Florida Supreme Court Votes to Allow Medical Marijuana Amendment on Ballot

Earlier this week, we received news that United for Care, the campaign working to place a medical marijuana constitutional amendment on the ballot in Florida, had collected and certified the required number of signatures for qualification. Despite surpassing the signature requirement, the Florida Supreme Court still had yet to approve the language of the amendment. This afternoon, they ruled 4-3 in favor of allowing the amendment to be placed on November's ballot.
"Florida and national NORML salute the decision of the Florida Supreme Court to allow our citizens the right to decide for themselves if medicinal marijuana is an appropriate course of conduct for their own adult lives," stated NORML Board Chair and Florida resident Norm Kent, "Our group will be working vigorously, from Key West to our northwest panhandle, to pass this amendment and give our citizens the right to make health decisions best suited for their own lives."
"This is a tribute to the initiative of John Morgan, the group United for Care, and the thousands of petitioners who labored all over the state to acquire the requisite number of petitions to get this item on the ballot," Kent said.
20 states have now passed laws permitting medical marijuana and 2 have legalized cannabis for recreational use. Florida represents the first southern state to launch such an initiative, which divides the gubernatorial candidates, with the present governor, Rick Scott, opposing the initiative, and his likely opponent, Charlie Crist, saying he supports the effort.
The official ballot language can be seen below:
Allows the medical use of marijuana for individuals with debilitating diseases as determined by a licensed Florida physician.
Allows caregivers to assist patients' medical use of marijuana.
The Department of Health shall register and regulate centers that produce and distribute marijuana for medical purposes and shall issue identification cards to patients and caregivers.
Applies only to Florida law.
Does not authorize violations of federal law or any non-medical use, possession or production of marijuana.

Portland, Maine, Legalizes Recreational Marijuana
Lansing was one of three communities in Michigan that voted Tuesday to decriminalize marijuana.
Two other communities had similar votes today: Jackson passed a similar ordinance by 60 percent and Ferndale passed one as well by 69 percent of the vote.
JACKSON, MI – Marijuana advocates in Jackson took to the polls in droves Tuesday, Nov. 5, and passed a proposal that permits residents to carry marijuana within city limits.
The proposal, which decriminalizes 1 ounce of marijuana or less for residents 21-years or older, passed easily via a 2,242-1,434 vote.
"There is now 14 cities in the state of Michigan that passed similar ordinance, and we hope this will send a message to politicians," marijuana proponent Roger Maufort said. "We're very excited."
More than 550 residents signed and turned in a petition in July to put the proposal to a public vote.
Maufort and Steven Sharpe turned in the petition Tuesday, July 30. Maufort is the president of the Jackson County Compassion Club. Sharpe is a Jackson resident and marijuana advocate.
"I was confident this would pass," Sharpe said. "With the numbers coming in, considering it was an off election year, we're very happy to see a high voter turnout."
Jackson resident Jennifer Martin, 23, voted in favor of the proposal.
"I voted 'yes' because I think it should be straight up legal," Martin said. "People are going to smoke it anyway, whether this is voted in or not."
Maufort and Sharpe maintain that the proposal can help Jackson law enforcement focus on "real crime" in the city.
"If you look at the closure rates of larcenies, breaking and enterings, even rape, it's appalling," Maufort said. "We need police to focus on taking care of the real issues facing residents."
Jackson City Council members voted in August to put the proposal to a public vote and place it on the Nov. 5 general election ballot. Under law, the council was required to either vote in the proposal or put it to a public vote.
The proposal will change the city's code to read "none of the provisions of this division shall apply to the use, possession or transfer of less than 1 ounce of marijuana on private property by a person who has attained the age of 21 years."

20th State! Quinn signs Illinois medical marijuana bill into law
Gov. Pat Quinn today signed a bill legalizing the use of marijuana for medical purposes in Illinois that supporters say is the strictest in the nation.
Jim Champion, a military veteran from Somonauk who suffers from multiple sclerosis, joined the governor at a bill signing ceremony at the University of Chicago. He told of the relief he gets from marijuana, which his wife indicated allows him to more than cut in half the number of pills he takes. Champion said he is glad he'll soon no longer be violating the law to get pain relief.
The law takes effect Jan. 1, but state regulators are likely to need months to come up with the rules. That means it could be until next summer before those suffering from 42 illnesses including cancer, AIDS and multiple sclerosis can legally seek relief through marijuana.
Under the new law, a person could be prescribed no more than 2.5 ounces of marijuana over two weeks. That's enough to fill two small sandwich bags. In addition, the prescribing doctor must have a prior and ongoing medical relationship with the patient. And a doctor must find that the patient has one of a few dozen serious or chronic conditions for the marijuana to be prescribed.
Patients would have to buy the marijuana from one of 60 dispensing centers throughout the state and would not be allowed to legally grow their own. Workers at dispensing centers would undergo criminal background checks, the stores would be under round-the-clock camera surveillance and users would carry cards that indicate how much they had bought to prevent stockpiling.
Marijuana would be grown inside 22 cultivation centers registered with the state.
The state agriculture, professional regulation and public health agencies need to figure out a way to determine who gets permits to open marijuana growing centers and dispensaries and to determine rules for physicians giving out cards allowing patients to obtain the marijuana.
For years, the measure had failed to gain traction at the Capitol, particularly in the House. But this spring sponsoring Rep. Lou Lang, D-Skokie, was able to cobble together the votes needed to send the bill to the Senate, where a similar but less restrictive bill had passed in previous years.
Quinn had said he'd keep an open mind on the issue and indicated that military veterans who suffered pain might get relief.

Illinois Medical Marijuana Bill Endorsed By Lt. Gov. Sheila Simon, Awaits Senate Vote
With legislation that would bring legal medical marijuana to Illinois pending in the statehouse, Lt. Gov. Sheila Simon on Sunday announced the bill has her support.
According to the Associated Press, Simon said she was initially opposed to the proposal, but had a change of heart after reviewing the bill's regulations and hearing testimony from seriously ill patients who would benefit from it.
"It does a good job of both getting medical marijuana to people who need and keeping it away from those who don't," Simon said, according to the AP.
The bill would establish a four-year pilot program during which individuals with serious diseases including cancer, HIV and multiple sclerosis would be able to get a special ID card allowing them to buy limited amounts -- up to two-and-a-half ounces -- of medical marijuana from one of 60 state-licensed dispensaries.
The measure was approved last week by the Senate Executive Committee and will next be considered by the full Senate, which approved similar, less regulation-heavy legislation in 2009.
The program is tightly restrictive, not accepting "chronic pain" as a qualifying condition for use and not recognizing qualifying patients who live in other states, unlike other states who have approved medical marijuana bills, Medill Reports previously noted. The bill also requires that patients have an established doctor-patient relationship before a doctor can OK marijuana use.
If the full Senate OKs the bill and it also gets the governor's signature, Illinois would become the 19th U.S. state to legalize medical marijuana.
