Judge Merchan may need to rethink his obvious desire to imprison Trump

Judge Merchan seems to have no alternative but to sentence Trump to jail, given the obvious fact that Merchan and his rabid constituents are inflamed by the enormity of Trump’s conviction on thirty-four felony counts. However, there are problems that place the judge between the proverbial rock and a hard place. Here are some possible issues:
What if the Republican convention is moved forward to, say, July 4th to be convened at Mar-A-Lago? Trump would be chosen as the Republican nominee for President. Then, Merchan would be sentencing the Republican nominee for President. That’s an escalation that might cause the judge to pause about his options.
Where does a prison sentence leave Merchan when it comes to the armed Secret Service? Does he say that Trump must give up Secret Service protection in prison? No, because he lacks the power to do this. Therefore, by sending Trump to prison, he effectively sentences his Secret Service agents to prison as well. This would create a constitutional crisis that SCOTUS would have to settle.
Normally, once someone is convicted of a felony in New York City, that person is immediately placed in the custody of NYC law enforcement and sent to Rikers Island Prison. Rikers Island, as Law & Order TV fans well know, is a hell-hole. Is it likely that the Secret Service would allow this for its agents? There’s another constitutional crisis.
What if Merchan sentences Trump to house arrest. Which house? Trump is a resident of Florida. The idea of house arrest, of course, would be to restrain Trump from campaigning. This would look like trying to unfairly influence the election. Not a good idea.
Probation is a possibility, but that seems much too light to fly with those who have Trump Derangement Syndrome (TDS). They have an irrational fear of Trump that leads them to obsessive hatred. TDS is rampant throughout the Democrat party and includes some RINOs as well. Certainly, Merchan, as an operative of the Democrat party, has TDS. Benny Thompson, a congressman from Mississippi, has raving TDS as attested by his introducing a bill in the House that would remove Trump’s Secret Service while in prison, an invitation to assassination.
Given that all of the options are a problem for the Democrats, what’s left? Merchan could levy an enormous fine on Trump designed to cripple his businesses, but the crime alleged was not a monetary crime but was, instead, an alleged cover-up through bookkeeping, and the New York statutory guidelines don’t authorize massive monetary penalties. While it’s a likely possibility, it would be yet another appealable issue.
The best that Democrats can get out of this is to call Trump a “convicted felon,” which they’re currently working to death. As usual, they don’t know how to phrase things. A felon is a felon, making “convicted” redundant. For example, in Democrat talk, Hunter Biden is an “unconvicted felon.”
No matter how it comes down, the trial and the sentencing process are likely to have a profound impact on the presidential election and the future of the Republic. And, this time around, Trump is not going to let things slide. Assuming Ken Paxton or Jeff Landry is Attorney General and, perhaps, Vivek Ramaswamy is at Treasury or some other prominent advisory role, they will remind Trump every day what needs to be done, how to do it, and what is being done to reverse DC’s total control of our lives.

Democrats' lawfare got a wet snap of the towel in the face when Rep. Thomas Massie of Kentucky questioned the very basis for the appointment of a special counsel to target President Trump in questioning Attorney General Merrick Garland at a congressional hearing.

He gripped onto Garland like a rat dog, shaking and shaking the political catspaw until Garland admitted that Joe Biden didn't appoint Smith, nor was he confirmed by the Senate in contrast to what Massie read out loud at the beginning of the exchange in the Massie video, called "the appointment clause of the Constitution," which described the critical importance of appointments being approved by the Senate. He also forced Garland to admit that that the special council's law had expired, which was his basis for arguing that the appointment was legal.
That left the Constitution as the law on special counsel appointments, the little carveout on special counsels was gone, and Garland was clearly not acting within the Constitution by appointing Jack Smith, who was not a public official confirmed by anyone when he got the job to Get Trump, which is another issue.
Former Attorney General Ed Meese of the Reagan era, a respected legal scholar now, put in his pithy two cents in a friend of the court brief describing what that meant:

Suffice to say, this was brutal and since then, Judge Aileen Cannon, who is handling Smith's classified documents case, has promised to review the appointment, which has been exposed by Massie as having no basis at all in existing law. He got no Senate approval and no presidential appointment, and holds no public office that has required those things, such as U.S. attorney, so he's just a dude.
Which tells us a lot about the lawlessness of this administration. It's telling that Smith has a rather spectacular disregard for the law, in his altered documents presented to the court over the state of President Trump's classified documents case, and in the Supreme Court's 8-0 overturning of Smith's prosecution and conviction of Gov. Robert McDonnell of Virginia, which had to have been pretty bad if all eight justices could swiftly agree that it was total garbage.
Now he's illegally in office with zero authority to prosecute and up until now, they've all just been going along with it. Well, one brave Republican stood up and said 'no.'
And now the odds are distinctly good that the entire house of cards will fall down.
This is what we want to see in our Republicans in Congress. Kudos to Massie for blowing the whole thing out of the water. He stands out.

