Dogg, being a true investor in ASFX or any other company requires that you understand facts and potentialities. Simple hype or bashing does not help you understand the risks or opportunities. Neither does it allow you to avail yourself of the risk mitigation tactics.
ASFX is a company under immense pressure. I am somewhat surprised that its stil at .004. ealistically the PPS could easily be les than half that.
Its key product has been ordered off the market by a FEDERAL JUDGE because of management's actions. Not because of a defect or danger to consumers. Does anyone here understand how rare that is?
The same Judge predicted that the Company would lose the underlying lawsuit. Does anyone here understand how rare that is?
Management has yet to disclose to its shareholders what is happening. To the contrary they are attempting to spin this as "THEY ARE TRYING TO DISTANCE THEMSELVES FROM THE GARBAGE PRODUCT FROM TECHNIMED AND ITS REPUTATION" This can very easily result in personal and corporate sanctions by the court.
They are dancing around releasing sales and operating results numbers. They obfuscate the facts and hide behind facebook and facilitators who in my opinion have to be compensated in some fashion. How else can I explain to myself the insane disregard for the facts, which are incredibly negative.
If Technimed is smart, they will do something aggresive with their pricing right now and play the lawsuit and the Federal Judge's order to the max with the customers and the trade press. It would be so easy to discredit the company right now. They could deliver a knock out punch to ASFX then after 6 months or so they can start working back prices. But who knows?
Dog, this is way beyond undesirable. This is potentially lethal on a customer by customer basis. The retailers and jobbers don't want, need or will tolerate getting letters from opposing counsel asking to confirm if they know of the recall. The attys will do that just to put pressure on ASFX. This is hardball and the ASFX team is little league. This has been an incredibly botched management of the situation.
You think Amazon and Diapers.com where a hiccup? Wait and see.... in my mind, I have written off my investment. Now I'll just watch and see the pumpers twisting in the wind. This could get real ugly, real quick.
EDIT: everything is looking good......ROFLMAO watching whats left of my investment wondering when it will finally evaporate...TO DA MOON....WOW
not an education I expected. ASFX is certifiable horror show. From the totally inept management, to whoever is giving them advice on dealing with the trade. I have never in 30 years in CPG arena seen anything like this. This has a very real potential to scare away every significant retailer. In my way of thinking, this has evolved form mismanagement to a total disregard for the shareholder's interest.
apparently they may have been in front of this Judge many more times than anyone knew...
Judge Paul Gardephe of the United States District Court for the Southern District of New York found that Kidz-Med's arguments lacked merit, and held that Kidz-Med had represented on numerous occasions to the Court that it "fully understood" the scope of the recall extended to all retailers who received Kidz-Med's product in the infringing packaging, regardless of whether Kidz-Med had directly sold to the retailer or not. Kidz-Med must now send recall notices to all retailers who received the Kidz-Med product in infringing packaging from Kidz-Med wholesale distributors.
In my opinion, they have tried to keep the market from finding out what happened. Not really concerned with ghaving to take back prod uct, as that is manageable, but they dont want the market to read the January 18th order.
That order was devastating to anyone who is a serious person and not palying games.
Posts here (and elsewhere) keep trying to cover up what ASFX management is doing. The latest blow delivered by a Federal Court should not be disregarded.
This latest setback in my opinion may be what starts a domino effect.
ASFX has played games with a Federal judge. That is not same old same old. Sanctions could easily be coming against the company and it officers. Trying to pretend that this is nothing is ridiculous.
New York Court Orders Kidz-Med to Immediately Notify All Retailers of Product Packaging Recall in Ongoing Lawsuit With Tecnimed srl
NEW YORK, NY--(Marketwire - March 10, 2011) - Cooley Manion Jones and Miele Law Group on behalf of their client, Tecnimed srl, international pioneer of non-contact temperature measurement technologies, announced today that the continued attempts of Kidz-Med, Inc. and American Scientific Resources, Inc. to avoid the nationwide product packaging recall ordered by the United States District Court for the Southern District of New York have failed again. Kidz-Med argued that its obligations under the Court's January 18th Order required it only to notify customers to whom Kidz-Med had directly sold its product of the recall, not to all retailers who received the infringing packaging from distributors.
The Court noted that Kidz-Med's conduct was inconsistent with its previous representations to the Court regarding the expected scope of the recall, and specifically stated:
"Having submitted to this Court an estimate of the costs associated with a recall of product from both wholesalers and second-level retail customers, and having induced the Court to rely on its submission for purposes of a bond, Kidz-Med cannot now credibly argue that it understood that the Court's recall order would only apply to retailers with whom it had direct dealings."
