The 116th Congress went into session at the beginning of January, and several marijuana reform bills have already been introduced in both chambers. See below for a listing of legislation we are tracking on the federal level, and stay tuned for information on the progress of these bills and opportunities to take action.
H.R. 420 – Regulate Marijuana Like Alcohol Act
Chamber: House
Sponsor: Rep. Earl Blumenauer (D-OR)
Purpose: This legislation would remove cannabis from the federal Controlled Substances Act. It would also transfer cannabis enforcement authority from the Drug Enforcement Administration to a renamed Bureau of Alcohol, Tobacco, Marijuana, Firearms and Explosives.
H.R. 127 – The Compassionate Access, Research Expansion and Respect States (CARERS) Act of 2019

Purpose: This legislation would permit states to implement medical cannabis programs without federal intervention. It would also allow physicians with the U.S. Department of Veterans Affairs to recommend cannabis to veterans. Sen. Cory Booker (D-NJ) is expected to introduce a Senate companion bill.
H.R. 498 – Sensible Enforcement of Cannabis Act of 2019

Purpose: This legislation would essentially revive the Obama-era marijuana enforcement memo that was rescinded by then-U.S Attorney General Jeff Sessions last year.
H.R. 171 – LUMMA – To provide for the legitimate use of medicinal marihuana in accordance with the laws of the various States

Purpose: This legislation would reschedule marijuana and clarify that the federal government cannot “prohibit or otherwise restrict” state-legal use, possession, transportation, production and distribution of medical cannabis. It would also reschedule marijuana under the Controlled Substances Act, from Schedule I to Schedule II.
H.R. 601 – The Medical Cannabis Research Act

Purpose: While this legislation wouldn’t change the federal legal status of cannabis, it would require the Justice Department to approve additional manufacturers of research-grade marijuana, protect research institutions interested in conducting studies on cannabis, and authorize the U.S. Department of Veterans Affairs to inform patients about federally approved cannabis studies that they can participate in.
S. 179 – A bill to direct the Secretary of Veterans Affairs to carry out a clinical trial of the effects of cannabis on certain health outcomes of adults with chronic pain and post-traumatic stress disorder, and for other purposes.

Total Active Cannabinoids – Identify the active cannabinoids. There are over 66 chemicals unique to the plant.
Terpene test results - terpene analysis is crucial for differentiating strains of cannabis as terpenes have a major influence on the medical and psychological effects of a plant.

Pesticide test – verify the safety of the medicine. A pesticide test can detect trace amounts of chemical pesticides in dried flowers and cannabis concentrates.
Microbiological Test – verify the results regarding the presence and breeding of micro-organisms such as specific pathogens, bacteria, yeast and mold.
Residual Solvent Test - identify the presence of harmful solvents impurities and/or other added odorants and chemicals present in super-concentrated forms.

THC Dosage – identify the percentage of THC in the strain. One gram of cannabis equals 1000mg of dry weight with the total THC content of 100mg.
CBD Dosage – identify the percentage of CBD.
Legal Dosage compliance for oils and edibles – review state requirements and verify dosage conforms to label claims supported by lab testing.

Food Safety Audit - verify proper food safety practices at processing facilities. This report data is used to help select suppliers and validate internal policies and procedures.
HACCP Plan (Hazard Analysis of Critical Control Points - Storage and distribution of a food product is scientifically analyzed for microbiological, physical and chemical hazards.
FDA / Bioterrorism Plan - Verify the manufacturer has registered under the Public Health Security and Bioterrorism Preparedness and Response Act of 2002

Benefit Claims - Structure/function claims may describe the role of a nutrient or dietary ingredient intended to affect the normal structure or function of the human body.
Labeling requirements – Verify primary panel and informational panel adhere to state laws such as font size, “cannabis-infused”, manufacturer contact information and website
Labeling restrictions – confirm labeling does not contain false origin of cannabis grown, cartoon imagery or product that imitates candy packaging.
Steps-07
Sound statistical sampling of finished product to insure accuracy - determine whether to accept or reject a production lot as products leaves the plant, or prior to distribution.
Reserve sample (retains)of each product lot - Hold reserve samples under conditions consistent with product labels or under ordinary storage conditions.
Final Certificate of Analysis of finished product - Verify that the product meets its product specification. The final C of A should contain the actual results obtained from testing performed as part of quality control of an individual batch of the product.

Here's a breakdown of square footage production estimates for clones. Been doing this for 15+ years in Oregon and have a fairly good handle on realistic projections:
1) Avg clone needs at least 4" X 4" to grow horizontally, 12" vertically and be ready for sale in 3-4 weeks (each cutting needs to take root and show signs of vigor which can take 3-4 weeks).
2) Grow platforms can reasonably have a height of 12' and be manageable (with moveable ladders). Each horizontal level of the grow will need about 12 inches in height to allow for lighting, container and plant. That means a pod with 12' ceilings can grow 108 clones per sq ft of floor space on 12 verticle levels. I think the current pods used by LVVV are 8' but that can be altered so I'm going to stick with the 12' verticle height. (Height, and therefore production can be adjusted to whatever it is).
3) With 12' ceilings there would be 12 levels of clones, lights, containers, etc. Each sq ft of floor space would produce 108 clones.
4) With a 4 week rotation that means 108 clones per sq ft X 5,000 sq ft = 540K clones per month. 540,000 X 12 (months) = 6,480,000 clones produced yearly.
5) If Colorado, Washington and Oregon are any indication then LVVV can expect to receive between $10.00 and $35.00 per clone on a wholesale basis. Clone value depends on strain (THC and CBD percentages, length of time to harvest, quality of end product, reliabilty of strain genetics, buzz surrounding strain, etc, etc.).

Senator introduces a bill to legalize marijuana and it’s called S.420
The new bill would make weed legally different from heroin
A new bill introduced in the Senate today would legalize weed, and it’s not just the text of the bill that’s a nod to marijuana culture. The bill, introduced by Sen. Ron Wyden (D-OR), is labeled with a conspicuous number: S.420.
The new bill would give the Drug Enforcement Administration 60 days to remove the drug from its list of controlled substances, while also barring the sale of marijuana in states where it’s still illegal. S.420 would also require merchants to add an excise tax to marijuana, an indirect tax that’s added to the price of the product, similar to how tobacco and alcohol are taxed.
The bill would also require businesses to register for special permits to start selling weed. Cannabis products would also face labeling and advertising requirements similar to those required for alcohol.
Wyden also introduced two other bills today, both aimed at allowing sellers in states that have already legalized marijuana to take regular tax deductions like other businesses, while also giving cannabis companies access to banks and an easier time taking out ads.
It’s not the first time a bill has taken up the number 420. Last month, Rep. Earl Blumenauer (D-OR) proposed H.R. 420, a bill that would legally treat weed like alcohol. Lawmakers in California, Rhode Island, and on Capitol Hill have all named bills 420 in the past, according to Forbes.
The bills introduced today face an uphill fight to becoming law. But in a statement, Wyden said, “The American people have elected the most pro-cannabis Congress in American history and significant pieces of legislation are being introduced

Today we received the Notice of Final County Action for our Minor Use Permit DRC2018-00064. LiveWire’s GHC cannabis nursery application satisfies all provisions of the San Luis Obispo County Code. Now we can go for State approval.