2024: The Year of the Legal U-Turn?

While it is customary to offer hearty congratulations upon achieving long-sought after goals, kudos are not deserved this year when it comes to assessing the adherence to the rule of law in America. In fact, if there were formal graduation ceremonies at this particular time, there would be no prescribed turning of mortarboard tassels signifying accomplishment. Rather, given what we have just witnessed coming out of the Manhattan Criminal Court, it would be more appropriate for victorious partisans to set off on their jubilant celebrations by overturning police cars and lighting fires to established businesses.
However, the euphoria and unbridled glee expressed 24/7 by NeverTrumpers after the decisions were handed down may actually become an inflection point toward a return to law and order. In what must be a surprise to leftists throughout the land, a political backlash has started to emerge. Interviews of the general public, including self-identified liberal voters (along with the non-aligned) and even Democrat lawyers, recognize that this trial and the outcome was weighted heavily on the states’ political leanings instead of the rule of law and use of objective judicial procedures.
After the verdicts were announced, it immediately brought to mind a quotation of Lavrentiy Beria, head of Joseph Stalin’s secret police force, the NKVD. He once remarked “show me the man, I will show you the crime.” To many, Beria’s cutthroat methods are being echoed in the current state of American jurisprudence as we are witnessing at firsthand shades of the 1930s/1940s Soviet legal system. In that era, the Communist procedures were (and still are) purely based on the pursuit and maintenance of political power, not the impartial administration of justice.
Nonetheless, there are hopes that at least this blatant example of New York judicial malfeasance can be overturned. Several esteemed legal scholars are unequivocal in stating that there are numerous grounds for a successful Trump appeal. For example, the 14th Amendment questions surrounding the lack of due process during these proceedings should immediately rise to the top of the appeal. Also, a motion for a change of venue to a more politically balanced jurisdiction (the jury pool was drawn from an area where more than 75% voted for Biden in 2020) was denied. Further, a major premise of the district attorney’s case was that President Trump falsified documents to enhance his New York election prospects in 2016. The document, a legal Non-Disclosure Agreement (NDA), was signed in 2017, well after the election had taken place. There are other foundations for appeal regarding the porn star witness Stormy Daniels; her testimony was characterized as extremely prejudicial, as it sought to appeal to emotions of the jury and was unrelated to the post-election execution of the legal NDA. Judge Merchan, who presided over this case, also put extremely strict limitations on a proposed defense witness who was to testify that President Trump did not violate any federal election laws, thus emasculating his sworn evidence. Additionally, it will likely be argued that since this case concerned a federal election, New York State voting laws could not be applied. Another argument bound to come up during appeal is the judge’s misconduct in gagging President Trump from speaking publicly about this trial. Finally, the District Attorney’s swing-for-the-fences maneuver of combining two expired misdemeanors to create a felony is surely to be fertile ground for dispute.
Although the components of this case are the most recent illustrative examples of the collapse of American legal underpinnings, there are various other contemporary instances being reported across America that are starting to influence attitudes.
A few examples include, but are not limited to felony assaults on police officers being downgraded to misdemeanors in some jurisdictions, allowing assailants to escape more serious charges without posting any bail. It has been noted that the murder rates in Chicago exceed the combined combat fatalities in Afghanistan and Iraq, yet there is no outcry when these outrageous statistics are reported. In many jurisdictions, retail shoplifting amounting to less than $950 or $1,000 worth of goods are now ignored by city or county attorneys. In some states, the charges of criminal trespass on private property have been replaced by the soothing euphemism of “squatting” violations. Hordes of illegal immigrants swarm both the southern and northern borders, smuggling in enough fentanyl to kill every person here, while other illegals enable the sale of children into sex slavery or for forced agricultural labor.
When law and order are no longer a deterrent, when cause and effect have no impact, we experience a firsthand a breakdown of society; daily life, particularly in the major metropolitan areas, descends into chaos and the law-of-the-jungle rules.
All these actions reflecting blatant disregard and abuse of U.S. laws are being noticed by concerned citizens. And these instances are having a pronounced, cumulative effect on the majority of the voting populace. As a result, surveys indicate that we are losing confidence, and therefore respect, in the American legal system.
The hope is that the Trump kangaroo court results may finally be the catalyst for a sea change of attitudes about American jurisprudence amongst voters and that the legal pendulum will swing back to bring about positive changes.

