I would have thought it obvious to everyone by now that remarks be they concerns,frustrations,criticisms,observations, assurances made by genuine investors, or remarks by management via Press Releases count for nothing. Time for promises and empty rhetoric is over. Besides no one is listening.
Our future is now firmly in the hands of traders like Power Battles and several others who have come out of the wood work in recent days as we approach our day of reckoning.
It is the market and the desire by those active in it who will decide our fate and drive the share price up or down.
I am amused and bemused by recent comments.
Let's hope that powerbattles can rally the troops sufficiently to increase the share price and wear down those forces which we know have been actively working to suppress the share price in recent times. powerbattles and his cohorts are the best allies we have.
Now is not the time for those genuine investors out there to be asking tough or serious questions about capital raising, prospective equity partners, product release etc.
Now is the time to buckle up and see and where the events of this week and beyond lead to.

Disillusioned also fits my general frame of mind at the moment.
Randy and I have had serious doubts in recent weeks as to whether Smme really can or will actually produce anything.
With Randy now out of work and my employment on very shaky ground(i cant be sure i'll have a job next month) we may well need to start selling down our considerable sharing holding to meet our financial commitments.
Whoops - a reality check. The current value is less than the sum invested.
Oh now isn't that just great.
Some people would say hey Little you and Randy are plain greedy. Maybe?
What I know is that we chose to accumulate shares by providing necessary funds via private placement throughout the past 7 years always believing the company had the ability to produce. Then during 2010 the litigation emerged which added meat to the bone. We continued to increase our holding confident on our decision.
Now I'm not so sure.....
There is nothing / absolutely nothing at the present time which gives me the confidence that Smme can successfully produce anything.
I'm sorry but they just haven't proved it. Yes I've been told numerous times we are so close.
I fail to understand how and why the company has not been able to attract sufficient funds other than from people like us.
I'm perplexed that we've heard nothing regarding any scheduling re appeals court which lets be honest has been the only thing we could hope to hang our hopes because reading numerous PR's about products out in the never never gives false hope and little promise.
I actually hope there are persons out there who can read between the lines know who LMU and Randy really are. I mean those individuals out there running the show those same people who I speak to on a regular basis who fill me with such promise and can finally back it up with substance because you know what folks we put everything we had and more into this and we sit here now unsure about our future and the future of Smme.
I actually need to see something because you know what I'm sick of it.
Please note that this is my very very last post.
I have always asked questions hoping that those with the answers would respond.
Unfortunately the answers I've been seeking have not been forthcoming.

PR out overnight states by the end of 2014, 100 million EMV cards with chip will be released in the USA.
I would like to know what Smme thinks their share of this number might be?
I think it's a fair question as it gives the company a further 6 months to raise the capital required, iron out the bugs and negotiate terms with suppliers.

I'm still waiting to see the current generation of cards.
Like everyone else regardless of how long or how many shares I own, I too grow extremely frustrated with the time its taking SmartMetric to have available a physical product of any kind for release to the market.
I may well be one of the many long term loyal shareholders who in recent days have grown increasingly despondent about when and if SmartMetric has the wherewithal to get product to market.
As I try and put on a brave face and maintain my belief I find myself being mocked by friends and family who scoff at the mention of Smart Metric. I can only hope I have the last laugh because at the moment it's not a laughing matter. Randy and I have stopped talking.
As has already been stated products were supposed to be released during the first quarter of 2014. We now find ourselves closing in towards the end of the second quarter and still nothing and very little by way of explanation as to why there has been nil products released.
An injection of capital appears to remain paramount in funding and supporting production. It's apparent that funding from various quarters has not been forthcoming to support production to date. This poses the question as to what opinion the market has about SmartMetric and the likelihood of them succeeding.
Throughout the corresponding period we continue to read via PR's aspects of Smme's products which is unhelpful. As the doubt about product release grows I find myself falling back on the hope (perhaps the company's only hope)of a successful outcome concerning litigation.
This contradicts my reasons for investing in SmartMetric and remaining long.

