fast, from what I know about this,,,
the owners or principal operators of ANY company, public or private, have certain fiduciary responsibilities to the company and employees.
for instance, if the company operator, or the person charged with these responsibilities fails to pay the employees, he can be charged. If he uses the mail to commit fraudulent money charges such as on invoices to customers, he is responsible.
failure to act in the best interests of the company, for instance.
more can be done than just to have a shareholders meeting and/or doing nothing.
Being a COO or CEO or president, etc., does not allow them to break the law. In my opinion, there is something inherently wrong when a guy writes a pipe agreement, puts money into it, then BAM! Guess who is running the company. the same guy! didn't take long either.
just some thoughts.

I can see not taking legal actions for quite a few reasons if you are in a stock of a company whose stock dove significantly due a bad economy for example. Or maybe if a newer better product from competitors came out and the company was struggling.
but that isn't the case here. This company has bankrupted itself due to mis-management, inaction, and lack of responsibility. I think this could be proven.
problem is, you can't get your money back even if you do. At least you could legally haunt Swift for the rest of his life.

what I have in xechem is a but a few hundred dollars. This is money I am willing to lose whithout even the slightest worry. But if I had a lot of money in it, I gaurantee I could have answered your question.

Swift has killed xechem, on purpose,,,
in my opinion. I think Swift took xechem to penny land because he knows he can hide his activities. He doesn't have to account for the outstanding shares, doesn't have to file the same way as BB or NASDAQ stocks, and he certainly doesn't have to keep the shareholders informed.
question is, why? What is his plan? and why did he secure finances for certain obligations?
in my opinion, he is acting in a felonious manner. And to make it worse, I still haven't read anything here from the shareholders with tens of thousands of dollars invested about ANY kind of legal actions filed.
I only have a few hundred dollars in this stock, so I have no reason to hire a lawyer to protect my "petty cash" as it would cost more than my "investment" just to put down a retainer.
But when I read how Bigdaddy and others have hundreds of thousands of dollars in this, I am at a loss as to the inaction of these real investors. If I had more than ten thousand invested( at one time I had more than sixty thousand in this stock ) I would be extremely active in bringing this Swift guy to be accountable for his actions. I believe as COO he has certain fiduciary duties to both the company AND shareholders.
Well, I have said my piece for now, so good luck to those that supposedly buy more everyday day, like some here claim to be doing.
which begs the question, who and why would anybody continue to put thousands more evrey week in this? I can't help but think it is pure BS on their part. I certainly wouldn't do that!

great DD. and yes, kind of blase around here. I guess posters have about given up on Swift and xechem. It seems that even if good news IS found, many here have come to the conclusion that Swift couldn't make anything out of it anyways.
sad, really sad that Swift has sucked all our energies away. It has been such a long time since RP was at the helm and such a long time since we looked forward to press releases.
heck, two years ago, we couldn't post enough about what we thought would come out in the next pr and when. Now I have this ever present sensation that IF news comes out, it is most likely to be bad news rather than good news.

In fact, I would hire a private investigator like I did a couple of years ago when I found out DB was using Chassman to manipulate this and other companies.
It turned out there was nothing I could do legally, the guy may be crooked, but he is a smart crook.
somehow, I don't get the feeling RS is anywhere near as smart as DB.

I second that FIAT, this IS the gang that couldn't shoot straight.
The pipe will convert soon and then, as usual, the shareholders will pay for it. Then either we shut down, de-registered, and move to Nigeria, or we end up with another huge reverse split.
swift hasn't done anything to give any of us confidence in what he will do next.

lots of bad things COULD come out of it. I don't look through rose colored glasses only. I am a stock trader, I keep it real, as it is my money. I am NOT a long. I don't love this company and most importantly, I stay objective on this stock now. in other words, they would have to try REAL hard to gain any trust from me again. I hope for the best, and prepare for the worst.
