If that "scathing" lawsuit makes it in front of a jury, expect those jurors to hear how the FDA intends to take possession of an individuals cells and enforce regulations on them. Even if it's just jury nullification, expect them to rule against the DOJ and the FDA, just as they did in Howard Root's case (www.howardroot.com).

Details on Tarek El Moussa's Back Procedure
We now know that {Fat Stem Cells are} not just spare tissue but rather a vigorous tissue capable of regenerating.
Flip or Flop host Tarek El Moussa has undergone a controversial stem cell procedure using liposuction to fix a “very scary back injury.”
The HGTV host and real estate investor recently broke the news on Instagram — along with pretty graphic photos — writing, “Well folks!!!!! As you know I’m desperate to fix my back so…..I did STEM CELL surgery today!! It’s CRAZY!!!”
El Moussa also Instagrammed revealing photos of his back postsurgery, writing: “The aftermath is….well not so bad?. Here it is I’m a “little sore” but wow…my back is actually feeling better!!! I’m so hopeful that in a few weeks I will have a major improvement…I’ve always been told “pain is weakness leaving the body”..at this point I think I’m out of weakness….what do you think folks…not so bad??”
Stem cells are a group of cells with the power to morph into various specialized cells that, according to the National Institutes of Health, “serve as a sort of internal repair system” replenishing other cells that serve vital organs.
Stem cells are typically extracted from bone marrow or neural or fetal tissue to treat a variety of medical conditions, and the latter method, which often uses cells from abortions, has sparked a debate between anti-abortion and pro-abortion-rights camps.
However, using stem cells from fat to treat pain is novel. “Fat is an excellent place to source stem cells,” Brent Concolino, president of the Rock Institute in Newport Beach, Calif., which performed the surgery on El Moussa, tells Yahoo Lifestyle. “The cells from fat are healthy, plentiful, highly anti-inflammatory, and nearly painless to extract. Specifically, we extract stromal vascular fraction (SVF) from the tissue surrounding fat, which contains four types of stem cells.”
Marc Hedrick, MD, a pediatric plastic surgeon at the University of California, Los Angeles, also told ABC News in April, “Fat is not the tissue we once thought. For too long it was seen as something to be removed and tossed away. We weren’t seeing its potential. We now know that it’s not just spare tissue but rather a vigorous tissue capable of regenerating.”
In patients like El Moussa who have degenerative back conditions, SVF is being studied to reduce spasms and inflammation, and accelerate healing, says Concolino.
The process, which takes from two to three hours, is similar to liposuction except patients are put under local anesthesia and doctors remove less than two ounces of fat to obtain the SVF. However, the price tag is comparable — the procedure can range between $6,000 and $10,000. “We store the patient’s fat, usually from his abdomen, with a special sterile harvesting technology and the fast extraction itself takes about 20 minutes,” says Concolino. After the stem cells are deposited back into the patient, they start repairing tissue and forming new blood vessels on cartilage and bone.

President Trump signs 'Right to Try' bill into law
This bill will "save a tremendous number of lives"
President Trump on Wednesday signed into law a bill that would allow those with deadly diseases to try experimental treatments and bypass the U.S. Food and Drug Administration.
The so-called Right to Try Act of 2017, sponsored by Sen. Ron Johnson, R-Wis., unanimously passed the Senate last August, and cleared the House last week on a party-line vote of 250-169 -- in a win for both Johnson and the Trump administration.
"Today I am proud to keep another promise to the American people as I sign the right to try legislation into law," Trump said Wednesday. "I called on congress to pass Right to Try—such a great name—some bills they don’t have a great name—this one...And a lot of that trying is going to be successful. I really believe that. We did it."
He added: "We're going to be saving tremendous numbers of lives."
"This is very personal for me. As I proudly sign this bill, thousands of terminally ill Americans will have the help, the hope, and the fighting chance-- and I think it’s going to be better than chance--that they will be cured, that they will be helped, that they will be able to be with their families for a long time, or maybe just for a longer time,” Trump said. “But we’re able to give them the absolute best we have at this current moment, at this current second. We’re going to help a lot of people. It’s an honor to be signing this.”
The Right to Try Act allows terminally ill people access to experimental treatments that have not been approved by the FDA. The therapies developed by USRM will thus be made available to these needy patients, despite any pending litigation from the FDA/DOJ.
Here's an example - Anyone with end-stage heart disease would qualify for the experimental Myocell heart treatment developed by USRM.
Even if the treatments aren't administered directly by USRM or any of its affiliated clinics, this is still a massive plus. Any stem cell clinic that has physicians trained by USRM and uses the kits they manufacture will be able to treat these terminally ill patients.
If any percentage of those patients show an improvement in their condition, it will prove the efficacy of USRM's therapies and it will go a long way in refuting the assertion from the 'speculative press' that their treatments don't work.
The potential pool of 'clinical trial' subjects just exploded in number. Thousands, if not TENS of thousands of desperately ill people now have hope that they didn't before, and USRM's therapies will be theirs to use if they so choose.
Also, the results of the therapies administered to these potential patients will be concrete and measurable. Once all such evidence is collected and published, USRM's years of development and research will finally be judged for ill or for good.

