Who are they gifting these blocks of 10M shares to? I would post a link however you would not be able to get thru the password protection of my broker. You should be able to find it in the sec filings section under the ticker of your trading platform.

...issuing new shares as compensation. That this was disclosed here is a good sign...some companies (see Spongetech) used the markets like an ATM and never disclosed these sales. Still, this is the sort of thing that can result in short-lived jumps in delivery failures (the inventory is not available to cover the long sales of a newly issued block of shares, resulting in fails as the market maker is forced to go short to hedge).

The notes pay 10% interest and are due on December 31, 2013. The notes are convertible into common shares of Pacific Gold Corp. at a fixed price of $0.05 per share.

Thanks for clarifying the reporting issue. Like I said, I don't know anything about the company, other than its share price puts it in the "wild west" category, where the usual rules often fail to apply, both when it comes to management and market participants -- something that is deeply unfortunate, of course, but that's how things are.
A quick look at the fails data for the stock does suggest (and only suggest, mind you...I don't have time to take a good look right now) two things that make me wonder whether the source of the fails might not be endogenous:
1- Many short spikes surrounded by days of no or very few fails.
2- Daily fails numbers that are either very round (ending in many zeros) or repeating for multiple days at a time (note the string of 17,993 beginning on 12/7/2009 or the string of 4,487,901 beginning 10/16/2008).
In my experience, strategic (meaning, manipulative) delivery failures do not look like this. Might the company have been issuing shares (registered or otherwise) during these spikes?

I would need to know what the distribution of fails over this period was...how many each day, and what percentage of the float each days fails represented. Chart that in relation to volume and price and we'll have something to work with.
Do you have fails by date?
I don't know a thing about PCFG or its management, so please don't take offense when I say that a very real possibility when examining fails in microcap stocks (particularly non-reporting) is that sometimes management issues unregistered paper as compensation, and when these are sold onto the market, spikes in delivery failures inevitably result.

180,834,319 < The number of Fails to Deliver in PCFG stock from period beginning 01/01/2008 to period ending 09/30/2010 implying large short positions (naked).Most of this so called trading activity was during a death spiral and drove the stock sub-penny way below .01. PCFG was non-reporting during most of this period meaning they were not a "threshold security" and never appeared on a Reg SHO threshold list, through period 10/27/2008 - 08/31/2011 PCFG has been off-list (716 consecutive trading days). October 2010 the stock rises 1,000s of % points in 3 months to close out the year .03+ and has never returned to the levels where it was relentlessly shorted. They just recently became fully reporting......so what's eveyone's thoughts? Open short positions?

Knowing raw numbers of fails isn't very valuable...it's like saying it's 100 degrees outside (which would be much more meaningful in Antarctica than Death Valley).
Fails must be examined within the context of shares issued and float, in addition to their persistence. In other words, a huge spike in fails that is very short lived is less likely a sign of manipulation than is an enduring wave.
Do you have additional information?
