So I spent the past days listening to recordings of interviews Abaxia, Scanbuy and others. In each of these interviews I asked about the license fee model and it is Scanbuy that states very clearly that they will not ever pay a license fee. Now with this CTIA change of events to me Scanbuy is the old NeoMedia.
But what is worse is that Scanbuy doesn’t own the patents and its indirect form of barcode which it uses is the patent that is being questioned right now. So that if this does go ahead and Scanbuy is infringing NeoMedia patents – then what a joke that is.
But I am not angry at Scanbuy – I am shocked at the stupidity of the CTIA. What a joke. How could you publish something like this when there are issues about patents –how can you support a proprietary code and license fee when others are fighting for open standards.
I am in shock. Something smells here.

I have been promised an interview but no more?
I am trying hard to be biased but I have a recording of the CEO of Scanbuy slating the license fee and now he is endorsing it – this is all within 9 months?

YJ,I also wonder why they are allowing 75 min.for the CC. One would think that what ever they have to say must be substantial, otherwise I can't see it taking more than 5 min. to say "hey, were broke and closing the doors" or "were doing a RS and we don't care if you like it". I'm thinking that what ever it is, it has to be something big in order to give IM enough time to lay it out and explain it to those that are listening in.
I posted that awhile back, unfortunately it is a "scanbuy" ad. Unless this is new and scanbuy has been removed as the app. to download.
What do you plan do to? not wait and see. If you have another plan of action please fill us in, if not, I will stick to seeing what Iain can do for me and my investment.
I don't know if it's to late or not, But instead of calling people out, how about letting us see where Iain leads us and whats instore for the rest of the year and '09?
YA is in the business of making money, a very sound business plan. Do you or anyone esle really believe that they would have invested even 1 cent more, not to mention over 8 mil. dollars more if they suspected that they were going to lose it??
I have no problem personally in the fact that they are going to make alot of money here, but you know what, so am I and everyone else that is holding long.
It really pisses me off when some here are now calling out Bena and lumping her in the same sentence as SS and TS.That is uncalled for and total rubbish!!!! IMHO!!
I'm happy to see the campaign use the QR code, and I'm happier to see that the iphone/Neoreader are paired together, any exposure at this point is good exposure.
So did we drop down to .006 to fill a gap?? I sure hope we get some more news and keep this moving North.
Thats what Im holding out for. It is going to be interesting to hear what iain has to say in the CC. Hopefully he will provide us with some much needed information on where he is taking us and maybe give us a look into the future of the company.
Here's mine for what it's worth....we will continue our upward move in the PPS. I think people (new investors) have been comforted by YA and their generous gift lol, to us. Why would they give us even 1 more cent if we were going to lose the patent case, or should I say that they lose their patent case since they own them.
since Friday our shares traded have been off the wall. I believe that we have finally turned the corner, now if we can obsorb all the shares that those of us will be selling once they reach green, dont think alot of longs are going to stick around for huge profits which in my opinion will happen in the next 1- 1 1/2 yrs.

Why do you feel that it is up to someone else to provide info so "potential" investors can see the whole picture?
How about "do you own DD and then make up your own mind", all of the info you want sean to post is readily available for anyone who takes the time to research their possible investment.
As a non-investor you sure are demanding of others to provide you with everything you ask for, I think Sean has answered your question to the best of his abilities, so why keep beating a dead horse?

Edited: It look's like to me that this response was sent out in response to the original request for re-examination and basically telling EFF that there claims have been rejected.
All of this is only speculation on my part as I don't know enough about this to be sure, but man I sure hope that's the case. We need a win, even if it's only a partial win in the patent dispute. Maybe, if this goes in our favor then renewed buying interest will pick up along with our PPS.
I can't believe that this is rejecting all of our patent's. It looks like to me that all of the EFF'S claims were rejected. I would be dumbfounded if this is against NEOM and all of there patents have been rejected. Thanks for posting that jonsie, hopefully someone soon can clarify this.
