So not only does Musclepharm have to pay their own legal fees and settlements they also have to pay Costco's legal fees and all judgements levied against them in the case.

You're relatively new here right? Fraudulent labeling is not new to Musclepharm. They were kicked out of a third party certification program last year because they lied on their labels.
They have been sued by NSF for fraud and paid out a big settlement about this time last year.
The fact remains they are embroiled in 2 class action lawsuits now along with the SEC investigation that has been going on for 2 years now.

The problem with Msclepharm is that they have turned themselves into a discount brand. They are a low cost bottom tier brand plain and simple. Once you enter this category you don't come out.
