9 working for Treaty headquarters.
10 Q. What were these gentlemen doing for Treaty?
11 A. They were doing investor communications through
12 social media.
13 Q. So on Sunday, January 29th, 2012, which was the
14 day before Treaty made the public announcement of its
15 claimed oil strike in Belize, you sent a draft of that
16 release to Mr. Itak and Mr. Amanollahi?
17 A. Right.
18 Q. Why were you sending a draft of the press release
19 to these two individuals?
20 A. They were working for the headquarters, for
21 Andrew Reid, and they're responsible for social media
22 communication with shareholders.
23 And they were -- and I was asked to get
24 information to them so that they could handle
25 shareholder inquiries and shareholder information
1 through their social media after the news release went
2 out so they had to be informed as to what we were
3 talking about.
4 Q. So you wanted them to be prepared to push the
5 news out on social media that Treaty was planning to
6 announce on Monday morning?
7 A. They were being prepared so that when the news
8 release went out Monday, and I didn't want them to do
9 it.
10 Headquarters had them under agreements to do
11 social media communication of investor information, and
12 they would never put anything out until after it was
13 already public information by news release. So they had
14 to be informed.
15 Q. You wrote that you wanted to be sure that the
16 release had major impact. Do you see that?
17 A. Yeah.
18 Q. Why did you want the release to have major
19 impact?
22 A. It's totally arbitrary. I was a shareholder,
23 too, and the shares were at one-tenth the price of what
24 I got in at.
1 in deep, deep doo-doo at the time.
2 And we wanted to see the company -- everybody
3 believed we had an incredibly positive release coming
4 out. And everybody prayed to God it would affect the
5 stock in a positive way because everybody had lost a lot
6 of money at that point.
7 Q. You wanted the press release on the claimed oil
8 strike in Belize to have a major impact because you
9 wanted to be able to make money on the shares that you
10 were holding?
11 A. No.
21 Q. Right. So you were never able to sell your
22 stake, the shares that you had, because the stock price
23 never went up and staid up at a level that would enable
24 you to cash out basically.
25 A. No, that's not the -- I expected Treaty Energy to
1 be a very successful oil and gas company.
2 Q. And you would sell your shares and make money?
3 A. I would keep them as long-term investments in my
4 retirement account. I would sell some when I needed it
5 to pay the mortgage, yes.
10 Q While you were working for Treaty, were
11 they more interested in putting out press releases --
12 A Oh, yes.
13 Q -- than they were in drilling for oil?
14 A Yes, yes, yes, yes, yes, yes, yes. They
15 were more interested in keeping that investor
16 bulletin board thing responding to that. That seemed
17 to be their focus. Hamdi and I eventually -- we were
18 scratching our heads. What the heck are these guys
19 doing?
20 And we eventually came to the conclusion
21 they're not an oil company. They're a stock company.
22 And so they're not putting the money here in Belize
23 like they should have done.
They did it to appease investors.
16 Q And then the seventh paragraph starts: At
17 1235 feet hydrocarbons were detected in the form of a
18 gas register. Do you know what that refers to?
19 A It's hilarious. Anybody reading this thing
20 would realize that whoever wrote this doesn't know
21 what they're talking about, and so it's embarrassing.
22 Throughout the presence of Treaty down there, we had
23 to deal with this sort of frustration.
24 I think whoever wrote it, what they're
25 trying to say is that we had a gas increase in the
1 mudlog. I think that's what he was trying to say.
2 But the way he wrote it, it's not --
3 Q Was there a gas increase in the mudlog?
4 A Not really. We got a little bit, but it's
5 not -- it's not a kick. If we had -- I wish it would
6 show a kick.
7 Q Would look like the test?
8 A Yeah, yeah.
9 Q Do you know where the 1235 number came
10 from?
11 A I don't know. I don't know why he put that
12 there.
13 Q Did anyone discuss this language with you
14 or --
15 A No. This came out prior to me even being
16 in Belize City. By the time we left Independence and
17 got to Belize City, this is already, you know, noise.
18 Q Do you know what the motivation for Treaty
19 Energy was for releasing this press release?
20 A I can only speculate. I don't know for
21 sure.
22 Q What is your speculation?
23 A They did it to appease investors.
24 Q And then the next sentence reads: This
25 presence of C1 to C4 gas readings indicated a
1 geopressurized oil bearing zone, slash, gas driven.
2 A I don't know where they got that. I don't
3 know how they can -- the presence of C1 to C4, we
4 didn't take C1 to C4 readings. I had no
5 chromatograph.
6 I don't know where they got that. I mean,
7 any oil and gas person who's associated were this
8 would have been embarrassed, and I was certainly
9 embarrassed.
10 Q And the next sentence reads: As drilling
11 continued, the indicators suddenly increased from the
12 depth of 1235 feet with readings being taken at
13 one-foot intervals.
14 So I wanted to ask you, were the readings
15 actually being taken at one-foot intervals? They
16 were taken at ten-foot intervals, right?
17 A (Moves head up and down.)
18 Q And was there a study --
19 A Well -- okay. Normally if you find
20 something, then you start just looking at every few
21 feet. You're not really taking -- you're stilling
22 logging every ten-foot intervals, but you take them
23 more often at this point because you're trying to see
24 any show oil. This sample might not be on the next
25 one or it might be -- you know. So you're trying to
1 catch that oil, and so you take it every few feet.
2 Q Okay. Was it actually taken at one-foot
3 intervals?
4 A No, no, no, no. I wouldn't have time to do
5 that.
6 Q Okay. And does the mudlog show that the
7 indicators suddenly increased from the depth of 1235
8 feet?
9 A Well, it showed that it increased up there
10 right at the limestone.
11 Q Would you consider this a steady
12 increase --
13 A No.
14 Q -- from 1235 feet?
15 A Huh-uh. It just went up, and it stayed.
16 It stayed constant. It's not -- that's not what I
17 would like to see.
Q Did you have any conversations with Harden
22 about the need for a wireline log to get more
23 specific information before you found out about this
24 press release?
25 A No. One, I didn't know they were going to
1 do a press release. And, two, I did not know whether
2 I would have been involved with the project at that
3 point. I was just here for mudlogging. And as far
4 as I was concerned, my stint was up.
5 Q When Harden was sort of jumping for joy, we
6 struck oil --
7 A Right.
8 Q -- did you ever say, "Well, wait for the
9 wireline logging to be able to get so excited"?
10 A No, no, no, no. I was pretty much out of
11 there at that point. I was thinking I'm done. I'm
12 going home.

