My new money (along with a few pre-split freebies) is underwater currently but I have no problem holding and adding (as I did yesterday). I may not have maximised profits to date but expect to reverse that fact by EOY because I have a half full glass not an empty one. If I'm wrong, I'm wrong and it certainly won't be the first or most probably the last, lol. JMO

A class action lawsuit would hold no merit (legally). Horrendous decisions have been made by management under the 'survival' mantre. I believe management could successfully argue it was either this way or B/K and commons wiped out. I would think that a lawsuit entitled pi$$ed off shareholders wouldn't see the light of day. JMHO
and right on cue we get dropped nearly 15% on 400 shares, just goes to show how this thing will move up on good news and decent volume. JMO
Agreed, anything remotely positive about VATS and we should get a reaction. I'm in ECI** at the minute and this is a pussycat compared to that one, lol.

This is the first time that I've had a reply where they say they will provide an update, I'm not trying to pre-empt anything but surely they wouldn't be providing one if there was anything really bad? I'm prepared to at least wait and give them a chance to explain what's going on. JMO
PS: I thought you said they 'sounded' upbeat last time you heard from them?
Just had a reply back from Ruby, they are going to give out a corporate update soon to update shareholders on what's happening. At least the uncertainty should decrease. JMO

It's already below pre split lows, it never traded at .02. Previous pre-split low was approximately .0326 I think. JMO

They've just got rid of as much bad news as possible and the short interest is driving this down to take advantage as much as they can. I never said this was going to da moon overnight so enjoy being right at this particular time because I think by EOY you'll be singing a new tune and if I'm wrong I'll have the nads to stand up and be counted, will you?
No I don't expect them to change just for my sake, I want them to get this company back on a steady keel with manageable debt and expand market share. I don't pretend to know what's fully going on here and I also don't pretend to want to be spoon fed with updates every day. As I've said before I've always avoided these R/S type plays but they do have the revs here and if they can control the debt, I think the market will see ECIG(D) differently. I've come in here with eyes wide open and if my paltry investment goes to zero I'll just move on and try somewhere else, but dya know what, I'm prepared to see that there's potential to go either way not just one way or the other, something that the majority of negative posters here fail to address. JMHO
Since the management change they have not delivered one filing early, in fact they've filed virtually everything at the last minute. Why would you expect them to change now. Right?
I believe they had until April 3rd, so 4 working days for the 8k to be delivered means it doesn't need to be out until AH on thursday (latest) JMO
As an accelerated filer they can file anytime on or before 10th May but that's on a weekend so it could be monday 11th. However, if they file a NT-10Q then they have an extra 5 days to file but that also means it would come out on a weekend so it may not actually hit the wires until AH's on monday 18th May. JMO
No need to wait that long, 10 months should tell you it will be. JMO
and yet board marks are still way up from early new year levels.......still huge appetite for ECIG(D) JMO
One thing I don't understand is why you think they didn't have the shares to deliver? I could understand if the O/S was fully max'd out and the post split O/S was 20m but it wasn't, the post split O/S was under the 20m so they must have had enough shares to give to the note holders whilst the TA was gagged, or is that too simple to think that way?
Of course I am, they are examples of how ECIGD may have breached their contract. We don't know the particulars, but we certainly know they were unable to deliver shares which constitites a breach of contract.

But it's not anywhere near 3 cents and fully diluted (post split) the O/S would be 120m O/S. but wait.... that was the debt from Q4 and the debt is obviously way lower than that cuz you only have to look at the dilution this year to understand that! I think fully diluted the O/S will be lower (no more than) pre IPO levels and we will be golden as revs increase thru our increasing distribution and debt restructuring/reduction becomes evident. You must be able to see some positives occurring here or maybe you just don't want to? I'd bet money that you have a bid in at sub '50' levels cuz you're not stupid. JMO
Very not so subtle, all their debt isn't toxic (read the filings) and as for locations being shut? I don't think so! This is an expanding organisation, they have already cut the chaff from the BOD and they are expanding on a global scale, fact. The balance sheet is being cleaned up and toxic debt laid to rest. We've had one flat month and the shorts et al are having a field day. Make the most of it cuz good things are coming 'our' way soon and the year lows will have been in. JMO
After yesterday’s 10k I decided to sit down and break the current situation down to its most basic form and here’s my take FWIW.
It seems apparent to me that there’s no dressing the 10k up, like putting lipstick on a pig, it’s still bad, but it does reinforce the notion that ECIG(D) was on the brink of B/K. It was either B/K (with the potential of wiping out commons) or survival, so I for one am glad Dan and Phil decided survival was the way forward and the R/S went ahead.
Revs were way under what I expected in Q4 but YoY revs from $3.1m to $46.9m in 12 months is nothing short of stellar. 1 flat qtr means nothing, and certainly doesn’t mean a trend is in place. I believe Q1 will show 30-40% growth in revs over Q4 as distribution expansion starts to positively impact the top line. Nielsen Data has recently indicated that FIN is the 3rd best seller in the US. Check out Nielsen Data and you’ll see they are a very credible source of consumer activity across 100 countries. http://www.nielsen.com/us/en/about-us.html
The debt is unsustainable in its toxic form but Dan and Phil have chosen a ‘hard route’ to expunge all toxic debt and restructure with non toxic debt. The new debt is still convertible but it won’t be VWAP’d, therefore there’ll be no inciting note holders to short the pps down to nothing, and the interest rate will almost certainly be lower.
You’ve only got to look at the dilution pre and post R/S to realise that the debt has been cut down as much as possible within a very short space of time. How much is left I leave to those far more knowledgeable than I, but I bet the debt shown in Q1 is considerably lower than in Q4.
On the down side uncertainty rains and further dilution is more than likely on the cards, therefore a further dip is expected. but.....
Anticipated upcoming events are the warrants being chopped in half by the weekend (followed by an 8K winging its way here next week sometime) and Q1 fins which are expected by mid may (18th if NT-10Q). I believe that the first stage of the balance sheet clean up and improved revs will be delivered, if nothing else other than to show the new crew are in town and they are going to ensure survival and build the business back up again.
In short the world isn’t coming to an end it’s just going to take a year longer than thought and the $80m revs projection for 2014 will have to wait for 2015 EOY results.
I happen to believe that any further dip will provide the lows of the year and I'll add accordingly. JMO
