And no one knows what happened in court yesterday?
>>It is also my opinion that the settlement is clearly in our favor.
Ah, yes, the double secret probation vapor settlement no one has ever seen even after four months. There are six working days left until the court's January 9 deadline. If not met, the docket says Daic will be declared the winner of the 2009 suit and he gets everything, plus $170M in damages because CLYW "failed to prosecute."
So again, what settlement?
And if CLYW fails to file the settlement and make it available to stockholders we plan to go after company officers for damages.
I, at least, understand your position and decision. Good on you.
Really? Please post the results of today's court judgment.
Certifying the vote means the numbers reported are claimed to be true. That is far different than a vote being valid. My family voted last week for the day to be 18 hours long. Tragically, we have no way to enforce the vote and no legal recourse.
>>I am trying to get a hold of Turrini as I type.
Good luck! /S
>>Now they are fired, we can move forward after the judge invalidates this illegal vote they held to keep their positions with the company.
What judge and when?
Interesting analysis.
If true, we are looking at no agreement on the 9th. If I understand the docket, Daic wins everything because CLYW will have "failed to prosecute." I would not want to be Turrini or any of his friends when that happens.
The patent is still worth a king's ransom. Who will get it?
As you note, we are dealing with property worth tens of billions of dollars, owned by us shareholders but held hostage. That amount of money simply drives some people insane with greed. This insanity makes them do insane things. It's all quite understandable. Now that shareholders have had enough and are awaiting the January 9 public issue of the settlement agreement, if that does not happen, stand by.
And please, you co-conspirators, don't bother with posting insulting replies to this note. Now that I'm a paid Ihub subscriber, there is no limit to the number of posters I can send to The Phantom Zone.
Really? Please list the right people.
How very helpful.
Sorry you took such a beating from these bums. I know... when you're fighting over billions of dollars all rules go out the door. That's the tragedy. There's more than enough to go around.
Oh, BTW. On 9 January the settlement will be filed with the court and the shareholders sent copies. On 10 January a flock of geese will fly out of my butt. Film at 11:00.
Perhaps the next big event will be our suit against the guilty.
Discovery is a bitch.
Interesting that he didn't file for receivership, as he has a right to do.
Williams, Turrini, Pierce, The New Guy, etc. It's all so simple. The New Guy was announced Tuesday. The pps got a slight bounce. Today it dropped back down again. We are still on the grays. That means that a sale of 300 shares ($12) can halve the pps. That isn't business. That's insanity.
People, all the fire and brimstone on this board is just froth. The only thing investors are looking at is results. There have been none. The 9th is coming. Unless the settlement is filed and made public, I expect the pps to hit .02, regardless of Williams or Turrini or New Guy or unicorns frolicking in the parking lot or anything else. We don't even know who is still a director. I am not joking about going after Turrini et al after the 9th if they lie to us yet again. Others have private mailed me that they are in, too.
I certainly have not stopped demanding answers.
More close to home, how do you propose to overturn allegedly improper recent BOD decisions and proxies in a reasonable time frame? Please be specific.
Thank you for the link.
Not to my knowledge, you haven't. What you've done is repeatedly summarized what you claim is the law. Please post links to the laws you claim apply to specific issues of your arguments.
Uhuh. Please post your alleged previous settlement. What? You can't?
>>Yeah... the shareholders have spoken... in an illegal election conditioned by an illegal proxy solicitation... and what they said, inspite of all that, was that the effort to remove Williams FAILED.
Williams WON the vote of no confidence... So, pretty much everything done prior to and following the "election" is all bogus...
Blah, blah, blah. Post some FACTS and DOCUMENTS, please. What? You have none?
>>fact williams is still a director
Really? Prove it.
Wow. Log off for a few hours and another flame war starts. What is this one about? That the new CTO has been unlawfully appointed? Who says?
It's like the old joke. A middle-aged woman goes to the doctor. He tells her she's in good health but he's puzzled that she's still a virgin. She replies that for 40 years she's been married to an IBM salesman, and that every night, he sits at the foot of the bed and tells her how great their sex is going to be.
More important than management changes is getting off the grays. Until then, as we have seen today, a quarter million shares may trade with a 20% increase in pps... all to be destroyed by a sell of $60 by some penny day trader.
Anything other than getting relisted remains a waste of time for shareholders. That does not excuse not going after management after 9 January, if warranted.
New CTO. Next: January 9 filing. Settlement released. Or else.
Let's see what happens.
Let's cut through the nonsense. We have a filed settlement by 9 January and the settlement is made available to shareholders. Or, we find a pit bull attorney. I talked to an attorney today at Christmas dinner -- purely hypothetical, of course. She's interested. Enough is enough.
Undetermined yet. First, we wait for the alleged settlement to be filed on 9 January. Next, we demand to see it. Then we decide.
We can discuss offline at litton51@hotmail.com, or here via private mail.
I am beginning a BOD fund for the new year. If the alleged settlement is not filed and Daic wins by default on the 2008 case on January 9, I want to enlist as many other shareholders as possible to go after the company officers who did this to us. Time's up.
We'll all know on the 9th.
If you think the US is going to allow its military targeting system to be destroyed by LightSquared or any other telecomm company, you are dreaming. Esp. since the DOT is systematically decommissioning all other air nav systems (NDB, VORTAC, etc.) And spending hundreds of billions of dollars to work around CLYW's patent is absurd. They would have years ago simply bought CLYW, Daic, and the patent. Although I am not discounting the likelihood of corporate shenanigans just this side of a law suit.
You suggest as fact a global conspiracy against CLYW on the magnitude of a James Bond villian's escapade. To your "LOL!" I must respond "OLO!"
My review of alleged CLYW deals informs me that Turrini has led the effort to suppress the CLYW patents. Why is open to speculation as he is a large stockholder, along with Daic. The only thing that makes sense is that they have been working together for years to maximize their return and to hell with the shareholders.
Fourteen working hours remain for Turrini to make good on his promise to release the "settlement" by the end of this week.
Cowards.
Not to be unkind, but frankly, while your after-the-fact analyses have arguably had some value, your predictions of events have been lousy.
Before Friday means today or tomorrow.
Congratulations on getting Turrini to answer any questions. My requests have gone unanswered.
I have to call "bullshit" on this. No client has to beg his attorney to do anything. The client tells the attorney what to do, and when, as long as it is not unlawful or improper. Turrini is stalling again. He must think we are stupid. As an alternate explanation, he is using Daic's attorneys and they report only to Daic. I have been involved in civil suits. Paperwork takes days, not months or years. You decide.
If his most recent claims prove true, I will apologize publicly. If, as has been his history, he is just continuing to knowingly cheat the shareholders, I will also have something to say.
If it existed, it would have been filed. We need to determine what to do next when the January deadline passes and Daic wins his 2008 suit by default.
pssst... there is no written settlement agreement.
Nor does anyone else per Walsh's firing them. Now what?
