Genius Products has another pair of Sci Fi Channel flicks flying onto disc later this year as part of its Maneater Series. First up is WYVERN, from director Steven R. Monroe and featuring Nick Chinlund, Erin Karpluk and Barry Corbin taking on the titular beast (a fancy term for a dragon released from its burial under ice by global warming); it streets Aug. 18. Not long after, September 8 sees the RISE OF THE GARGOYLES, helmed by VIPERS’ Bill Corcoran and set in Paris, where the winged beasts terrorize Eric Balfour, Nick Mancuso and Tanya Clarke, among others. Both movies will be presented in widescreen with 5.1 audio. Retail price is $14.95 each.

Three Reasons Scratch will be Better than DJ Hero
This winter, two competing music rhythm games will each vie for your attention - and money. Both games will ditch the tired rock-and-roll theme that has been so tremendously successful in favor of sampled beats and a turntable. While both games will allow pasty white nerds everywhere the chance to vicariously live out their fantasies of laying down ill beats, only one is deserving of their time and money. That game is Scratch: The Ultimate DJ. Here are three reasons why we think the innovative new title from Genius Products will trounce Activision's competing game, DJ Hero, when both land side-by-side in shops this winter.
Scratch did it first
You know that episode of Sienfeld where Kramer comes up with this great idea for a cologne that smells like the beach, and then Calvin Klein totally steals it? That's pretty much what Activision has done here. Scratch: The Ultimate DJ has been in production since 2007, with 7 Studios developing and publisher Genius Products behind the title. However, after having acquired the developers at 7 Studios, Activision quickly announced its own music rhythm game in 2008 that is eerily similar to the one already in production by Genius. Genius has sued Activision and 7 Studios, alleging that the latter basically stole their idea. While the court case is unlikely to be settled in time to prevent either game's release, we recommend settling this score the old fashioned way: with a DJ battle.
Facin' a collaboration
Any music-rhythm game purporting to represent DJ culture is going to need a lot of street cred, and Scratch seems to Activision beat here as well. Genius Products has collaborated closely with Beastie Boy and scratch maestro Mix Master Mike on Ultimate DJ. We can't think of anybody whose input would be as knowledgeable when it comes to the history of sampled music. Activision has tons of money to license music tracks for its game, so we have no doubt that their final setlist will be impressive in scope. However, the designers of Scratch have really done their homework and secured deals with artists who really define the DJ culture. It has been confirmed that the Scratch setlist will include music by DJ Shadow, the Gorillaz, and Run DMC, for starters.
The Controller
Every fan of Rock Band knows that the controller can make or break the game. That is why the design of the turntable for both of these DJ games was so important, and why each side has kept their design a secret until the very last minute. It's hard to fault the choice made by Activision to put the finger buttons right on the turntable to emulate the feel of scratching a record, but the overall design looks uninspired. While the DJ Hero controller is certainly functional, the Numark-inspired deck included with Scratch: The Ultimate DJ is the bomb. The Numark deck features a free-spinning, touch sensitive turntable and a crossfader. Players can even record and upload their own samples using a compatible USB microphone.