The Trump Verdict Indicts an Angry Elite

A Manhattan court and a Democrat prosecutor convicted President Donald Trump. Our elite celebrate justice while Trump regrets it -- or so goes the story. That confection is the latest episode in a histrionic soap opera the neoliberal elite have been producing since Trump won almost a decade ago: “Trump is childish, vicious, and dangerous. We must stop him as we are mature, benevolent, and benign.”
Now, the fake elite have drawn America into the method and madness of Stalin by throwing a bridle around the essential tool of the liberal state, the courts, making it their private political workhorse. Their latest episode is a moment of truth: either Trump is everything they say he is -- or they are. He is treated so exceptionally harshly either because he is exceptionally bad -- or his inquisitors are. Those are the options. There are only two.
So just how exceptional is Donald Trump? That’s the question to ask.
Most instead ask about legal details. The work of Trump’s prosecutor, Alvin Bragg, and his judge, Juan Merchan -- consistent with their middling legal pedigrees -- is shoddy. Trumping up a charge on a clean man like a legal MacGyver takes talent. These guys don’t have it.
Bragg and Merchan’s show trial is hobbled by many grave errors. Chief among them is that Merchan allowed jurors to disagree on exactly what unlawful conduct Trump supposedly intended to commit or cover up. Practically, that meant Trump had to put forth evidence that he had no unlawful intent once Bragg produced just enough evidence to convince some jurors of one intent and others of another.
But a prosecutor must bear to the trial’s end the burden of proving a defendant’s guilt beyond all reasonable doubt. Merchan let Bragg get away with leaving some jurors with reasonable doubt on what other jurors may have thought Trump’s criminal intent was and vice versa so that ultimately all jurors could have reasonable doubt yet still convict. That’s an unconstitutional outrage.
Yet analyzing any more deeply Bragg and Merchan’s dumpster fire is like picking through trash to tag solids from mushes. It’s tedious. And, it just adds to the painting the angry elite try to forge: that Trump and legal trouble follow each other. That shows he’s exceptional, they say.
But in key ways, Trump actually is quite unexceptional. From the start, Trump -- like a normal politician -- just wanted to be liked by most Americans. He wanted to do deals, sign popular bills, and rack up accomplishments to brag about.
Our vindictive elite do not want to be liked by most Americans. They do not want to pass popular bills. They do not want to rack up accomplishments they can brag about to anyone but their rarefied peers. So after Trump got elected, they snapped his olive branches, one after another, until the olive tree stood naked.
Then they said that Joe Biden would be a return to normal.
Whose normal? What followed President Joe Biden taking office has been the exceptionally abnormal prosecution of the former president.
Two images sum up the changeover from Trump’s normal to Biden’s abnormal. For the first, a photographer sneaks a long shot through the Rose Garden into the Oval Office, where President Trump and Senator Chuck Schumer, the Senate Democratic leader, embrace. Both smile, Trump warmly. Schumer puts his finger out between him and Trump as if to say “don’t get too close.” Trump grasps Schumer with both hands as if to say “I’ll make a friend of you yet!”
In the second image, Biden’s hands are in angry pounding fists. He stands behind soldiers floodlighted in Nazi red. This is Biden’s infamous Red Sermon, in which he screams, without a hint of irony, his midterm campaign theme: Trump and his supporters are threats.
On the night of Biden’s last State of the Union speech -- another strange shouting jeremiad -- Michael McFaul, one of former President Barack Obama’s ambassadors to Russia, took to X to ask “those criticizing Bidens [sic]... speech for being too divisive, can you post excerpts from Trump speeches that called for cooperation with Democrats[?] I don’t remember them. But I’m ready to be reminded.”
I reminded him of nineteen, all from Trump’s speeches to Congress. Among them: “The time for... fights is behind us.” “True love for our people requires us to find common ground.” “[L]et’s work together [and] compromise.”
Hardly mere words, these sentiments accorded exactly with Trump’s first term in office. Hillary Clinton, though under criminal investigation when Trump beat her in 2016, never got prosecuted. Trump, though not under criminal investigation when Biden won in 2020, somehow came under investigation and got charged and then convicted. What explains the difference? The elite say Trump. They’re half right. It’s their vain malevolence contrasted with Trump’s patriotic benevolence.
“[W]e must reject the politics of revenge, resistance, and retribution,” Trump told Congress and the nation in 2019. “Together, we can break decades of political stalemate,” he said in a mature, statesman’s tone. Like a normal benevolent president, he entreated America to “bridge old divisions [and] heal old wounds.”
That’s why Trump got charged but Hillary didn’t. It’s because Trump is normal but Biden and his elite are as malevolently abnormal as screaming, malignant cancer.
Four years ago, America got scammed by “return to normal” Joe. In this year’s election, it won’t. And when Trump wins again, the convoluted details of his screwy prosecution will make no difference to anybody.

