Limits on the Statute of Limitations
One downside of this statute occurs in relation to the copyright issue. The statute of limitations puts the time of claiming any infringement at three years. Concerns are then raised about offenders who may infringe the statute and then go into hiding for three years only to re-emerge when they cannot be sued in a court of law since the case will then be considered invalid. Examples of the latter could include documents such as final reports for degree, masters or doctoral studies. Such documents may go undetected for months and even years; a judicial remedy can only be issued once the plagiarism has been discovered. However, the three-year time period does not start until the infringement has been noted and after that discovery, one has three months to file a complaint failure or the case will be invalid.
But the infringement is constant when it is published material sold to the public, and therefore the 3 year limit only occurs after the material has been discontinued. If it is not discontinued the material is in a constant state of infringement and therefore the statute of limitations DOES NOT APPLY
Moreover if the proof of the infringement is tied up in things like telephone conversations which are difficult to retrieve without court order the time of the notation of the infringement does not begin until such information is gathered...!!!
So whom is effected by this... Hollywood, The Recording Industry, The Advertising Industry, and many many individual companies.

Cliffs Natural 4Q Net Surges On Higher Iron Ore, Coal Sales
Feb 16, 2011 17:02:08 (ET)
DOW JONES NEWSWIRES
Cliffs Natural Resources Inc.'s (CLF) fourth-quarter profit more than tripled as the coal and iron-ore producer reported higher sales volume and improved prices.
Shares jumped 8.7% to $100.98 in after-hours trading as the bottom line easily topped analysts' expectations, helped by strong sales margins.
The company has reported improved results each quarter of 2010, helped by higher sales volume and a strong contribution from the iron ore business. The company has also moved to increase its business exposure to seaborne markets.
For the latest quarter, Cliffs reported a profit of $384.4 million, or $2.82 a share, up from $108.2 million, or 82 cents a share, a year earlier. Revenue surged 74% to $1.42 billion.
Analysts polled by Thomson Reuters expected a profit of $2.16 on revenue of $1.43 billion.
Gross margin widened to 33.9% from 21.3%.
At North American iron ore operations--which typically account for the largest share of revenue--sales volumes jumped 14% as revenue per ton grew 33%. Asia Pacific-region sales volume increased 24% as revenue per ton more than doubled. North American coal sales volume rose 24%.
Cliffs expects global steel production will continue to grow this year, primarily driven by emerging markets such as China, India and Brazil. The company now sees North American iron ore sales volume to total 28 million tons this year, with revenue-per-ton to range between $140 to $145.
Last month, Cliffs agreed to acquire all outstanding shares of Consolidated Thompson Iron Mines Ltd. (CLMZF, CLM.T) for about C$4.9 billion ($4.97 billion) in a bid to expand its share of the global iron-ore market. Cliffs expects nearly half of its iron ore production in North America will be exported. The company expects the deal will close early in the second quarter.