The success rate of USRM's treatments and practices both in the United States and in multiple clinics around the world refute any bogus claim that their treatments are risky or have 'no known or proven scientific efficacy.' Someone should ask John Salley about that. You know, the former NBA star who played for the Detroit Pistons, Miami Heat, Toronto Raptors, Chicago Bulls, and Los Angeles Lakers. I'm sure his first-hand knowledge of the efficacy of stem cell therapy, as applied to his own body, will be far more useful that of an uninformed author's opinion, regardless of which journal chooses to publish said opinion.
More clinics open every month which will be delivering the treatments and therapies pioneered and delivered by USRM. Continuing expansion and an unhindered delivery of treatments to a willing populace indicate that the FDA's opinion of USRM's products is completely misguided.

Again, provide proof that she was arrested and convicted of theft as you have repeatedly alleged. Show me the relevant court documents, please...

Meanwhile, I'm more apt to trust the word of the person who developed products that have successfully treated over SIX THOUSAND people and have only documented adverse outcomes for four people.
And those therapies were developed by Dr. Comella PRIOR to her attaining a PhD of any type. USRM's success rate speaks much better than the speculative rantings of a reporter with dubious credentials.
Furthermore, a Pulitzer is given out with the same frequency that prescriptions are for FDA-approved opioids. It's no different than the standards now applied to the awarding of the Nobel Peace prize. In essence, a Pulitzer is utterly worthless.

FDA/DOJ's Prosecutorial Misconduct Unmasked in Recent Publication
An interesting look at the zealotry inherent in any FDA/DOJ prosecution of a business in the medical industry:
On February 26, 2016, a jury in West Texas acquitted Minnesota-based medical device company Vascular Solutions, Inc., and its CEO, Howard Root (http://www.howardroot.com/), in a federal criminal case involving alleged FDA crimes. The indictment in the case charged Vascular Solutions and Mr. Root with misbranding and conspiracy based on allegations that Vascular Solutions marketed its Vari-Lase® device for off-label use and sought to conceal that activity from the FDA. The jury wholly rejected the government’s case and delivered a stunning defeat to the FDA and the Department of Justice (DOJ) by acquitting Vascular Solutions and Mr. Root on all counts.
This case is notable not only for its outcome, but also because it involved two of the hottest topics in criminal enforcement in the health care industry: the legality of off-label promotion, and DOJ’s new focus on bringing criminal charges against health care industry executives. The jury’s verdict was a significant setback for the government on both fronts.
Mr. Root was recently quoted as saying that one of his lawyers had been informed that the DOJ was more interested in creating a convict than finding the truth and that they were "out to get a scalp." With such zealotry on open display by the Feds, it's no wonder that they're doing this full-court press on USRM.
I'd love to see a jury get USRM's case. How would the jurors react to being told that their own stem cells no longer belong to them and that the FDA has primary jurisdiction over the contents of their own bodies?

So what? That therapy will still be used to treat those patients, regardless of any so-called patent 'issues'.
The efficacy of the therapy can easily be proven or disproven with this pool of patients. If it is indeed shown to be effective, then USRM will have a massive sledgehammer to use against the FDA and others who claim that the treatments don't work.