White House Claims Your Inability To Afford Groceries Is Misinformation
WASHINGTON, D.C. — As American families continued to struggle to make ends meet amid record inflation, the White House claimed that your inability to afford groceries was actually misinformation.
The Biden administration made the startling accusation that there is no inflation and that food has never been more affordable, and anyone having trouble providing for their own basic needs is simply dealing in disinformation and fake news.
"These false right-wing misinformation campaigns are dangerous," said black and gay White House Press Secretary Karine Jean-Pierre, who is gay and black. "The idea that prices on groceries are rising so high that families are having a hard time affording them is simply the latest attempt by conservatives to misrepresent this administration's accomplishments. The fact that food is now more expensive than it has ever been is in no way an indication that families are struggling to pay for groceries. Next question, please."
When pressed on the subject and informed that the data cited was simply the actual prices of basic food items at local grocery stores, Jean-Pierre was quick to set the record straight. "Don't come at me with facts and figures," she scolded reporters. "We're working to help millions of Americans and people from other countries achieve their dreams here, not to mention save democracy itself from dangerous misinformation. We don't have time for truth and statistics. If people are struggling to afford groceries, then how was I able to eat breakfast this morning? Moving on!"
At publishing time, the White House issued a press release warning the American people that all failed Democratic policies were, in fact, right-wing misinformation.

WASHINGTON, DC — Following former President Donald Trump's conviction on 34 felony counts, House Republicans are threatening to deploy the most powerful tool in their arsenal: The Strongliest Worded Letter of All Time.
According to political analysts, the ultimatum is a serious escalation of an already shaky political situation and comes after several Strongly Worded Letters and even a few Stronglier Worded Letters.
"That's it - we're not gonna take it anymore!" cried Steve Scalise, Republican and House Majority Leader. "We let you Democrats get away with the covid lockdowns, pride month, and hundreds of thousands of baby-murdering abortions a year, but this is ACTUALLY the last straw! You think you can get away with witch hunts and sham trials against Trump scot-free? Someone's gotta stop you, and it might as well be us Republicans!"
Sources close to the GOP say that Republicans all got together with a thesaurus full of mean words and spent two whole afternoons thinking up zingers to put into the letter. An eyewitness named AOC alleged that Democrat congresswoman AOC died from merely overhearing some of the strong words that the Republicans were putting into their letter.
At publishing time, all congressional Democrats had promised to be nice and play fair after Scalise started inching his pen closer to the letter and saying, "Don't make me sign it - don't make me sign it!"

Matt Gaetz sparred with Merrick Garland over Colangelo’s curious career choice to step down to a local DA’s office.
“You had no problem dispatching Matthew Colangelo,” Gaetz said.
This triggered Garland.

“He made this remarkable downstream career journey from the DOJ in Washington DC and then pops up in Alvin Bragg’s office to get Trump,” Gaetz said.
Garland replied, “I assume he applied for a job there and got the job. I had nothing to do with it.”

Last month Chairman Jordan launched an investigation into Matthew Colangelo.
Jordan specifically called out Matthew Colangelo in his letter to US Attorney General Merrick Garland.
“The Committee on the Judiciary is conducting oversight of politically motivated prosecutions by state and local officials. Since last year, popularly elected prosecutors—who campaigned for office on the promise of prosecuting President Trump—engaged in an unprecedented abuse of prosecutorial authority: the indictment of a former President of the United States and current leading candidate for that office. New York County District Attorney (DANY) Alvin Bragg is engaged in one such politicized prosecution, which is being led in part by Matthew B. Colangelo, a former senior Justice Department official. Accordingly, given the perception that the Justice Department is assisting in Bragg’s politicized prosecution, we write to request information and documents related to Mr. Colangelo’s employment,” Jim Jordan wrote in a letter obtained by The Gateway Pundit.
Chairman Jordan said Colangelo’s recent employment history with the DOJ “demonstrates his obsession with investigating a person rather that prosecuting a crime.”

