Sunday Times reports Warner Music is considering pursuing a merger with EMI by making a direct appeal to its rival's shareholders in an attempt to undermine the opposition of EMI's mgmt. The EMI board last month rejected what it described as a "preconditional offer" pitched at 260p per share.
Any deal between the No. 3 and No. 4 recorded music cos would require clearance by competition regulators. Warner remains keen to press ahead because it believes the European Commission's review of the Sony (SNE) BMG merger provides an opportunity to reshape the global music industry, creating three strong "majors" and a vibrant independent sector.

Running windows version of Handbrake (beta ver. .8) does a good job of creating h.264 mp4 files that work nicely on aTV.
Watching the temps on the Mac Pro (using SpeedFan 4.32) the cores go from temps in mid 30s centegrade up to the mid 50s.
Tested 720p files from the Apple Quicktime pages and some worked (Simpsons and other movie trailers) some did not (The space shuttle video)
They are all mov files, but I suspect they are not all h.264.
The 720p files look great on my 42" 1080p lcd
The newer itunes video content all looks better than most of thee std defintion programs on comcast.

Besides the fact I like pulling down video podcasts on my laptop and seeing them imediately on my TV, and that I can rip my movies to mp4s and pick them off a menu, just playing music through a home theatre sound system wasn't even on my mind when I bought it.
Now, consider the cost of getting music to any room of your house. Example:

SHENZHEN IS ONE of the hottest technology spots in China. Many of the "big names" from the West have offices, manufacturing facilities, or shipping centres located here. Shenzhen is often called the gateway to Guandong, the main technology manufacturing area in China, and is usually mentioned in the same breath as Hong Kong.

The last email I received said:
Wrapping up Apple TV is taking a few weeks longer than we projected, and we now expect to begin shipments in mid-March, not in February as originally anticipated.
Seems like another minor slip, but at least there is now a firm date.

AMD plucks new manufacturing chief from IBM

Advanced Micro Devices has appointed IBM veteran Douglas Grose as head of manufacturing, one of the company's most crucial executive positions.
As senior vice president of technology development, manufacturing and supply chain, Grose replaces Daryl Ostrander, who is retiring.
Improved manufacturing has been one of the primary pillars in the turnaround at AMD in the past five years. Historically, the company periodically stumbled because of delays or problems with manufacturing. Kevin Krewell, a former AMD employee and analyst, once joked that while Intel had a rigorous manufacturing ethos of "Copy exactly," AMD had one that could be called "Somewhat similar."
Things began to change under Bill Siegel and continued under Ostrander. AMD now regularly wins awards and accolades for its manufacturing. It has also come up with a method that it calls Automated Precision Manufacturing, which lets the company tweak the manufacturing recipe of a single wafer as it winds through the entire production process--a process that can takes weeks. In the past, semiconductor makers had to run several wafers, look at the results, and then adjust the formula. APM lets AMD correct problems more rapidly.
While continuing the work on APM, Grose in an interview said AMD will also increasingly emphasize lean manufacturing techniques to reduce waste. "It is a grass-roots effort that started in manufacturing and will spread across AMD," he said.
Grose will also oversee procurement and AMD's relationships with the foundries, or chip manufacturers for hire. Starting last year, Singapore's Chartered Semiconductor started to produce microprocessors on behalf of AMD. It was an unusual move: microprocessor manufacturers have tried to outsource in the past, but the relationships often fell apart. So far, the Chartered relationship is going well, and the company will begin to take on more advanced chips, Grose said.
Selecting an IBM-er to head up manufacturing is a natural move. IBM and AMD are linked in a long-term alliance to develop manufacturing technology. A substantial number of AMD's top executives came to the company from IBM (like CTO Phil Hester) or Motorola (CEO Hector Ruiz).
AMD's next major manufacturing challenge will be in moving to mass production of 45-nanometer chips. Chips made on the 45-nanometer process will be radically different in many ways than chips made on the current 65-nanometer process: one of the biggest changes is that the transistor gates, which control the flow of electrons, will be made of metal, rather than silicon. AMD says it will introduce 45-nanometer manufacturing in 18 months, rather than the usual 2 to 2.5 years the company takes between manufacturing jumps.
Dan Hutcheson, of VLSI Research, a consulting firm that studies chip manufacturing, has said that AMD appears to have already reduced a number of roadblocks toward mass manufacturing these chips and that the goal is "definitely doable."
Competitors, though, have noted that almost no companies in recent decades have advanced manufacturing that fast. If AMD is successful, it will reduce Intel's lead in moving to new manufacturing techniques from a little over a year to six months.

