Former Marijuana Regulators Call For 10 Equity Amendments To Bipartisan Cannabis Banking Bill
With the end of the current Congress approaching, efforts to find areas of compromise on marijuana reform are increasing—with lawmakers, advocates and stakeholders increasingly willing to set aside policy differences in the interest of getting something enacted before January.
The internal debate among reform supporters has long come down to the idea of incremental versus comprehensive, and the bipartisan Secure and Fair Enforcement Banking (SAFE) Banking Act is generally considered to represent the former side of the legislative spectrum as an achievable yet not particularly transformative change.
But while the standalone bill has faced criticism from certain equity-focused advocates and lawmakers, a new paper from the Cannabis Regulators of Color Coalition (CRCC) is one of the latest examples of how the reform conversation has evolved, with the group laying out a series of recommended amendments to the banking bill that they hope will bridge legislative divides.
CRCC’s paper, published by the Ohio State University (OSU) Moritz College of Law, is titled “Not a SAFE Bet: Equitable Access to Cannabis Banking, An Analysis of the SAFE Banking Act.”
It details the main components of the banking legislation—which has passed the House in some form seven times now but continues to stall in the Senate—and proposes several changes that the former regulators say would sharpen its equity impacts and help make the bill more acceptable to those who’ve insisted that sweeping justice-focused legalization must be prioritized ahead of modest financial reform.
For example, CRCC is calling for amendments to require financial institutions to prove compliance with anti-discrimination laws in order to receive the marijuana-specific protections offered under SAFE, require financial regulators to develop best practices to “achieve racial equity” in their services and expand federal study and reporting requirements to more holistically cover financial barriers faced by women-, minority- and equity-owned cannabis businesses.
“Without additional legislative amendments to directly address challenges related to fair and equitable access to financial services, small and minority-owned cannabis businesses that currently have inadequate access to banking services or loans are likely to continue to be denied the full breadth and depth of services offered to others,” the paper argues.
This analysis comes at a key time in the Senate, where Majority Leader Chuck Schumer (D-NY) and colleagues recently filed a long-awaited legalization bill. For months, the sponsors have been adamant about the need to prioritize passing the wide-ranging legislation first.
But in the weeks since the bill’s filing, the rhetoric has quickly shifted, with Schumer, Sen. Cory Booker (D-NJ) and other key players now emphasizing their willingness to compromise as the leader holds talks with bicameral, bipartisan offices about a possible package of modest marijuana reforms, including a cannabis banking fix, that may come following the midterm elections. The yet-to-be-filed legislation is being referred to as “SAFE Banking Plus.”

