If there indeed was a serious deal, one should wonder why they walked away. Better opportunities we don't know of? If there are indeed better deals out there for XXII, they should simply pay the 250M to crede, and move on alone, more profitable in the future.
But regardless, I think the lawsuit won't hurt XXII. Where's the proof they intentionally sabotaged the deal? Management has always publicly stated that they keep searching till they reach a deal they think is most profitable for the shareholders... it's a yes/no game.

Is it normal to find nothing on the FDA webpage regarding 22nd century application? I know some/most files are not yet ready to make public, but there's not even a brief mentioning of XXII MRTP?!
No need to react like this. It's quite normal I say this. On this board several members were "pumping", as if it was a big thing that FDA met with them within two weeks, whilst they are in fact obliged by law to do so.
Just trying to be objective and realistic here :)

They do not seem to be referring to anything timeframe-related. They seem to refer to something regarding the substance of their application. Since they were always so positive that the FDA should approve their application, they seem to imply that the FDA is (very) positive and therefore the application should indeed be approved, which is premature imho.

Don't know about the European regulation. Lately I see posters of Marlboro, stating "no additives added"; which I find quite misleading... don't understand why they don't ban these slogans.
Spain is a big zero, and I have the feeling Henry isn't honest about it.
Management is doing a terrible job imo. For Spain, they said the shopkeepers told them taste was not good, now we are again waiting almost a year for Europe. By the way, why not investigate European market before launching, they had years of time. And what in the US? They don't talk to these shopkeepers for feedback? They don't inform shopkeepers about the "specifics" of red sun?
I would like to see some numbers on the re-ordering of red sun by shops already selling red sun. To me it seems the revenues are mainly increasing by adding new shops rather then shops re-ordering...