No, it's not a symptom of the dreaded Swine Flu, but there has been a seeming rise in disputes concerning "tortious interference" in the games industry as of late. The most notable example being the Scratch: The Ultimate DJ dispute. Of course, from the first appearance of that curious word "tortious," there's been much confusion; be it over the term's actual meaning or it being incorrectly interchanged with the non-legal word "tortuous" (meaning winding or twisting).
The word "tortious" comes from "tort," which is a civil wrong that results in damages. So, "tortious interference," from a definitional standpoint, is when someone intentionally interferes in someone else's business or contractual relationship and causes civil damage. These two varieties of tortious interference are not the same on a more detailed level, however.
When someone commits tortious interference with respect to a contract, that person is either convincing one party to a contract to not perform or preventing them from performing. In this case, it would be the other party to the contract who would be able to bring a lawsuit. On the other hand, tortious interference with a business relationship is different. This occurs when the interfering party prevents someone from establishing or maintaining a business relationship. For example, stealing a client list or making false accusations against another business might be tortious interference, in addition to the other possible claims that might exist for those actions.
The games industry is a heavily contract-driven industry, so most claims of tortious interference in a gaming context are likely to be concerned with contracts. Rather than further dissect the Scratch issue, I'll illuminate the big picture of tortious interference with a similar, but hypothetical situation:
Let's say that a saxophone-based music game was the supposed "next big thing," and to that end, a small upstart company called Blues Software was developing the game based on an alliance with sax manufacturer Yahama. Blues Software got Yamaha to make a half dozen Sax controllers. Blues decided on the title "Swingin' Sax" for its game. As a development model, Blues was doing all of the art in-house, but had contracted with Horn Studios for the game engine's programming.
The contract was pretty standard, with a series of milestones and associated milestone payments. It was anticipated the project would be done in no more than 18 months. About 8 months later, the development of Swingin' Sax was stalling. Horn Studios was behind, and based on some unrelated projects failing, needed an infusion of cash. Enter Big Games, who had recently signed a contract with Fox to develop "Lisa Simpson's Sax Hero" and its follow-up "Lisa Simpson's Big Band."
There are varying degrees of severity of tortious interference that could come into play at this point. If Big Games had no idea about the Swingin' Sax project, and contacted Horn Studios to develop the engine for Sax Hero, there might be a finding of tortious interference if Horn gave up work on Swingin' Sax for Sax Hero. More likely, though, is that Big Games would be aware of Horn Studios' work, and if Big Games then tried to induce Horn Studio to quit work on Swingin' Sax in favor of Sax Hero, specifically to prevent Swingin' Sax from beating Sax Hero to market, then there's a pretty certain and egregious case of tortious interference with the contract between Blues Software and Horn Studios.
There could be tortious interference with a business relationship that arises, too. Say both Blues Software and Big Games were targeting similar music artists for use in their games. If Big Games went to these artists and negotiated non-exclusive licenses, but then also tried to convince them not to work with Blues Studio, then that might be grounds for a tortious interference with a business relationship claim.
So do recent tortious interference claims in the game industry say anything about the health or integrity of the industry as a whole? As with most other industries, this sort of litigation isn't really a barometer. Ultimately, in all industries, business arrangements work out and others fail, and when something goes wrong, it often leads to a court battle of one type or another. Such is the nature of doing business in today's world. While there are certainly unethical and apparently unethical actions in the market at any given time, it takes more than a small uptick in litigation to show there might be something wrong. The game industry is just continuing to grow, and as it does, the number of disputes will likewise grow.

Undoubtedly, there will be more hearings before (and after) August 12th. I have a feeling Scratch The Ultimate DJ will be released well before the conclusion of legal proceedings, unless Activision and Genius are willing to settle out of court. However, a settlement is unlikely, as Genius knows they will will prevail by a Jury trial in the end, imho.

What is a Case Management Conference (CMC)?
A CMC is a meeting that takes place at the Court House. Attendance at this meeting is limited to the Judge, and the parties (the Plaintiff and the Defendant). If party has a lawyer representing him or her, the lawyer may also attend. This meeting happens after the Plaintiff begins the lawsuit by filing the Claim/Summons, but before the trial. Generally, the CMC is 30 minutes to one-hour long.
This meeting is not a trial and, therefore, witnesses do not attend at this stage.
Why Have a CMC?
The CMC is a mandatory step in the Small Claims process for most of the civil claims filed. The purpose of this meeting is to try settling some or all of the issues in dispute before going to trial. This may mean that a trial is ultimately not necessary. However, if a trial is still needed, it might be shorter and simpler because some of the issues have been resolved at the CMC.
What Happens at a CMC?
The CMC begins with the judge and the parties meeting together to discuss the case. In certain situations, the judge may even take turns meeting with the parties separately to discuss each side of the case. Exactly how a meeting proceeds may vary from case to case.
During this meeting the Judge will give the parties input on their case, including:
the Judge’s assessment of the strengths or weaknesses of each party’s evidence
the Judge’s opinion of the statute or common law that might apply
the Judge’s suggestions for possible resolution
How Do I Prepare for a CMC?
It is important to come to the CMC prepared to deal with your case. This means that you must bring all relevant documents with you. It is helpful if these documents are organized by date. Unless otherwise directed by the Court, all parties must attend the CMC and be authorized to settle the case. It is not sufficient to send someone on your behalf who cannot consent to a settlement.
Rules of a CMC
1. The judge conducting the CMC will not be the trial judge so parties can speak freely.
2. All settlement discussions are “off the record”. This means that if a trial is necessary, the discussions from CMC cannot be used by either party at trial.
This includes any of the opinions expressed by the judge on any issue.
It is possible that there may be some points of agreement reached during the discussion. If so, the CMC Judge will advise the parties that these points will be communicated to the trial Judge.
What If The CMC Does Not Lead to Settlement?
If no settlement is achieved at the CMC, the matter will proceed on to trial. The date for the trial will be set at the CMC. At the trial, the judge may award certain costs if the matter could have been settled at the CMC but was not.
If the case must proceed to trial, the CMC judge asks the parties for certain information about the trial. This includes:
The number of witnesses the Plaintiff plans to call.
The number of witnesses the Defendant plans to call.
The need for any expert evidence or expert witnesses for either party, including the expert’s name, occupation and title/position.
Will either party be getting a lawyer to represent them at the trial?
Are there documents that the parties must exchange?
How are exhibits going to be presented? For example, photographs are better than bulky engine parts or a can of paint.
Are there any special requirements? For example, a witness from out of town who wants to give telephone evidence.
The CMC judge will conclude the meeting by ensuring that each party receives an information package entitled “Preparing for Trial”. He or she will also give a brief explanation of the trial process and how to prepare.
Finally, the parties are free to continue settlement discussions on their own anytime after the CMC. If a settlement is reached, the Plaintiff should advise the Court in writing.