New Jersey Senate President Files Bill To Allow Interstate Marijuana Commerce
HUGE NEWS - States are forcing Feds hand to legalize Cannabis!
The governor of New Jersey would be authorized to enter into agreements for interstate marijuana commerce with other states that have legalized cannabis under a new bill filed by Senate President Nicholas Scutari (D).
However, the agreements could only be forged if federal law changes, or if the Justice Department issues guidance permitting such activity.
With more state adult-use marijuana markets coming online in the Northeast region, the legislation is timely, proposing to create the policy infrastructure for interstate cannabis commerce that could significantly expand the currently fragmented industry and help resolve possible supply and demand issues.
The fact that the bill is being sponsored by the Senate president—who also championed the state’s legalization law—signals that this is a serious legislative endeavor.
But the federal policy conditions that are built into the measure leave questions about the timeline for implementation even if it is passed. The bill itself would take effect immediately upon enactment, but the governor could only initiate the interstate agreements if Congress or the Justice Department gives such activity the green light.
There are also regulatory requirements that must be agreed upon by each of the participating states. The New Jersey Cannabis Regulatory Commission (CRC) and the legislature’s Joint Budget Oversight Committee would have certain oversight and rulemaking responsibilities to that end.
Under the legislation, the text of which has not yet been posted online but was obtained by Marijuana Moment on Tuesday, interstate marijuana commerce agreements would be contingent on compliance with the contracting state’s cannabis laws, including those pertaining to licensure.
The states must agree on the mode of transportation for marijuana products to be exported and imported. And such products could not be shipped through any state or jurisdiction that prohibits the activity.
Agreements could involve either medical or adult-use marijuana products. And considering that the majority of states have legalized cannabis in some form, the map of possibilities is theoretically expansive (especially as it concerns medical cannabis) as long as states and jurisdictions adopt permissive policies.
Any out-of-state marijuana business seeking to engage in cannabis commerce within New Jersey under the agreement must also receive a license from state regulators, as well as by local governments where the activity takes place.
“An agreement shall require that the contracting state impose requirements on foreign licensees with regard to cannabis and cannabis products to be sold or otherwise transferred or distributed within this State that meet or exceed the requirements applicable to State licensees,” the bill text says.
That includes meeting New Jersey rules on public health and safety standards, seed-to-sale tracking, laboratory testing of cannabis products, packaging and labeling requirements and marketing policies.
There must also be a “process for identification of adulterated or misbranded cannabis products, and the destruction of those products, using standards that meet or exceed the standards and procedures promulgated by the commission.”
The agreements would also need to include provisions that address how to handle “public health and welfare emergencies,” such as the need to promptly recall or embargo contaminated products.
“An agreement shall include provisions requiring appropriate regulatory authorities of each state to investigate instances of alleged noncompliance with the commercial cannabis regulatory rules and regulations upon request by the other state and in accordance with mutually agree-upon procedures,” the legislation says.

Missouri voters to decide whether to legalize marijuana in November
JEFFERSON CITY — Missourians will vote Nov. 8 on full legalization of marijuana, Secretary of State Jay Ashcroft announced Tuesday.
Ashcroft, a Republican, said his office confirmed that the campaign to place a legalization question on the ballot indeed collected enough signatures for voters to weigh in this fall, despite unofficial reports from counties last month indicating the effort would fall short.
At the same time, Ashcroft said a plan to institute ranked-choice voting did not collect enough signatures to make the November ballot. The campaign backing the measure, Better Elections, expressed disappointment.
Legal Missouri 2022, which had poured nearly $6 million into the marijuana campaign, now must convince a majority of Missouri voters to back legalizing marijuana in the Nov. 8 general election.

Florida recreational marijuana initiative launched

TALLAHASSEE, Fla. - Trulieve, the state’s largest medical-marijuana operator and country-music legends The Bellamy Brothers are backing a proposed constitutional amendment that would allow recreational use of marijuana by people 21 or older.
The proposed amendment was filed Monday at the state Division of Elections, with Tallahassee-based Trulieve contributing $5 million to the effort to get the measure on the 2024 ballot. Other multi-state medical marijuana operators also are expected to support the campaign.
Florida voters passed a constitutional amendment in 2016 to broadly legalize medical marijuana, and nearly 800,000 patients have been authorized for the treatment.
While past recreational marijuana initiatives in the state have failed, supporters of the new proposal say they’re confident it will satisfy Florida Supreme Court requirements to make it onto the ballot and will gain support from voters.
"It’s all about improving access," Trulieve CEO Kim Rivers told The News Service of Florida in an interview. "We came into this with a mission to provide access to high-quality products that are safe and have an appropriate value proposition to give folks control over their --- in the original days --- medical journey. I don’t think that changes here. I mean, in effect we are at our core about expanding the opportunity for access to safe legal product, which is what this would allow us to continue to do."
The "Adult Personal Use of Marijuana" proposal would allow people 21 or older "to possess, purchase, or use marijuana products and marijuana accessories for non-medical personal consumption by smoking, ingestion, or otherwise."

New Florida Marijuana Legalization Initiative Filed For 2024 Ballot, With Backing Of State’s Largest Medical Cannabis Company
A new industry-led campaign in Florida filed a marijuana legalization initiative aimed at the 2024 ballot on Monday.
Past attempts to place adult-use legalization on the Florida ballot have been challenged and rejected by the state Supreme Court. But the Smart & Safe Florida political committee says the language of their proposed amendment to the state’s marijuana law will avoid such a contest and prevail.
The initiative is being backed by the state’s largest medical cannabis operator Trulieve, along with musicians with the country band The Bellamy Brothers, who are featured in an initial ad for the effort that talks about the economic opportunities and civil liberties implications of recreational legalization.

