On June 20, 2014, Sunlight Supply, Inc. (“Sunlight”) and IP Holdings, LLC (collectively, “Complainants”) filed a complaint requesting that the ITC commence an investigation pursuant to Section 337.
The complaint alleges that the following entities (collectively, the “Proposed Respondents”) unlawfully import and/or sell in the U.S. certain light reflectors and components, packaging, and related advertising that infringe one or more claims of U.S. Patent Nos. 7,641,367 (“the ‘367 patent”); D634,469; D644,185 and D545,485:

Complainants also allege that the federally registered trademarks XXXL and ECONO WING REFLECTOR are infringed, and that the Proposed Respondents are taking part in unfair methods of competition, such as false advertising.
According to the complaint, the asserted patents and trademarks generally relate to light reflectors used in indoor and greenhouse gardening, referred to as grow lamps, grow lights, or horticulture light fixtures.
Complainants assert that the Proposed Respondents import and sell products that infringe the asserted patents and trademarks. Complainants specifically refer to eight accused products, including several air-cooled reflectors, a non-air-cooled reflector, and an econo-wing reflector allegedly made and sold by Sinowell (Shanghai) Co. Ltd. (“Sinowell”) to the other Proposed Respondents. Complainants also assert that Sinowell uses false advertising, the threat or effect of which “is to destroy or substantially injure an industry in the United States and/or to prevent the establishment of such an industry.”
Regarding domestic industry, Complainants state that Sunlight manufactures, inspects, packages, and distributes the majority of reflectors that exploit the patents and trademarks at issue. Investments in plants devoted to these tasks (including both labor and capital) are alleged to meet the economic prong of the domestic industry requirement. The technical prong is asserted to be met through at least two of Sunlight’s specific products alleged to practice at least a subset of claims of the ‘357 patent through the use of claim charts. Additional products are alleged to use the goodwill associated with the asserted trademarks.
As to related litigation, Complainants state that on March 19, 2014, they filed suit against Universal Garden Supply & Manufacturing, Inc. in the U.S. District Court for the Western District of Washington for patent, trademark and trade dress infringement, and unfair competition.
With respect to potential remedy, Complainants request that the Commission issue a general exclusion order and permanent cease and desist orders directed at Proposed Respondents in relation to the accused products.
Yes, Zimbali did infringe the patent of another company. Zimbali and five other companies have been named in the dispute. The patent owner company is a big Canadian company. I lost the link to the claim. It was once posted here on this board.

All this is not for free. We all know this.
Do you know the sales numbers of the Zimbali business ? No you don't and neither do I but I know that we have sales. That was confirmed to me.
Patent update must be close. Could be nothing but could also be millions.
I think the current management did a good job so far. Patent business needs time and lawyers costs a lot of money. Not betting on one horse only is a wise decision. I'm happy with the Zimbali business. Tell me a business that will have a better growth over the next 5 years. There are not many.
Today you buy 1 millon shares for just $1500.-- . In two years it might be ZERO or $200'000.-- . That is a very favorable risk/reward ratio.

Well possible that he is going to raise the AS. Currently it is at 800 million and 568 million is already OS. Could end up at 1.2 - 1.5 billion. Also possible is that the patent will solve this or the business is enough to pay the current bills. In that case we might stay below the billion. We will see. There is not much downside left. The next big move is on the upside.

I bought another 400'000 today. Debt free is good.
Not exactly right. Debt can always put you under pressure. Debt can be called. "Never drill on debt" is an old saying but a true saying.
Now that we have (finally) solved this issue we move on to the patent and the weed. Days like today are good days to buy. I don't jump on the train when it has left the station. Just wait and see. This one moves fast (both directions) and I expect the next move to be an UP MOVE.
Debt free is good news. Took very long but finally it's done.
Soon the Q2 report is out. Did not think to see it at 0.0020 again. Maybe the last time ? Bought another 400'000 shares.

I have to accept "soon" and "around the corner" and "any day from now" . More important to me is to have a line and get confirmation from time to time that things are going very well and that progress is made. I'm happy to get a least this and honestly I always feel very good after the call.
In my opinion it is worth to be patient.