Genius Products and The Weinstein Company have provided details for the upcoming release of The Legend of Fong Sai Yuk for 26th May. Directed by Corey Yuen, and starring Jet Li, the special features will include a Bay Logan commentary and interviews with the director, choreographer and writer.
Synopsis
Jet Li stars as a carefree young martial arts expert who gets involved with a government official’s daughter just as he discovers his family is part of a rebel resistance movement. Since numerous buyout attempts have failed recently for Image Entertainment, I see the company eventually forming a partnership / merger with a similarly aligned / positioned multimedia company, such as Genius Products, imho. GLTY!

Image Entertainment Hires New Financial Advisor
DVD distributor Image Entertainment Inc., which recently ended an protracted, unsuccessful attempt to be acquired by a company that couldn’t come up with the financing, apparently is ready to jump into the M&A pool once again.
The Chatsworth licensee and distributor of entertainment programming said Wednesday that it has retained Houlihan Lokey Howard & Zukin Capital Inc. to explore strategic alternatives, which could include financing or sale transactions.
“In choosing Houlihan, we were very impressed with their reputation and positive track record, and we are confident that they will help us strategize the best course of action for Image’s shareholders as we move forward,” said President Jeff M. Framer in a statement.
Image has made repeated attempts in the past few years to find a financial backer that would allow the company to retain some of its independence.
The company in April ended a merger agreement with Nyx Acquisitions Inc. after the San Francisco private equity firm repeatedly failed to meet deadlines for closing the $60.2 million deal first announced in November.
An earlier merger with BTP Acquisition fell apart in February 2008 when BTP also could not arrange financing. In addition, Image’s board and management fought off an unfriendly takeover attempt by Santa Monica independent studio Lions Gate Entertainment Inc.

KIOSK is far from dead, imho. Studios and suppliers wish to adjust the pricing model for DVD / Blu-ray media used for rental (not retail), as they believe it is unfair.
Digital delivery via Kiosk (USB / Flash cards) is also growing.
I believe consumers will always prefer packaged media (any format) over streaming content.
The agreement between Blockbuster and Genius Products GNPR is a win-win situation for all, as Blockbuster can use its reach and advertising might to push new Blu-Ray and DVD content to the consumer.
The Blockbuster I was referring to is located in the largest city (by population) of the state. No matter the time (or day of week) the parking lot is ALWAYS empty! :oO
Instead of Brick and Mortar, I see KIOSK as the way to go (lower operating costs) for the company, GLTY.
The Blockbuster in my neck of the woods is like a ghost town.
However, I do see value in the Blockbuster brand name and Mail (subscription) / Kiosk / Streaming / Digital Content Delivery Models. GLTY.
Wal-Mart broadens electronics inventory
Wal-Mart will try to boost consumer electronics sales with such initiatives as broadening its stock of Blu-ray Disc players, high-definition televisions and mobile devices.
Wal-Mart will dedicate part of its electronics section to displaying Blu-ray players, Blu-ray discs and HDTVs, the company said in a statement. As part of the promotion, Wal-Mart will price a Philips Blu-ray player for $198 in most of its 3,500 stores starting this week as well as a Magnavox Blu-ray player for $168.
“We’re trying to create a ‘sound and sight’ area so that together you see what that experience is like,” said Wal-Mart spokeswoman Melissa O’Brien. “We’re following what we feel is the customer’s lead on that.”
The increased Blu-ray selection is part of a broader effort to boost electronics sales by changing signage and improving product displays, the company said. Wal-Mart, which doesn’t break out sales of consumer electronics, last week said its fiscal first-quarter earnings were little changed from a year earlier on sales of $93.5 billion, which also were little changed.
In addition to a broader Blu-ray and HDTV selection, Wal-Mart plans to increase its selection of wireless products by about 30% and broaden its videogame and personal computer choices.