Interesting remarks made by Duke regarding short selling. I also queried the quantity stated however the principles of what Duke is saying is I suspect correct. That is there are forces at work I'm sure keen to see SMME fail.

Your platitudes are admirable to say the least.
The difficulty for any chief executive and especially one running a public company is that they will always be subjected to scrutiny by their shareholders.
When information as it's apparent is only available via Press Releases which for the most part only heighten investor frustrations such as the PR released today then I believe investors are entitled to continue questioning management - any management for legitimate answers to valid questions or concerns.
Today's PR whilst talking about the future release of products (yet again)offers little in addition to the previous press release.
Pr's like those released today only increase Market scepticism and investor frustration.
Whilst frustrations continue to mount we may all be better served to request that the next PR should probably be released announcing the confirmation of actual product release or something monumental in relation to litigation.
Anything else serves very little purpose.

I would suggest that SMME and it's Investor Relations company refrain from releasing any further meaningless communications of this type until the eventual release of actual products.
These types of communications only add to the frustration which already exists within the market place.

With all due respect how would we know?
We are yet to see the card - any card or other product.
I believe it would be more prudent to update the market on the status of proposed release.
These types of PR's which have been numerous only cause angst among the genuine long term investors who are keen to see and await the eventual release of the SMME card.

Anyway DFLY Post #15 dated 23rd March 2010. One of the first announcements regarding SMME sues V & MC.
4 years on. God it's been a long time with many twists and turns and some way yet still to go.
4 years in relation to the lawsuit however isn't a long time when you compare it with the amount of time and the talk, PR's etc in relation to the release of products. This has probably been talked about for a lot longer. In fact when we first started talking about our investment in SMME Randy didn't need to take the medication he takes these days. Let's just say we've been thinking of a name change in recent times.
Last weekend we were sitting there with Col the Doll having our Vodka's and Tonic and she said Little "do you think this is going to happen?"
I said Col I've never been more sure. We are so close.
OBP I agree with you that I'm surprised there has been no statements regarding product roll out or at least an update.
That said until monies are received by brokers or additional capital raising to enable products to be rolled out then there may well be little said.
Bottom line is until sufficient funding is secured to enable products to be manufactured that there won't be any release.
I'm confident every effort is being made to secure the last monies required to enable product roll out very very soon.

I sense you are anything but "amused" disenchanted might be a better way to describe how you feel.
How do you know there is "nothing left"? How do you know there is as you put it. "no chance of a legal financial bonanza".
I can feel your frustration - no doubt about it.
No one can be sure about how the legal battle may turn out but I'm reasonably confident that once the final monies are received and I believe we're almost there product release will follow.
Ms Hendrick has her reasons for choosing not to bring partners with capital on board and whilst it may be frustrating and could well be a primary reason for delay with product release we must respect her reasons.
Yes it's been a long time coming. No one denies that.
You've got to believe we're so close. I would urge you not to give up now.

As we count down towards the end of the first Quarter and with a series of Press Releases I find myself asking the following question.
Production v Manufacturing?
The reason you see is in the PR dated 21st March it states "readying to move into production". In the PR dated 24th it states "readying to commence manufacturing".
I sought the following via Google. Although my Doctor is forever saying "Little stop googling your symptoms"
Nevertheless.........................I found the following

Interesting argument put up by V & MC in that they don't control the technology. The obvious question - who does?
I can only assume they've decided the best form of defence is to place their trust in the original ruling brought down by Judge Fitzgerald when he found in their favor back in September making reference to comparing "apples with oranges" and hope the Appeals court doesn't over rule Fitzgerald.