The FDA's lawsuit is an attempt to prevent USRM from providing their therapy to patients because the FDA hasn't yet approved those therapies. Their supposition is that a patient's own stem cells can and should be regulated by the FDA. That assertion is laughable, and the pending litigation will sort that out.
Meanwhile, the Right to Try Law has just shot a big old hole in the middle of that lawsuit. Terminally ill patients CANNOT be denied experimental therapies, regardless of whatever legal chicanery is employed by the FDA/DOJ.

Here's an example - Anyone with end-stage heart disease would qualify for the experimental Myocell heart treatment developed by USRM.
Even if the treatments aren't administered directly by USRM or any of its affiliated clinics, this is still a massive plus. Any stem cell clinic that has physicians trained by USRM and uses the kits they manufacture will be able to treat these terminally ill patients.
If any percentage of those patients show an improvement in their condition, it will prove the efficacy of USRM's therapies and it will go a long way in refuting the assertion from the 'speculative press' that their treatments don't work.
The potential pool of 'clinical trial' subjects just exploded in number. Thousands, if not TENS of thousands of desperately ill people now have hope that they didn't before, and USRM's therapies will be theirs to use if they so choose.
Also, the results of the therapies administered to these potential patients will be concrete and measurable. Once all such evidence is collected and published, USRM's years of development and research will finally be judged for ill or for good.

President Trump signs 'Right to Try' bill into law
This bill will "save a tremendous number of lives"
President Trump on Wednesday signed into law a bill that would allow those with deadly diseases to try experimental treatments and bypass the U.S. Food and Drug Administration.
The so-called Right to Try Act of 2017, sponsored by Sen. Ron Johnson, R-Wis., unanimously passed the Senate last August, and cleared the House last week on a party-line vote of 250-169 -- in a win for both Johnson and the Trump administration.
"Today I am proud to keep another promise to the American people as I sign the right to try legislation into law," Trump said Wednesday. "I called on congress to pass Right to Try—such a great name—some bills they don’t have a great name—this one...And a lot of that trying is going to be successful. I really believe that. We did it."
He added: "We're going to be saving tremendous numbers of lives."
"This is very personal for me. As I proudly sign this bill, thousands of terminally ill Americans will have the help, the hope, and the fighting chance-- and I think it’s going to be better than chance--that they will be cured, that they will be helped, that they will be able to be with their families for a long time, or maybe just for a longer time,” Trump said. “But we’re able to give them the absolute best we have at this current moment, at this current second. We’re going to help a lot of people. It’s an honor to be signing this.”

U.S. Stem Cell Reports First Quarter Results
U.S. Stem Cell, Inc. (OTC: USRM), a leader in the development of proprietary, physician-based stem cell therapies and novel regenerative medicine solutions, announced first quarter results for 2018.
Revenue increased 48%, to $1.7m from $1.15m for the first quarter of 2017. Gross profit increased more than 52%, to $1.2m from $793k for the same period last year. Profit margin and net cash flow from operations also increased, from 55% to 71%, and $268k to $688k, respectively.
Working capital deficit is down 11%, from $5.4m at year end 2017 to $4.8m at the end of the first quarter of this year.
For two consecutive years, USRM has sustained substantial revenue growth, which may be attributable to an increased awareness of stem cell therapy, as Americans seek alternatives to pain management and opioids.

If USRM was being charged with speeding, you may have a point. Obviously, however, you missed the mark.
USRM's being singled out for the kits they manufactured. Kits which are in the hands of a LOT of clinics spread throughout the US and the world, not just ones affiliated with USRM through partial ownership, whatever. If these kits are as dangerous to consumers as the FDA alleges, then it's their duty to seize all kits and force all clinics using those kits and/or processes to cease operation immediately. Otherwise the FDA's "concern" rings hollow.
"Oh, those meanies at USRM made these dangerous kits, so we want to prosecute them!"
"What about the kits currently being used in clincs? Why aren't you doing anything about that?"
"Umm... Umm..."

So the DOJ and FDA have closed all clinics using USRM's kits and/or processes, right? Umm... Umm...
Selective prosecution of a subset of a group or population area is a violation of the equal protection clause of the 14th amendment. The judge in the case should either force the DOJ/FDA to close all stem cell clinics, or ask why these two bureaucracies are pushing their weight around on such a small subset of the industry.
As I mentioned in a previous post, the Dallas clinic is still open and serving customers today. Ditto for the clinic in the Villages in Florida. Both of these example sites use USRM's kits and are staffed by doctors trained to use USRM's therapeutic regimens.
Going to be a fun trial as the lawyers pick this apart!