Key senator open to compromise, hopeful of some US marijuana reform

U.S. Sen. Cory Booker said this week he would support cannabis banking reform separate from a comprehensive federal legalization bill as long as the banking measure includes a “restorative justice” piece to give relief to those convicted of nonviolent marijuana offenses.
The New Jersey Democrat talked about being open to compromise in interviews with NJ Spotlight News and Cheddar News and expressed optimism that some kind of reform can get done before the end of the current Congress.
Booker previously has been adamant that comprehensive marijuana reform should be the priority rather than passing the SAFE Banking Act as a stand-alone bill.
SAFE Banking would enable financial institutions to provide banking services to state-legal marijuana businesses without fear of federal reprisal.
Booker said “conversations” are going on right now and it “should not be that hard to get in some kind of compromise.”
He added that he’s “hopeful” something can get done before the new Congress is seated in January 2023.

Today’s sentencing of Griner underscores the need for domestic cannabis reform,” Martiza Perez, director of the office of federal affairs at the Drug Policy Alliance, told Marijuana Moment. “The U.S. is responsible for exporting the drug war across the globe. It still arrests, incarcerates, and deports people for low-level cannabis arrests and convictions.”
“This makes it incredibly challenging to protect U.S. citizens abroad. We cannot stand on a moral or legal high ground because we don’t have it,” Perez said. “The US must end marijuana prohibition and remedy the harms of mass cannabis criminalization.”

American basketball player Brittney Griner was been sentenced on Thursday to nine years in Russian prison after being found guilty of possessing cannabis vape cartridges.
The case has captured international attention, placed pressure on the White House to secure her release and prompted calls from advocates and lawmakers to reform U.S. marijuana laws that similarly criminalize people over cannabis.
In a statement on Thursday, President Joe Biden said that Griner’s sentencing “is one more reminder of what the world already knew: Russia is wrongfully detaining Brittney.” The State Department classified Griner as a “wrongfully detained” person and maintained that designation even after she pleaded guilty to the cannabis possession charge.
“It’s unacceptable, and I call on Russia to release her immediately so she can be with her wife, loved ones, friends, and teammates,” Biden said. “My administration will continue to work tirelessly and pursue every possible avenue to bring Brittney and Paul Whelan [who is serving a 16-year sentence over alleged espionage in Russia] home safely as soon as possible.”

Joining us to discuss all of this, a lot of it to discuss is Tilray CEO, Irwin Simon. Irwin, it's good to see you. I was just looking back today and I found an interview that I did with you from 2012 when you were at Hain Celestial. So 10 years now and running that we've been talking about consumer products of one kind or another. I want to start with legalization.
- I looked a little younger then, right Julie?
- We both did. Let's dig into the business in a second. I just want to start with the federal legalization question because I know you guys don't sell marijuana itself in the United States, sell cannabis itself in the United States. What do you-- I'm sure you're watching the situation in Washington closely, where are you sort of gaming out the prospects at this point?
- So, Julie, let's step back to basically what the consolidation of Aphria and the acquisitions of multiple brands. And, as you said, you look back at Hain at 2012 and the brands that I acquired there and what we built into the largest natural organic food and personal care and protein company, if you step back and look what we're trying to build here is Tilray Brands, number one. With a focus on cannabis, with a focus on adult-use, medical, spirits, beer, and wellness and food.
To step back and look at the biggest opportunity, the US is $100 billion opportunity in cannabis. If you look at cannabis today in the US, 93% of Americans want medical cannabis legalized and about 63%, 65% want adult-use.