Kidz-Med previously attempted to the prevent the recall by requesting a stay with the U.S. District Court for the Southern District of New York and then the Second Circuit Court of Appeals. Both courts denied Kidz-Med's request. As a result, the nationwide recall commenced on Friday, February 11, 2011.
Executives at Tecnimed are pleased with the Court's decision to again allow the full recall to move forward without any further delays. Meanwhile, the underlying lawsuit continues as Tecnimed seeks damages arising from Kidz-Med's sale of products with infringing packaging and Kidz-Med's breach of contractual obligations. This lawsuit is part of Tecnimed's vigilant efforts to enforce and protect its valuable intellectual property rights and other business assets.
Tecnimed is the manufacturer of the world's first non-contact body temperature thermometer, the Thermofocus® 5-in-1 non-contact thermometer, which was the first thermometer to permit a parent to take his or her child's temperature without having to touch or otherwise disturb the child.
Please direct any questions regarding this lawsuit to Tecnimed's lead counsel, Tony Miele of Miele Law Group P.C. and Jennifer Furey of Cooley Manion Jones LLP. someone spent 105 to get the price up to .0042
is the .0038 a set price or is based on a closing price formula?
sorry, I misunderstood
I dont see Southridge buying and holding. If they buy (or have bought) they will flip and live off the 8% spread and whatever else they can drive on PR's etc. Just my opinion.
I have never seen a situation where a Sr. Exec in a public entity does not disclose details of his background. Name of Company, years of incumbency and details of his responsibilities. IS it published and I missed it?
I understand your comment. However you'd be surprised at what a sound manager can get done. First item is debt restructuring, then the Roth deal with is beyond stupid. Both are key indicators of management's limitations. If you can clean up the Balance Sheet and negotiate away the lawsuit. Like I have said many times here, Dr. T. seems like a genuinely good man that has been hijacked by the business. He has no business running this company and Roth has no verifiable credibility.
A lot of the stuff I have seen them do our publish is too cute by half. They play games on facebook and pretend there are no crisis.
The first rule of crisis management is get the info out and address it. Then move on. You don't have to have the best product to make it work. It just can't get in the way. re NDD, I still dont see that as adding the value that was paid for it. Can it be a contributor? Yea under the right circumstances. IF their cost is 12.50 on the Therm they need to reposition the retail pricing.
i'll say this, whether they are great products or not, I don't know. I think the thermometer is the most aesthetically pleasing of the many entries. Nice color palette etc.
Unfortunately the underpinnings of the business are literaly non-existent. There is no strong management component to inspire main stream "Wall Street" interest.
Their debt and its terms is horrible.
Jason Roth has no verifiable background best as I can tell.
Doctors are notoriously bad business people in the eyes of WallStreet.
They have done more to hurt the business than help it.
The Lawsuit should have never happened, and while you can't stop people from suing you, you dont have to make it so easy for them to prevail.
at the end of the day they have been enabled by people here and closer to the company to under perform.
A strong credible President could restructure the debt, restructure the Roth deal and bring real disciplinal management to finance and manufacturing.
They spend a ton on shows and travel that at this point they cant exploit the opportunities.
They need to pick their sweet spot and drive that.
i underestand. No problem.
I know private lablel extremely well and I know margins better. ASFX is not a PL company and if they are then they need to re-engineer their cost architecture.
Please explain to the unwashed how everything looks good and in specific terms your technical comment that PL deals are asign that everything is great?
PL is a very specialized area and a lower margin business that eventually wipes out any branded business and totally erodes brand equity and therefore shareholder value is significntly eroded.
probably discontinued
kidz-med 5-in-1 non-contact thermometer discontinued at Amazon is not something anyone wants to read. However I think that is what has happened. Lets hope its a technical issue like UPC code.
In the best interest of the product and shareholders, I suggest everyone lay low and not mention the E-tailer by name here and for God's sake don't pump the business there. If you looked at the page last week it already said it was sold and shipped by AJ Wholesale which is sometimes a clearance vehicle for the E-tailer. If there is no problem it may resurface. If its been TBD'd for the reviews or the Federal Court ordered recall we dont want to attract attention to the Mebby items.
I dont think the company can control it. For Amazon its not tough to figure out what happened. Its not biased, if you could read the now deleted negative non-pumper reviews posted you would see multiple buyers blaming the "POSITIVE" reviews for their product purchase decision.
This planting of false reviews (some by non-verified Amazon purchasers) corrupts the amazon reviews credibility. They would of course step in to protect the integrity of their customer trust platform.
FYI, I checked and the Mebby items are still there. However they are all drop shipped by ASFX and sold by ASFX so the internal vendor number will be different. They may have dodged the bullet on theMebby because of that.
The recall could certainly do it. If they actually read the order (which would not be out of the question) their lawyers could easily step in.
