Linda,
Still not sure of how Motion to Dismiss effects us....it's been so long that I've lost track. What type of ruling do we want here?
Marty
Linda,
Thanks again for your updates.
This has dragged on so long that I've forgotten what ruling would be favorable to us. I presume we want the motion to dismiss denied or am I wrong?
Ps..I just purchased a Hyundai and hope to have the same good experience with it that you had with yours.
Ma
Thanx Linda
I was beginning to wonder if Dime still had a heartbeat...long time without any current news.
Marty
Linda,
I assume that signing away all rights to future litigation for pocket change, was with JPM. I could not recall or find the actual text.
Would that agreement be useless if JPM loses to FDIC ...
In that case, current LTW holders might be pitted against those that gave up their rights.
Any opinion?
Marty
Linda,
As I recall...opting in for the small settlement required signing away ALL current and future claims. That was their purpose,IMO!
Marty
Hi Linda,
I would expect pressure on JPM to settle our claims quietly after some of their other deeds were recently exposed in the news media.
Marty
Linda,
Thank you for your opinion.
So, we wait for Judge Sleet....
Best,
Marty
So, I guess it's up to our current lawyers whether they want to take this to the next level...vs JPM and the gvt. I don't see us getting a fair shake from a judge who already ruled against us in the US Court of Federal Claims.
Any Pulse?
Happy Thanksgiving
to all bloodied and beaten down LTW holders...and may U know who choke on a turkey leg.
Marty
So quiet here...I can almost hear Jaime Dimon laughing at us about 15 blocks away.
Phillip,
Yes I read the agreement dated the 25th
Wouldn't that remove the LTW' from the bankruptcy case?
Would our problem pertain to transfer of assets in contemplation of bankruptcy prior to that date...and was it done legally? This can only help our situation as all the shenanigans may be exposed as JPM and the FDIC fight over the current situation.
Interesting stories today re JPM taking WMU from the FDIC before all the legal aspects were ironed out. WMU wants FDIC to pay part of the billions of fines as a result. Somewhere in this haste were our LTW's which apparently were skipped over....my assumption. I'm wondering if this current bickering will expose how our LTW's assets
got fraudulently transferred to JPM (IMO).
Stay tuned!
Philip,
Thank you for your reply and opinion.
I hope the California group continues to represent the LTW's in a new suit before a jury. They presented the situation in a clear and precise manner that a jury should understand and recognize as fraudulent conversion ....and worse, IMO.
They have all the data and are versed in the facts to present in a jury trial. Why wait for another decision from the same judges who ruled against the LTW's.
Time for HARDBALL with a JURY deciding the outcome...or a negotiated settlement in our lifetime.
Marty
Please explain...
Are the latest posts here saying we are done in this court?..... and now must wait for the outcome between JPM and FDIC. Then we can sue JPM? .....or, do we continue here and then have the right to sue?
Linda,
That may change if the LTW lawyers play hardball. I believe JPM and possibly some of the judges involved in past decisions have some things they would prefer not being dredged up. I expect HARDBALL before this is all laid (liad) to rest.
I just hope I am not laid to rest first!
Marty
Linda,
Thank you for your estimate of the remaining LTW's.
With a potential $15 plus judgement per LTW against JPM, I would think a settlement at least 1/3 of that would make sense to JPM ....before the court decision.
JPM does not need another embarrassment added to their record if they continue their ways!
Marty
Linda,
How would that convert to the current reduced quantity of LTW's? Seems to me that we could could receive the same....after accepting a big discount to settle.
JP has their hands full trying to settle many of their past misdeeds with the govt.
Marty
Hi Linda,
Thanks for the reply. So, we may still be alive. The summer doldrums/vacations may be the reason for no action in these cases. Hope all is well with you and that it is cooler in your area than here.
Marty
Hi Linda,
Nothing new here in 6 weeks...are we still alive?
Marty
Hi Linda,
JD has a residence at 1185 Park (a hi-rise)and recently it was reported that he bought a street level office. The residential bldg has a front court yard which you walk thru to enter the hi-rise. There was one guard on the sidewalk f/o, another midway in entrance and another just inside the courtyard. I did not notice any offices at street level...maybe on the side of bldg. Park Ave typically has just Dr's offices.

740 Park Ave
Watch the PBS documentary on those that reside at this building...if it gets replayed. Just google that building to get a taste of it!
I walked by Jamie Diamond's residence at 1185 Park Ave the other day...was surprised to see 3 uniformed security guards. I was curious as to why 3 security guards...so I googled the location. I walk by many of these buildings and have never before seen 3 guards. Don't see any F/O the Kock or Koch residence on Park Ave....where some of the biggest scummers in Manhattan reside,IMO.
Philip,
Thank you for your reply.
Marty
Philip,
Would the POTENTIAL settlement be shared by ALL LTW's...including those that accepted the pennies per LTW to sign away their rights?
I'm bending closer to the pavement with each passing day...but, must keep going till our pay day! Keep breathing, stay alive, alive! Maybe cryogenics? Wife could pack me in the freezer next to some cooked steaks, in case I get hungry.
OK, breath,breath.
Linda,
Thanks!
Long live the 19%....and others.
Marty
Thanx Jax for reply and Linda for keeping board informed.
LONG LIVE THE DIME 19%!...and the others.
Marty
Linda,
Romney referred to the "47%"....we are now the "19%.
LONG LIVE THE 19%!!....and those others.
Marty
Let's keep this board alive with some messages...otherwise it may get shut down due to inactivity!
Best to all DIMEQ die-hards!!!!!!!
Anyone here?
Phillip,
You are correct in the worthless designation. I had viewed them in my acct only a week or so ago. I just checked again and they were removed 8/21. The designation by broker seems to ALLOW you to take the tax loss this year. However, I still think you can hold off taking the loss till final court decisions. I am not giving up hope on our rights...wts or not....till the fat lady sings!
Phillip,
I think their designation means little. You don't take a tax loss till you sell,IMHO. My brokerage gave it zero value a few months ago...which they based on no trades for three months. This gives one the opportunity to transfer assets into a Roth IRA from a regular IRA....which I did.
Phillip,
Very good advice,IMHO!
I recently distributed all my DIMEQ from my regular IRA's (where I could not take a tax loss) into my ROTHS...where any potential gain will NOT be taxed! Nothing to lose...everything to gain in my case. Incidentally, it may transfer at zero value...since it hasn't traded in a few months.
Disregard my prior post...that was pre-coffee start-up of brain cells.
Drak,
Are you saying that DIMEQ can still be traded thru some brokers? If so, who and the current price?
Linda,
So, unless Judge Block gives a resounding thumbs down to us...it would make sense to put us out of the game with a $1 LTW offer in my opinion. That's just $11.5 million of an over $300 million judgement! Maybe better if the Judge sees merit in our position....
Marty
Linda,
Less than 10 million LTW's left by my calculation. Would make sense for winner in Judge Block's court (unless we are included in judgement) to make us a fair offer and avoid further litigation....considering the low consideration needed for so few LTW's.
Marty
cubs,
Read messages #6945 and #6949....hopefully, hopefully.
splendid,
Glad to have others along with me for the finale.
Don't mind giving up a few bucks (from my dream scenario) if something happens to bring our situation to a satisfactory conclusion. Seriously, just hoping we get a fair settlement should any litigation force a settlement.
Marty