The New York Times Calls for Marijuana Legalization
Repeal Prohibition, Again

It took 13 years for the United States to come to its senses and end Prohibition, 13 years in which people kept drinking, otherwise law-abiding citizens became criminals and crime syndicates arose and flourished. It has been more than 40 years since Congress passed the current ban on marijuana, inflicting great harm on society just to prohibit a substance far less dangerous than alcohol.
The federal government should repeal the ban on marijuana.
We reached that conclusion after a great deal of discussion among the members of The Times’s Editorial Board, inspired by a rapidly growing movement among the states to reform marijuana laws.
There are no perfect answers to people’s legitimate concerns about marijuana use. But neither are there such answers about tobacco or alcohol, and we believe that on every level — health effects, the impact on society and law-and-order issues — the balance falls squarely on the side of national legalization. That will put decisions on whether to allow recreational or medicinal production and use where it belongs — at the state level.
We considered whether it would be best for Washington to hold back while the states continued experimenting with legalizing medicinal uses of marijuana, reducing penalties, or even simply legalizing all use. Nearly three-quarters of the states have done one of these.
But that would leave their citizens vulnerable to the whims of whoever happens to be in the White House and chooses to enforce or not enforce the federal law.
The social costs of the marijuana laws are vast. There were 658,000 arrests for marijuana possession in 2012, according to F.B.I. figures, compared with 256,000 for cocaine, heroin and their derivatives. Even worse, the result is racist, falling disproportionately on young black men, ruining their lives and creating new generations of career criminals.
There is honest debate among scientists about the health effects of marijuana, but we believe that the evidence is overwhelming that addiction and dependence are relatively minor problems, especially compared with alcohol and tobacco. Moderate use of marijuana does not appear to pose a risk for otherwise healthy adults. Claims that marijuana is a gateway to more dangerous drugs are as fanciful as the “Reefer Madness” images of murder, rape and suicide.
There are legitimate concerns about marijuana on the development of adolescent brains. For that reason, we advocate the prohibition of sales to people under 21.
Creating systems for regulating manufacture, sale and marketing will be complex. But those problems are solvable, and would have long been dealt with had we as a nation not clung to the decision to make marijuana production and use a federal crime.
In coming days, we will publish articles by members of the Editorial Board and supplementary material that will examine these questions. We invite readers to offer their ideas, and we will report back on their responses, pro and con.
We recognize that this Congress is as unlikely to take action on marijuana as it has been on other big issues. But it is long past time to repeal this version of Prohibition.

Alcohol is far more dangerous than marijuana. More lives are harmed because people become addicted to alcohol because it is legal, instead of using a less addictive drug, marijuana, because it is illegal. The war on drugs has created billionaire drug lords that are more powerful than law enforcement agencies. People can't get jobs and become tax payers because they have a record of arrest for having used marijuana. When will we be able to respect Congress for doing what is right and sane?

Marijuana is currently legal in my state. I am proud that the voters in Washington had the opportunity to make this choice. I am a sixty year old man who has raised 6 kids. I don't use marijuana and only 1 of my children does. It is long past time to repeal this version of Prohibition. You should not buy on strong days. You should use weak days to accumulate. Once it moves up it moves up very very fast.

While FRTD was suspended I did email a lot with Parilla. I got 4 emails from him. Since the shares are not suspended anymore I didn't get any more answers to my emails. Tried it several times but he is not responding. Don't know why. My emails are written friendly and the questions I'm asking are quite simple, e.g. what about the VaporVites ? The initial 5000 VaporVites should have been delivered in the first week of June and another lot of 10000 VaporVites by mid-June. The two deliveries are worth $1'200'000.00 . What about this ? True or a lie ?
Honestly I don't know what to think about him. Soon after FRTD shares got suspended he said that he immediately delivered the documents the SEC was asking and that the same day the SEC got everything they did ask for. True or a lie ?
He said many things that we can't prove and he didn't prove either. Why is he not talking about the VaporVites anymore ? That was the most important business for the company. The cash cow. What happened ? What ? Where is he ? Why is he silent ?

As promised the information I got.
I was asking about the sales of Zimbali, the patent and a press release.
1. Zimbali has sales. The sales are not very significant but they think that there is a lot of potential. I did ask what "not very significant" means but didn't get a number. I was told that in the upcoming Q2 report I'll find out.
2. Patent discussions are very active and interesting.
3. Press release as soon as there is something material. Most probably patent related news.
I did mention that the share price is frustrating. The answer was that the drop from 0.01 to 0.002 is not because anything inside the company went wrong. They didn't stop any project or had to deal with setbacks.
OK, that is it. Don't know exactly what to say. I'm not very much surprised about Zimbali. The sales can't be huge because we got that business for 100 million shares only. Good is that it is revenue generating and the potential is there to increase the sales.
I'm surprised about the good comments regarding the patent. Maybe this is worth more than we thought ? Don't forget we are trading at such a low level (company valuation of just about $2 million) that any good news about a license agreement and royalties would make TCPS jump big time.
I'm looking forward to the Q2. We'll see a change in liquidity (due to the financing), maybe debt reduction, and of course the sales of the Zimbali products.