Thanks for the link however what caught my attention is the ability of the mentioned company to attract 19 million in funding.
What is this company doing to attract funding when Smme continue to struggle to raise sufficient funds to complete the supposed production and release of one or more products. For me it begs several questions which go unanswered.
Another PR out overnight which tells us the potential size of the field which Smme claims to operate within of which we continue not operating in due to our current position where we are yet to release products. Talk is cheap - release of products remains the question which goes unanswered = the apparent answer insufficient funds.
We now move into March. 31 days left in the 1st quarter of 2014.
March will prove crucial to the success or failure of Smme and whether or not the market believes the company has a future.
Investors have remained true in their belief that the company will deliver as its stated it will. If insufficient funding proves to be a major reason for not being able to meet its timelines then serious questions need to be asked as to why management won't entertain other avenues of capital raising. We'll know soon enough.
There's many out there I'm sure that are biting their lip wanting to express an option as we draw down toward the close of the 1st quarter waiting and hoping of news of release.
Lets hope we are not disappointed.

From your response it's apparent you are a trader and not an investor in Smartmetric and seek only the possibility of a sugar hit from any good fortune the company may reap should the lawsuit fall in our favor.
With all due respect to you and other followers on this blog whilst the lawsuit may be a bonus I believe there are many among us that have invested in the company in the belief of the technology and ultimately the products which Smme will eventually bring to market. Hopefully we won't be proven wrong.
I don't profess to be a numbers person however was keen to dissect remarks relevant to release of products past, present, and future. Furthermore I was keen to identify whether the company believes it remains on track to release products within this quarter.
It's fair to say the company commented more on the litigation than it did in relation to any product release apart from a snippet of information contained within the overview "we expect to begin mass production of our product by February 2014".
The report also confirmed during the previous quarter there were no revenues which would suggest that for reasons best known to the company it would seem no MKR's have been released or if they were they were either given away or monies earned not reported?
I believe these types of reports are relevant even if you don't. They are more relevant than many of the PR's released which constantly say a lot about what the company is going to do and very little about what is actually happening.
On the back of this latest 10Q I would hope that Ms Hendrick may come out with a PR suggesting that SMME remains on track for release this quarter. My take on the latest PR in relation to the Bitcoin frenzy was to calm things down a little and turn the focus back to the primary issue of the release of the EMV /chip & pin card.

The main character Jordan Belfort made his reputation and much of his initial wealth on selling penny stocks via Pink Sheets.
He describes those persons willing to invest in penny stocks as schmucks and various other adjectives which are less than complimentary to the average Ma & Pa investor.
Whilst watching the movie Randy leaned over to me and said Honey do you think we fit into that category which Jordan (Leonardo) describes? basically losers.
My response - I hope not! It's had me asking myself ever since watching the movie if we too are schmucks.

I was reading an article in a magazine several months ago which I put to one side which at the time thought they were relevant to SMME. Have things changed since the article was written back in the fall?
The article was about funding Big Ideas.
" Money will always follow good business, it's very easy for entrepreneurs to complain about lack of capital but maybe it's that the ideas and plans aren't good enough."
"Even if you are the face of an enterprise, you can't do everything yourself. You have to build your knowledge and team".
"Each of us knows very little but collectively we know a lot".

We may need another Press Release advising of more products to be released to spark another rise in the price.
I beg to differ about the share price. It's all about the price. If the market had the confidence that Smartmetric could fulfil half of what it claims it can or will then investors would be falling over themselves to buy up and what may be considered a bargain.
Even at current levels it appears there are a lack of investors, traders and backers willing to make a bet.
WHY?
Unless the company can successfully raise capital then all of the press releases are meaningless.