Advocates and industry stakeholders have been hanging on the senator’s words in the weeks since he filed a long-awaited federal legalization bill alongside Senate Majority Leader Chuck Schumer (D-NY) and Senate Finance Committee Chairman Ron Wyden (D-OR).
That’s because, for the better part of the past year, Booker has drawn a clear line in the sand, insisting that comprehensive legalization must be enacted first before modest reforms like the Secure and Fair Enforcement (SAFE) Banking Act advance in his chamber.
Since filing the Cannabis Administration and Opportunity Act (CAOA), however, Booker has characterized himself as a “compromise guy,” ready and willing to work with his colleagues across the aisle to get something done on marijuana policy before the end of the session.
That something will likely be what’s become known as “SAFE Banking Plus” that combines protections for financial institutions that work with state-legal cannabis businesses with other reforms such as expungements for people with past convictions and industry access to federal Small Business Administration (SBA) services. Schumer has been holding bipartisan and bicameral talks about what such a marijuana omnibus bill might look like.

The non-partisan National Conference of State Legislatures (NCSL) has voted to adopt a revised policy directive that expresses support for federal marijuana descheduling and cannabis banking reform amid the state-level legalization movement.
The measure, which builds on an existing directive that NCSL passed in 2018, was approved at the organization’s 2022 legislative summit on a voice vote on Wednesday.
Most of the discussion that preceded the vote centered on the need for federal banking reform, a state lawmaker present at the event told Marijuana Moment, but there was no debate over the legalization language. While there was no roll call, the legislator said that opposition was minimal, and he estimated that only about five to seven of the 44 states and territories present seemed to raise their voice against adoption.
NCSL did previously pass a directive calling for cannabis descheduling in 2017, but the most recent measure that was revised this year previously said simply that states should be allowed to set their own cannabis policies without federal intervention. Members of NCSL voted to expand that position to include an explicit call for federal legalization.
The directive was also revised to say that, “until cannabis is federally descheduled,” the executive branch should prioritize enforcement actions against criminal enterprises involved in “illicit” cannabis production and sale, rather than people acting in compliance with state marijuana laws.

POLITICS Biden Daughter-In-Law Reportedly Shopped At Marijuana Dispensary With Secret Service Protection As President Leaves Cannabis Prisoners Behind Bars
As frustration mounts over unfulfilled promises to reform federal marijuana laws, a recent, controversial report has emerged about President Joe Biden’s daughter-in-law allegedly receiving U.S. Secret Service protection as she shopped at a cannabis dispensary in California.
The Daily Mail reported late last month that Melissa Cohen, who is married to Biden’s son Hunter, was spotted leaving a Malibu dispensary called 99 High Tide, with a “small unidentified purchase.”
While marijuana is legal for adult use in California, it remains federally illegal. The controversy isn’t so much not about Cohen reportedly patronizing the shop; rather, it’s about the apparent use of a federally funded Secret Service detail to protect the transaction at a time when Biden has failed to fulfill his campaign pledges to decriminalize cannabis and free people who are serving time behind bars for past convictions.
Biden has said that he doesn’t believe people should be incarcerated over cannabis, and he’s expressed support for letting states set their own policies without federal intervention, but he hasn’t taken meaningful steps to end federal criminalization as he promised on the campaign trail.
The president did grant clemency to 78 people, including those with non-violent federal drug convictions on their records, in April. But advocates have made clear that they want to see bolder executive action, like a mass pardon for all people who remain behind bars over marijuana.
To that end, the optics of a presidential relative reportedly getting Secret Service protection while appearing to engage in an activity that remains federally prohibited and for which the president is allowing people to remain in prisons despite campaign promises to the contrary raises questions.
However, it’s important to note that while the Daily Mail reported that the person in plainclothes who appears in the outlet’s photos next to Cohen is a Secret Service agent, Marijuana Moment has not been able to independently confirm that. It’s also possible that Cohen could have purchased non-cannabis items at the dispensary, or federally legal hemp items.
The White House did not respond to a request to fact-check The Daily Mail’s reporting and offer comment.