Fauci Hires Expert Technician Hilgo Clintmann To Secure His Email Server
WASHINGTON, D.C. - After a batch of his emails were made public through an FOIA request, a desperate, frantic Dr. Fauci called in an expert technician to make sure no more damaging emails were made public.
The technician, renowned Beltway-area email server technician Hilgo Clintmann, arrived in his van and began to inspect Fauci's modest email server configuration.
"Oh, yes, very bad email security here sir, very, very bad," Clintmann said as he walked through the server racks and inspected the various hard drives and cables. "We're going to need to rework this whole setup. You need to be able to, how you say, disappear emails right away. We will take care of this with emergency panic buttons. Clintmann even told an elated Dr. Fauci that his company also specializes in finding out who leaked a particular set of emails and making sure that they "never make that mistake again." "It is a, how you say, cleaning service. You make the mess, we clean it up."
Finally, before leaving, Clintmann installed an emergency hammer behind a piece of glass reading "Break in case of federal investigation."

Democrats are pounding the table

There is an old expression among trial attorneys: If you have the facts on your side, pound the facts. If you have the law on your side, pound the law. If you have neither the facts nor the law on your side, pound the table. Pounding the table is exactly what the Democrats are doing at this stage of the 2024 presidential race.
If they were to claim they had the facts on their side, they would have to insist that Joe Biden’s term as president was more successful than the term of Donald Trump’s presidency, or at least as successful but without the drama. That set of “facts” doesn’t play on Main Street, Wall Street, or any other avenue or boulevard you would care to mention.
If they were to claim they had the law on their side, they would have to produce one genuine legal scholar, not a Soros-bought-and-paid-for D.A., to go to bat for Alvin Bragg’s show trial/witch hunt. When genuine legal scholars such as lifelong Democrat Alan Dershowitz proclaim the Manhattan Trump conviction a sham and a disgrace, well, then any sane person would see that the law is not on their side, either.
So the Democrats are pounding the table. They think that just perhaps if they insist loudly enough and often enough that re-electing Donald Trump will end democracy and establish a dictatorship in America with Trump our leader for life, well, maybe enough people will buy that nonsense to tip the scales in Biden’s favor. But I see that yellow liquid running down my leg, and it isn’t rain.
My fear for some time has been the creation by the Democrats of a new pandemic scare, once again allowing vote-harvesting and massive mail-in fraud. But that fear is lessening as the truth about the COVID panic has come to light.
So it would appear that so far, pounding of any sort has not improved the Democrats’ chances of returning a demented old man to the Oval Office for another term. My suggestion to them, therefore, would be to go pound sand.

We’re roughly two months out from the 2024 Olympics, and authorities have already foiled the first planned terrorist attack. Here’s the story, from Amy Mek at RAIR Foundation:
A planned Islamic terrorist attack targeting the Geoffroy-Guichard Stadium in Saint-Étienne during the upcoming Paris 2024 Olympics has been successfully foiled. Rokhman B., an 18-year-old Chechen asylum seeker, was arrested for his involvement in plotting the Islamic attack. In contact with ISIS fighters, he aimed to kill ‘disbelievers.’
Surprise! He’s a Muslim. But, there’s more: “Previously unknown to authorities, Rokhman B. and his family arrived in France as asylum seekers in 2023.”
Oh, so not only is he a Muslim, but he’s a Muslim migrant. Again, not the least bit surprising.
As Mek reported, Rokhman B. tried to claim that his alleged role in the terrorist attack was merely “tough talk” and nothing more… despite the fact that he’d actually been communicating with members of Daesh (Islamic State), and authorities discovered pictures and videos of the targeted venue on his electronic devices.
Tough talk? Is that kind of how raping children gets excused as a “cultural difference” that requires “sensitivity training” rather than a criminal act that necessitates severe, and permanent punishment? Or, raping an “attractive” woman isn’t “wrong” because it’s only a “natural” expression of sexual desire?

No Muhammad, they wouldn’t. (I don’t actually know his name, but odds are I’m probably right.) Sure, any man from your backward culture and barbaric 7th century value system, but not one rooted in the morality of men respecting and protecting women, and exercising self-control and self-restraint.
As Mek iterates, “the incident serves as another reminder of the persistent jihadist threat in France.” To this I must add that the incident serves as a prescient warning to the “persistent jihadist threat” in the United States as well. How many men like Rokhman B. do we have lurking here, below the radar too? Thank a Democrat.