I share your enthusiasm and remain hopeful that Smme are on the cusp of greatness.
That said I do think its worth pointing out that whilst its a positive Press release it is but one of many in a series of PR's suggesting the release of yet another product. At this time I'm starting to question my friend who said they are a company who claim to produce products but can't sell them. It's debatable whether the company can or has produced anything yet not to mention selling them?
Whilst the release of a card in relation to Bitcoin may well be a huge leap forward its hard to get excited when we've been told about the release of other products which as we know are still to be released.
There is obviously great pressure on everyone at Smme to meet deadlines of the 3 products which you mention in your post however I suspect that until funds are forthcoming to assist in the purchase of materials and manufacture of products that the eventual release of any product(s)remain very much up in the air.
Smme have their reasons for repeatedly releasing PR's about what they intend to do which whilst these are promising they only add to the frustration we are all feeling. That said I'm sure the initial PR about Bitcoin led to the latest jump in the share price whilst today's PR helped sustain it.
I've repeatedly said talk is cheap. If Smme have the technological know how to make and manufacture the various products they claim to but lack the funding then they sure as Hell need to work out how and where the money's to come from because I along with many other like minded investors sure as Hell don't have any more to contribute and it seems without many of us management appears to be achieving little or barking up the wrong tree(s) to secure the capital required.

Its debatable but the only winners up to this point in time appear to have been traders in Smme and not investors. These traders have been those willing to short the stock for short term profit.
Those of us who have actually invested in smme have little or nothing to show for our investment apart from the prospect of a promise that one day our fortunes will turn.
I am less than impressed however by now you'd have gathered that.
As a show of solidarity I intend to join you by refraining with any further comments on this site because like you I also ask myself what's the point?
Perhaps a more meaningful approach might be to lobby those persons directly within smme with whom some have been fortunate to have communicated with to demand sound answers to fundamental issues.
I'm reminded of the movie - Network when Peter Finch expressed those famous words.

Our frustration I suspect echoes a great many other persons who have been invested in the company for as long as you and I.
As you quite rightly stated the current list of PR's no longer cut it and frankly only add to the frustration many of us are feeling at this time.
In recent days I have become increasingly concerned with the current status of the company and feel more information is required to be announced on genuine product release.
If indeed the MKR was released when we were told it was released on a trial basis or not it was completely botched and I would have expected better.
I have invested too much money in this company not to give a damn and won't allow myself to be misled by my beliefs that everything's going along swingingly when you know what I haven't got a clue.
What are we all doing at the present time?
Hanging our hopes on the legal case. If we are then it contradicts what many have been saying as to the original reasons. we invested in the company in the first place.
I want to know that the infrastructure is being put in place to prepare the company for the next stages of how and when it intends to launch its products and know that it can be supported not by one individual but by many that I suspect it will take to manage a company of its intended size.
I am beginning to have my doubts. I'm sorry for stating it so plainly.
In private I have talked the company up to friends and family for many years. Some of these same people made the decision to invest and for a while now I've been the butt of their jokes.
My patience is really starting to desert me.

Thanks but hasn't it always been about the products and pending release? That's the reason I invested.
It's apparent that the share price has only moved in an upwards trajectory based on a positive result in relation to legal matters. Nothing else.
You say "its now all about the products and releases". If it were so then even without the potential that such products would bring to the company's bottom line would it not be fair to assume the price might move in an upward trajectory on the likely release of such product? The answer obviously not.
The only problem is up to this point in time there hasn't been any products that have been released. Dare I say there is scepticism in some quarters questioning whether indeed there are products at all?
Overnight and another PR has been released about products or aspects of a product we are still yet to see telling us what has been developed.
Yes I am extremely frustrated with the press releases which continue to be released with no actual products to back them up. Its apparent the PR's whilst they are a part of the marketing process are insufficient by themselves to generate the capital required to finalise matters.
As it was pointed out to me last week the management of the company supposedly hold in the region of 70% of total holdings which I believe only reinforces the concept of bringing into the tent the possibility of equity participation from a group or individual sensible enough and trustworthy enough to assist in finally and successfully bringing the product to market. It might be helpful to understand from Ms Hendrick why this isn't a suitable option?
I'm not naive enough to fail to understand what this may mean for Ms Hendrick nor am I stupid enough either to grasp the significance what such partnership offers the enterprise as a whole!
Throughout the years many of us have expressed our belief in Ms Hendrick and the technology. I maintain this position.
The time however is drawing to a close where I can't help but feel just talking about the technology is no longer enough.