16 Q What would you need? What sort of
17 information would Treaty need to come up with an
18 estimation?
19 A Well, one would be seismic -- some kind of
20 seismic studies there to give us an idea of the
21 extent of any anomalies, the geometry of the anomaly,
22 the extent of the field. We didn't have that.
23 Secondly, we needed a wireline log to give
24 us some porosity and to give us some oil in place
25 calculations based on that. We didn't have that. To
1 go by this, no.

22 1200 feet, and I'm not sure what the technique was or
23 what, but this is prior to me being there.

25 and so now at this point I'm going to look to see if

1 there's anything around 800 feet and look to see if
2 there's anything 1200 feet, where I want to focus on.
3 Q Did you -- besides just knowing that he
4 said there was oil at 800 or 1200, did they give you
5 any reports to look at?
6 A No.
7 Q Okay.
8 A No, nothing. You know, I figure out, okay,
9 I'll just come in there, and I'll look at the samples
10 if there's something there, and we had a mudlogging
11 unit system there with the red gas coming out of the
12 mud.
13 Q What type of mud logging system was it?
14 A It was a Geospect Mudlogging system or what
15 we call a hot-wire system, and it basically is simply
16 an electronic system to suck the gas from the
17 drilling mud as we're drilling. And if there's any
18 gas in there, it will show up, show some increase in
19 hydro -- in possible gas.
The FBI and DOJ have new information and apparently lying to an agent is also a felony. NEXT!
