Looking to Montana first makes sense. Dispensaries can make a profit there - and to my knowledge only there. All the other states are using a non-profit model. Hence the HESG stmt.

The shares that were retired were set aside previously for the purchase of another company that did not take place. The retirement of the shares put the screws on the shorts. Looks like it will be a great week!

CXAC is restricted because they currently only trade in physical certificate form. TD AMERITRADE does not accept opening orders for securities whose ownership is recognized by physical certificates only. However, you may continue to place liquidating transactions for any such shares held in your account.
When companies convert to physical certificates only, it is difficult for brokerage firms to obtain physical shares for their clients. Converting to physical delivery also increases the costs associated with transferring ownership of common stock between buyers and sellers.
TD Ameritrade has made a business decision regarding restricting transactions in HESG. You cannot purchase this stock through us; however, you are welcome to sell any existing shares. Both you and TD AMERITRADE take on risk whenever a security is traded. While you may be willing to accept any risk associated with this security, there are certain business risks TD AMERITRADE chooses not to accept. I do apologize for any inconvenience.
Call me stupid, but i assume what everyone is saying is premised on the act of locking shares up on a high GTC sell preventing the MMs from shorting more or covering the shares they already have shorted?
In response to your post re: MMs potentially 13 bb short, please educate me. Are you allowed to short more than the entire amount of outstanding, even more, the entire amount of authorized shares? Am I just crazy or do we have an absurd and dangerous conditions for these MMs that should shoot this up. Pls cfm b/c it makes a big difference how many shares team HESG think are shorted. Hold 'em so the MMs can fold 'em! GO HESG
TVMETGUY - Do they MMs have to fill by year's end, or within 30 days of when they open the short? Why do you say year end? Not dumping as I have 14mm, but curious. GLTA
There is often talk about the issued as well as discussions of the authorized shares outstanding. The most recent public records reflect 5 billion. Question: if there is either (1) dilution or (2) buy-backs or (3) anything else that affects the authorized # of shares or the issued # of shares, does as sub-penny stock like HESG have to post an 8k or anything else with the SEC?

A lot of talk on this board about SEC. Aren't they the ones who people reported Bernie Madoff to? Yeah, 'nuf said. The SEC is ineffective and would only be bad news - they don't reassure anyone, just scare otherwise naieve investors.
Next, the charts do mean something to chartists (I, alas, am not a chartist). More important was the lack of 9 mm blocks at the end of the day. That is better than any PR released this week.
Finally, TD, etc. limits on buying - so what. This is usually a temporary condition and builds in demand. Despite this, we ended neutral which is extremely important. We ended way above the critical .0007/.0008 level.

hmmm... I have had 8's in since pre-opening with E*Trade as a test and they haven't hit. I think, as others opined, that it is a fake bid. Has anyone gotten 8's today? I think 9's is as low as you can buy more, so LOAD THE BOAT FOR NEXT WEEK - and go with Clay's chart breakout to the upside!

tvmetguy, I don't understand how MMs buying or selling dilutes shares? Isn't it purely a function of how many shares are outstanding? That is to say, if the fliperatzi want to play it that way, yes, it can damage share price, but not the number of shares outstanding.
Am I missing something? BTW, I am not bashing, just trying to learn. Pls adv.

This is the first day I've seen them struggle to sell their shares for a profit(mainly they have been buying from HESG at .0009 and selling at 10,11,12,13, whatever they can get), which to me, means they won't buy any more from HESG to sell for fear of taking a loss. So, I think dilution is over, but they may take one more crack tomorrow.

Business Week, Fortune, etc. is better if you want public awareness. Even somethign like Times, Newsweek...

1. Expanding the 5bb # wouldn't make sense in light of retirement. I disagree.

GM all. After looking at last night's board talk, it seems there is a new wrinkle which was not previously known - the retirement will be 2 billion shares as the CEO is retiring 500k of his own.
And, with respect to whether yesterday's PR was "fluff", if he came back after two weeks and said he bought something, he would be criticized as rash. It takes time even when both parties agree to a buy/sell/merger. I mean, you don't want a shotgun or a Vegas wedding. You want a good lasting marriage - especially one that could yield $400k / month !!!!

Owning dispensaries, growing the product... it's perfect vertical integration. And, it's a model that HESG can spread to other states. But, don't they need a Montana Corp & license if they want to declare a profit? My understanding is that it is the only "for-profit" allowed state... ?

I don't understand your post. Why would they sell shares to buy them back? (Unless they are fliperatzi also?!) Or, did you mean they are selling shares to raise capital for operations, which makes sense but not in light of their statement they would buy-back shares? Can anyone shed some light here?