While Biden has backed modest cannabis reform proposals, the White House has made clear that his overall position in opposition of adult-use legalization has not changed, despite supermajority support for the policy change among voters in his party.
Instead, the president’s only public comment on marijuana policy since taking office happened last month, when said in response to a reporter’s question about cannabis clemency that his administration is “working on” it.
Biden’s broader opposition to recreational legalization hasn’t stopped congressional lawmakers, including Senate Majority Leader Chuck Schumer (D-NY), from working to end federal prohibition legislatively, however.
The leader filed a much-anticipated legalization bill that would also impose a federal tax on cannabis sales and promote social equity last month. However, chances are slim that the comprehensive reform proposal has enough support to reach the 60-vote threshold needed to advanced through the chamber.

Sen. Cory Booker (D-NJ) says that he’s “open to compromises” on marijuana reform, including the possibility that the Senate pass modest cannabis banking legislation with social equity components before advancing a wide-ranging legalization bill that he introduced last month.
In an interview published by NJ Spotlight News on Friday, the senator was asked whether he could see a path forward for more incremental marijuana policy reform, as he signaled he was considering at a Senate Judiciary subcommittee hearing last week that he convened as chairman.
Booker has faced criticism from some advocates and stakeholders over his prior opposition to moving anything in the Senate before comprehensive legalization was enacted.
“Look, I’m a compromise guy. New Jersey sent me down here to get things done—not to make stands where I make good points but don’t pass bills,” the senator said.

Pot drinks on the rise
Alcohol has long been the dominant social lubricant — but the growing cannabis industry wants to offer a replacement.
The market for beverages made with THC, marijuana’s psychoactive ingredient, is growing. Smaller players are looking to do more than just get people high — they’re positioning their beverages as more sophisticated and wellness-oriented. Specific niches the products seek to fill include relaxation, socializing with friends or improved sleep. The dosage of THC per serving is often as low as 2.5 milligrams, a far cry from the “small, but mighty” bottle of Orange Mango offered by Major or Keef’s Fruit Punch Xtreme.
Brands can appeal to a wider audience with drinks that can be sipped without getting people too high, said David Weiner, co-founder of Gossamer, a cannabis lifestyle and media company. Improvements in technology have translated into shorter waits for the buzz to hit, too. “You’re seeing dosages go down per drink,” Weiner said. New drinks have “higher design, less focus on THC, less focus on cannabis, and more focus on other ingredients.”

In some cases, no one else is checking.
Hemp products that can get you high have proliferated online and at corner stores, even in places where marijuana remains illegal. The products, marketed under names like delta-8 and delta-10, have been a lifeline for the struggling hemp industry. Even critics of the products acknowledge some companies maintain high standards for their products, with credible lab testing and careful quality control.

A decade ago, Americans were nearly evenly split on whether to legalize marijuana. While half the country favored revising U.S. drug laws to make room for legal pot, the other half said to keep cannabis prohibition in place.
Public opinion has since shifted dramatically. Now more than two-thirds of the country favors legalization. That includes 83% of Democrats, 71% of independents and 50% of Republicans, according to Gallup polling.
But just because a proposal is popular doesn’t mean it is wise.
Like you, we on the USA TODAY Editorial Board have seen and felt the national sentiment shift in recent years, and we have asked whether this direction is in the country’s best interests. With editorials in 2012, 2016 and 2018, we urged caution, worrying that a rush to legalize marijuana could carry consequences both unintended and unwelcome.
Now that Democrats in the Senate have introduced a package of proposed marijuana policy reforms – along with a commitment to work with Republicans “to get something done this year” – it’s time we look back on what we have learned in recent years and rethink our position.
More and more states contradict federal cannabis law
A decade ago, none of the 50 states had legalized marijuana for recreational use. That began to change in late 2012, when Colorado and Washington authorized their “adult use” programs. Now a majority of states have laws that permit marijuana in certain circumstances:
?Nineteen states allow marijuana for medical or recreational use.
?Eighteen states allow marijuana for medical purposes only.
?10 more states allow products with nonpsychoactive compounds.
?Two U.S. territories and Washington, D.C., also have legalized recreational marijuana.
Three states – Idaho, Kansas and Nebraska – do not allow any marijuana products.