Regarding the reviews manipulation (I was actually worried about this); while my businesses have never been in that position and I don't know of any rules etc.. I could see a scenario where if they caught on to the manipulation they simply boot the vendor and cancel the vendor number and charge back the company for all of the dissatisfied customers (about 20?). If there are any other ASFX items in Amazon and they are gone as well, then its toast for sure.
My former employee (she has been working with Amazon buyers for 5 years) tells me that if its not back up in a week or less then its positively discontinued. Doesn't mean they cannot get back in, but if the review manipulation is the trigger then it will be damn tough.
got the call back, if it were simply out of stock it would show as out of stock and give an approximate ship date. The buyer that my former employee spoke with buys a different category so she cannot tell her exactly what could be the issue but she is sure it is not an out of stock situation.
Saw a post on another board that Amazon product page has been removed. I have dealt with Amazon before as a vendor and my former company still does, I spoke to the Dir Maktng and she is going to call her buyer at Amazon today and ask a generic question. They are usually very easy to do business with. Anyone have "REAL" info? Has it been deleted as Doc T stated was a possibility in lawsuit? I have never seen them delete a page for anything other than deletion. Did ASFX change the UPC code on the new packaging? If so that could explain it. If not my guess is has been discontinued.
Good luck to us all.
Last Year American Scientific Resources Became Approved Manufacturer
WESTON, Fla., Nov. 23, 2010 /PRNewswire/ -- American Scientific Resources, Inc. (the "Company?" or "ASR") (Pink Sheets: ASFX) announces months ago that the Company is officially an approved manufacturer of medical devices under the International Organization for Standardization (ISO), the world's largest developer and publisher of international business standards.
ASR also recently became a FDA approved manufacturer of various medical devices operating under the ISO 13485 Directive of Quality Systems Manual and Good Manufacturing Practices.
Within the past week, the Company went through an ISO inspection conducted by world renowned TUV SUD. The one-week highly intensive process included implementing a complete traceability and management accountability function in all aspects for a medical device manufacturer and for an audit for a CE mark submission.
When the CE mark is issued, sales to the European Union, Canada, China and the Australasia regions can commence. ASR will update the public when the CE mark has been officially issued. The Company expects that to occur within the next 60 days, although there can be no guarantees. The CE mark, also known as European Conformity mark, is declaration that a manufacturer's product complies with the essential requirements of the European product directives including containing essential requirements, performance levels and technical specifications in order to legally be placed on the market within the EFTA and European Union. Having the mark opens up market distribution by enabling ASR to sell product worldwide, namely in areas that the Company is pursuing, such as Canada, Europe, China and the Australasia region.
The adoption of international standards by a Company certifies to the world that Company products are of the highest quality, with widespread acceptance internationally. Abiding by ISO standards ensures products contain the most desirable characteristics including reliability, safety, efficiency, eco-friendly and affordability. Businesses who use the international standards can compete on many more markets globally, making it easier, safer and fairer for trading to ensue.
Per ISO.org, "For innovators of new technologies, International Standards on aspects like terminology, compatibility and safety speed up the dissemination of innovations and their development into manufacturable and marketable products. For consumers, conformity of products and services to International Standards provides assurance about their quality, safety and reliability. ISO standards safeguard consumers, and users in general, of products and services."
Dr. Christopher F. Tirotta, CEO and Chairman of ASR, comments, "Another exciting Company milestone has been achieved by successfully passing the world's definitive business standardized system."
ASFX is a unstoppable machine. Kinda like a submarine with full ballast tanks and no propulsion.
BTW a customer is someone who buys from you. Not someone that issues a PR that says they like you.
Show me orders and profitability. They have already demonstrated a talent for losing money.
My best guess is that less than 5 NEW customers come out of Marketgate. New customers, not PR's that have stumbling around for months and months.
No news out of marketgate.
You would think that with 81 companiues wanting desperately to meet ASFX we would have at least a couple of dozen new customers. That would be a less than 1/3rd success rate with COMPANIES ASKING TO MEET WITH ASFX?
So if we get less than 24 new customers what should we think? Less than 20? Less than 10?
EDIT: will mark thIs post and will revisit when the 10K comes out in a few days. 2 plus years of excuses and Roth are about enough I think. Others can continue to be apologists and hype the company on PR's and no sales and even smaller profits. I think its time they showed what they are doing to make the business viable and profitable now.
I am not sure why but you are posting something thats almost 5 months old as news? Can ANYONE please explain what happened with the old ASFX 10,000 thermometer promotion?
Hey Dog, so what do you make of the PPS. I see a lot of posts that speculate about all of the news that supposedly is coming. The stock cannot move beyond the very low .0004's or high .003's.
ASFX is a company that may or may not survive. We should all be pushing management for official answers.