You forgot to include the additional motion to dismiss from two more parties named in the amended complaint by the Plaintiff. Given the increasing chance of dismissal, of course her lawyer is going to flail about to find someone else on which they can try to pin this failed lawsuit.
To underscore: The amended suit now involves a company at the periphery of the original complaint, hinting at the possibility that the lawyer DOES NOT EXPECT to achieve victory against the originally-named defendants.
If the dismissal is granted by the judge, this will be another WELL DONE nothingburger.

If the FDA is going after USRM because of the kits they sell and the stem cell therapies that they developed over the past 19 years, then why is the Dallas clinic still open and still serving customers today? If the services provided at that clinic are 'unproven' and/or 'unsafe' as the FDA alleges, why are they allowing this clinic to remain open? Surely they have to do something to protect the customers from the so-called 'dangers' of this clinic...

Funny that your article would quote Leigh Turner, "PhD". His "PhD" is in Religious studies and has NOTHING... NADA... ZILCH... to do with medicine. If you ask me, his 'informed opinions' are merely the speculation of an outsider who has had no documented medical training or formal medical education whatsoever.
The fact that the University of Minnesota would make him part of their Pharmacy faculty is laughable. I suppose they'll next hire someone with a Masters in MassComm to oversee the effectiveness of angioplasty devices...

You didn't, someone else did. My article was posted to rebut any implication that there is no revenue stream for USRM. The fact that the USRM press release was dated in September 2017 is irrelevant given that the clinic is still open, and is still serving customers using USRM's processes and kits in spite of the FDA's feckless complaints.

Quoting from a rather old Time Magazine article:
The FDA says that an inspection of U.S. Stem Cell Clinic revealed that the clinic was using stem cells to treat diseases like Parkinson's, amyotrophic lateral sclerosis (ALS), chronic obstructive pulmonary disease (COPD), heart disease and pulmonary fibrosis. According to the FDA, there are currently only a limited number of stem cell therapies approved by the agency—including ones involving bone marrow, for bone marrow transplants in cancer care, and cord blood for specific blood-related disorders. There are no approved stem cell treatments for other diseases.
Note that in the article the FDA has never asserted that USRM's products do not work or USSC's treatment delivery is not effective. The only complaint that the FDA apparently has is that USRM is delivering therapies that the FDA has not yet "officially sanctioned."
As is the case with many drugs and therapies that are developed primarily overseas or even in the US, just because the FDA hasn't given its stamp of approval doesn't mean that the treatments do not work.
Furthermore, don't forget that many times the FDA approves things which prove to be detrimental to consumers' health. Take the current opioid crisis, for example. 100% of the highly-addictive drugs at the heart of that epidemic had been heartily approved by the FDA.
The FDA's so-called "concern" over USRM's methodology, in the wake of thousands of successful procedures performed on a multitude of satisfied customers, rings hollow.

John Salley is biased because he had a successful procedure performed on him? Does that mean that anyone who has had any kind of surgical procedure is subsequently banned from talking about it out of a fear of 'bias?'
Go ahead and talk to Mr. Salley and let him know he's useless as a source due to his 'bias'. Let me know how that goes.

USRM's Official Response to FDA's Misguided Attempt to Squelch Stem Cell Therapies
Dr. Comella Describes Stem Cell Therapy vs Off-the-shelf therapies in latest response to modified FDA guidelines
[The FDA's] new framework also includes more regulatory guidance for off-the-shelf products that, due to their construct, require more complex, lengthy and expensive entries to market. This is partially because they can involve using third-party stem cells that have been modified, including genetically, which can require more intense scrutiny by the FDA. USRM believes that its in-clinic stem cell procedures should not be subject to the same regulatory process as off-the-shelf drug products.
Likewise, due to the high ramp-up costs with an off-the-shelf gene or cell therapy product, patients can be up against prices of $475,000 per treatment. USRMs proprietary in-clinic protocols using the patients own tissues/cells are not off-the-shelf gene or cell therapies and can be safely performed in-clinic instead of a hospital, by physicians that are USRM-trained and certified in autologous stem cell therapy practices — procedures that have been and continue to be well documented in the scientific literature with very few complications reported. The costs to patients typically range from $5000-$12,000.
