Absolutely not and that was my 2nd and 3rd post deletion since inception over a year ago. I realize I'm beating a dead horse on Preakness day and his name ain't Barboro. After nearly 11 months, does anyone have any info on how Zap's lawsuit is progressing? I would think Steve would keep the shareholders up to date. After all a victory for Zap would be huge for Zap. After all they claimed over two billion in advance sales. Perhaps that is why Daimler, sold Chrysler? Last I heard the Smart cars are coming but not by way of Zap, and I would guess not by DaimlerChrysler after the sale of Chrysler, I guess just Daimler.

DaimlerChrysler plan to market vehicle pulls rug out from under SR distributor

DaimlerChrysler AG plans to announce today that it will begin selling the Smart minicar in the United States in 2007 or 2008, a strike against Santa Rosa car dealer Zap, which had hoped to be the exclusive U.S. source for Smart cars.
The chairman of DaimlerChrysler is to lay out details of the Smart car marketing plan at a news conference in Detroit, a company official told the Associated Press.
DaimlerChrysler plans to market the Smart car to drivers in San Francisco, New York, Los Angeles, Seattle and other congested cities. The advertising, still in development, will emphasize fuel efficiency, safety and quality.
Details on where people can buy the cars, and for how much, were not released Tuesday.
Competition from the German-American auto giant could be a challenge for Zap, which for two years has been touting its plan to import and sell Smart cars through a network of used car dealers in several states.
Zap's Smart cars get 40 miles per gallon, city and country, according to the Environmental Protection Agency. It's not known yet what mileage DaimlerChrysler's U.S. version will get.
Zap warned investors earlier this year that a decision by DaimlerChrysler to sell the Smart car in the United States "could have a substantial adverse effect on the company's Smart car business," according to Zap filings with the Securities and Exchange Commission.
On Tuesday, Zap's chief executive officer, Steve Schneider, said he is confident Zap can be competitive, not only by continuing to sell the Smart car but also by providing electric cars, electric trucks and other alternative vehicles through Zap's chain of dealers.
"As we wean off of the Smart cars and put in cars we have control over, that will replace revenues lost by the Smart car," Schneider said. "Profitability in our own cars is much higher."
Schneider said Zap has sold 50 to 100 of its Xebra three-wheel electric cars and trucks this year and has about 100 on back order. He expects Xebra sales to benefit from the release of the movie "Who killed the electric car?" today.
DaimlerChrysler's Smart line, which has never been profitable in spite of the car's popularity in Europe, is getting new life in today's environment of high gasoline prices and growing concerns about global warming.
DaimlerChrysler will bring a next-generation, two-seater model called the "fourtwo" to the United States in 2007 or 2008, equipped to meet U.S. safety and emission standards, according to published reports Tuesday.
The Smart car will join several other entries in the subcompact category, including Honda's new Fit, Nissan's Versa and Toyota's Yaris.
Dealers that already sell DaimlerChrysler products, such as Autoworld in Petaluma and Smothers European in Santa Rosa, said Tuesday they have not been told what distribution channels will be used for the Smart car. The U.S. price for the subcompact has not been set. In Canada, prices start at about $15,000.
DaimlerChrysler's enthusiasm for bringing the Smart car to the United States may have been spurred by the buzz of interest Zap sparked when it said in 2004 it intended to import the Smart car.
Zap planned to buy Smart cars from European dealers and other suppliers and have the cars converted to meet U.S. safety and pollution standards by G&K Automotive Conversions in Santa Ana.
That plan was overwhelmed by an unexpected flood of orders. Within months, Zap officials claimed they got more than $2 billion in orders from dealers for 156,000 Smart cars, far beyond G&K Automotive Conversions' ability to produce.
A year ago, Schneider asked DaimlerChrysler to supply the cars he needed, but the company refused.
At the time, Smart President Ulrich Walker said the $2 billion in orders was "further proof of the fascination with our brand and the idea behind it." But Walker said DaimlerChrysler did not want to do business with Zap.
In October, Zap sued DaimlerChrysler over what Zap claims was unfair competition. The case is pending.
Zap's common stock closed Tuesday at $1.38 per share, up 15 cents on the Archipelago Exchange. Shares of DaimlerChrysler fell 91 cents to $46.80 on the New York Stock Exchange.

BEIJING -- (MARKETWIRE) -- 06/19/07 -- Electric transportation pioneer ZAP (OTCBB: ZAAP) will showcase its complete line of electric vehicles at CIEPEC, the tenth annual China International Environmental Protection Exhibition, June 21-24 at the China International Exhibition Center in Beijing.
CEIPEC 2007 is a trade fair for environmentally friendly products from around the world. The conference is organized by CAEPI (China Association of Environmental Protection Industry) to raise awareness about green technologies for introduction to consumers in China.
ZAP will be showcasing its line of electric vehicles, all of which are made in China. These include electric scooters, ATVs, cars and trucks, which are all exported to the USA and other countries in the Americas. ZAP Chairman Gary Starr says electric transportation is vital for the health and well being of the Chinese economy and the world.
"The market for gas-powered vehicles is exploding in China," says Starr. "This will not be good for China's air quality, but will also have an adverse effect on world oil supplies. Now is the time for China to make the move to electric vehicles."
Starr noted that China is the world's second largest market for cars and commercial vehicles combined, second only to the USA. Its car population grew from about four million in 2000 to 20 million in 2006. While pressure is mounting on China to curb its CO2 emissions, passenger car sales will probably maintain at a growth rate of not less than 25 percent per year.
While China has experienced spectacular economic growth, it has also brought air pollution levels that are blamed for a variety of illnesses and premature death. Starr cited statistics supporting the use of electric vehicles in China. Electric vehicles can eliminate 90 percent of pollutants related to automobiles, even after counting the emissions from electric power plants. An electric car in place of a gas car can prevent 10,000 pounds of greenhouse gases from entering the atmosphere. Vehicles are a leading source for air pollution and one of the largest consumers of oil in China. Recent satellite data has revealed that Beijing is the air pollution capital of the world. According to European satellite data, pollution in the sky over China has increased by 50 percent over the past decade. China is now the world's second largest producer of greenhouse gases and the World Bank has warned that China is home to 16 of the world's 20 most polluted cities.
Starr will be joined by Mr. Yong Jiang, representing Shandong Jindalu, manufacturer of the XEBRA electric sedan and truck for ZAP. Last year the two companies signed a strategic partnership agreement to fight global warming through the manufacturing and marketing of electric vehicles in addition to planting one million trees worldwide by 2010.