I don't know anything about capital raising or court case but what's nice about the share price being consistently low 19 or 20 cents.
2 months ago it was consistently trading around 40 cents.
In another 2 months if there's no news about the court case or release of products or capital raising and sentiment wanes and the price is trading consistently at 10 cents would that be nice?
Nothing personal but its all about the price and at 19 cents regardless of how many shares I might have or how much they cost me the current price just isn't living up to expectations!

Good story with a moral behind it.
Smme is and continues to remain a penny stock. 20 pennies to be precise.
We all say how the litigation is a bonus should a payout by way of settlement or eventual court ruling go our way.
There is a part of me that can't help but think that persons at various quarters inside and outside the company are growing anxious that such monies would be the remedy to our capital shortfalls.
This of courses contradicts statements previously made suggested its a bonus. Indeed the reality appears to be that it may well be a life line.
Given monies are now required to fund and support the appeals motions before the court I consider it would be prudent for the company to seriously consider sensible negotiations which would result with the immediate infusion of capital required which may mean that Ms Hendrick needs in order to fulfil the company's ambitions to enter into agreement(s) similar to those you've described.
Not only does the company need funds to complete manufacturing leading to production but it needs funds to support its legal challenge in the appeals court.
The bottom line iin my opinion is that we have precious little to fund either.
Coupled with the expiration of time only emphasizes our fragile state.
The time for PR's unless they contain genuine substance should conclude and news of a meaningful injection of funds necessary to complete manufacturing is now at hand otherwise I fear we will remain just that - a penny stock for a long time to come.
The moral of my story by the way is - pent up frustration.

While the debate rages over whether Ms Hendrick should give up a part of her company in return for capital injection etc I came upon the following article.

The question as to whether or not monies should be sort from a broader base other than those persons who visit this site is pertinent. What is more pertinent is why is has taken so long to raise the capital required to finalise manufacturing and production which by market standards is not huge amount of money.
In the latest 10K it states the total number of shares issued as being 147,698,950. Of this I have estimated Ms Hendrick to own in the vicinity of 69 to 70 million shares which is in the region of 47%.

Dear All,
On the back of a response of mine (#4493) to a post by Bale Out I suggested that the key to product release and delivery is subject to the ability by the company to raise sufficient capital.
Since then there has been various posts by a select group of people who I suspect are strong supporters and like minded long term investors in Smme arguing in principal about the contents of a post by Poor P-S #4498 which has since been removed.
When I first read the post my immediate response was well that appears to be a positive. Then having time to consider the entirety of its contents I grew incredibly uneasy with what was intended to be a positive message.
Whilst the responses to the deleted post are mixed it is apparent that those persons responding including myself have reasonable holdings in SMME and wish only the best for the company in relation to product release.
The success and or failure of any company rests in its key executives and their ability to discharge their various responsibilities.
We know the technical ability Ms Hendrick possesses and trust that her focus remains on product development. We are also well aware of the efforts of those individuals who have worked tirelessly to attract funds from individual investors via private placement and know only too well that if it weren't for these people that product development would more than likely not be as advanced as we understand it to be.
I have raised this question previously and consider it timely given the debate currently raging and ask what are we to make of the public relations company Constellation and question whether or not they could be doing more to promote SmartMetric's upcoming product release and whether they are providing SMME with sufficient advice at this critical stage of the company evolving from an R&D company to one actually producing products and revenue.
It's apparent by the spate of recent posts that like minded investors like myself believe in SmartMetric but believe the company needs to take a major step in their marketing if it is to succeed like we believe it is capable of doing.
I currently hold in the region of 2.5 million shares in various forms and have invested a considerable amount of my savings in the belief that Ms Hendrick supported by key staff will eventually succeed in releasing products that the market has been waiting years for. I trust we won't be disappointed but believe the company does need to shift gears in relation to its marketing and communications as the day draws nearer to product release.
I hope my comments are received in a positive sense as they are certainly intended to be by the writer.
