I agree with you. I think she will schedule a trial. But that is completely separate from any dispositive motions. A trial could be scheduled, and all or part of a case can be subsequently dismissed. Not saying that is the case here. It's just one of MANY possibilities. All we can do is sit and wait. I feel very confident with SG representing WDDD though. I work at a national plaintiffs firm, and SG is well respected in the community. But at the end of the day, our fate rests with the Judge and no one knows what she will do.
That's great. But that is a hearing. Not a ruling. So we have a hearing on the MSJ in November. Then we have the holidays. When do you think the judge will rule? If we are lucky, maybe February - March 2016? Does Activision have any motivation to settle at what WDDD could or would demand? Not really. Especially with SG at the helm. They are not going to settle on the cheap.
Again, this is based off my experience as a litigator. It could take a few months for a ruling. Especially with Holidays and transition into the New Year. I'm not saying this to be negative. It's the facts. Of course there could be a surprise settlement in the meantime or the judge could take the hearing off calendar and make a ruling on the papers. But these are all big maybes. Id love your or anyone else's thoughts on this.
I'm a long SH just like you. So I don't want the judge to sit on this. But that's just what happens. Expecting a fast ruling isn't realistic. Hopefully I'm proven wrong.

FWIW, I'm an attorney and practice solely in federal court. Rulings on dispositive motions like an MSJ can take months, especially at the end of the year with various holidays and a possible transition in law clerks.
I'll also be buying an Apple TV and second generation apple watch. I love the iPad pro but not buying one yet. My firm may give all of us attorney's one for travel
And it was at 3pm EST so I guess it's still possible it's going on. It could have started late.
The only bad thing I could think of is a stay of the case.

I've appeared in federal and state courts for status conferences. They can be very non-eventful.
I'm not sure if Activision will ask the court to stay the case. I haven't seen any formal motion to stay filed. I don't see how the court can grant an oral request to stay the case without providing WDDD an opportunity to brief the issue. But who knows. Maybe she will unilaterally stay the case. No one knows.
As a plaintiffs lawyer, I could imagine WDDD will take an aggressive stance at the status conference and request the court to set all future dates.

I know that. Anyone can email Cook. We could all email Cook. That is not the alleged securities violation. What has been the "issue" to some is the response from Cook. That's all I'm talking about.

The best securities lawyers in the world are on AAPL's payroll. I'd bet every dollar I have that the email was not sent on a whim by Cook while he had his morning coffee. He was adequately advised before that email went out with his name on it.