We have just gotten an anonymous tip from a source that indicates that Apple is planning a special event on February 20 to introduce Mac OS X 10.5 (Leopard), iLife ‘07 and iWork ‘07 as well as updated Mac Pros. Mac Pros will be available immediately with a free upgrade to 10.5 when it ships, and the ship date for 10.5 will be confirmed for 3/24/07 as we have been predicting for quite some time now. There is some speculation that we may see a week earlier or later for this event, depending on the status of Leopard, but this is the most likely date which is being planned (by this time, Leopard’s new interface will be complete and the OS will be finishing up testing). What better way to demo Leopard than with a brand new 8-core Mac Pro?
Many will remember that last year, not long after Macworld, Apple had a special event on February 28, 2006, to introduce new Intel Mac Minis and iPod HiFi (see their PR archive here).

Intel ships draft .11n card

SAN JOSE, Calif. — Intel Corp. announced it is in production with its draft 802.11n wireless modules, and at least four notebook makers are expected to announce systems next week using them. In addition, the company has certified five makers of access points as compatible with its chips.
Acer, Asus, Gateway and Toshiba will announce notebooks using Intel's 11n module with the official release of the consumer version of Windows Vista January 30. Asus, Buffalo, Belkin, D-Link and NetGear will ship 11n access points wearing a new "Connect with Centrino" logo showing they have been tested with the Intel module.
Intel provided no details about whether the largest notebook makers—Dell, Lenovo and Hewlett-Packard-- will use its .11n modules. Cisco Systems subsidiary Linksys is "evaluating" the Intel interoperability program for access points, said Dave Hofer, director of wireless marketing for Intel's mobile platforms group.
Intel claims its 11n module is compliant with the IEEE 1.10 draft issued at a meeting in London last week. However, the module, in its initial version, will not support bonding two 20 MHz channels together in the 2.4GHz spectrum to achieve higher data rates.
The 1.10 draft allows the channel-bonding option if client systems test to make sure the full 40MHz band is available. Hofer said Intel will run additional tests to see whether it wants to support 40MHz channels at 2.4 GHz in future versions of its module. The module does support 40MHz channels in the 5GHz band.
The Intel module supports 2x3 and 2x3 MIMO antenna configurations, provides sustained 125 Mbit/second data rates and can transfer a 19 Mbit/second high definition video stream up to 68 meters. It includes four chips--two analog front end devices believed to come from third parties, and an RFIC and baseband made by Intel.
The so-called 4965AGN module supports twice the range and five times the throughput of Intel's current .11abg module, Hofer said. "11n will support whole home coverage with the ability to handle high definition video," he added.
The module delivers up to an hour more battery life than some competing 11n products, Hofer said. However, the company did not detail the exact power consumption of the module.
Intel supports the plans announced last August of the Wi-Fi Alliance to certify draft .11n products, Hofer said. Intel's "Connect with Centrino" programs adds others tests not covered by the WFA regime, he added.
"We view the WFA as testing protocol-level interoperability. We add real-world test cases the WFA does not test for," Hofer said.
Specifically, Intel has conducted four sets of tests in a large two-story home, including tests of interference with microwave ovens, baby monitors and cordless phones.
January 17, 2007 The Resignation of US Attorney Kevin Ryan: What it Could Mean for Apple

Kevin Ryan stepped down today as U.S. Attorney for the Northern District of California. That could potentially be relevant to Apple, because Ryan has led the government's effort to prosecute Silicon Valley companies on options-related transgressions, such as backdating. Last July, Ryan brought the first backdating indictment, against two former Brocade Communications executives. Just around that time, he also created a backdating task force . And sources say it is his office that is scrutinizing Apple's books, as well.
A spokesman for Ryan, Luke Macaulay, says Ryan has been thinking about leaving since last summer, in part because he’s got two sons heading for college. In other words, maybe he felt it was time to give up public service for a while, and head for the more lucrative private sector. But there’s also been much talk about an exodus of veteran prosecutors and others during his tenure, and criticism of his management style (check out this piece from a while back in SF Weekly). Sources tell me that Ryan, as the SF Weekly story suggests, got plenty of negative feedback in an internal review earlier this year.
And in October, DOJ headquarters in Washington sent out a panel of prosecutors from around the country to interview a dozen or so of those that had jumped ship during Ryan’s tenure. My sources say such an inquiry of former staffers is rare, and maybe unprecedented. Macaulay confirms this external review occurred, but isn’t sure how common it is. Also, he said no final report has come out of it so “it’s too early to draw any conclusions from the evaluation.” Still, given that Ryan’s departure was a “mutually agreeable decision with Washington,” according to Macaulay, Ryan’s higher-ups were evidently concerned about something.
So what does Ryan’s departure mean for Apple? That depends on whether his replacement pursues backdating cases as aggressively as he has. As it is, Macaulay points out that Ryan has publicly said it is unlikely his office would indict more than five companies (the math is complicated: Ryan has said his office is most intently examining red flags at ten to twenty percent of twenty five of the companies now being investigated. That’s 2.5 to 5, to be exact).
That’s not a gigantic caseload, but some former government prosecutors and defense attorneys I’ve spoken with wouldn’t be surprised if it fell even more. Ryan, as the guy in charge when the backdating emerged as a full-blown scandal earlier this year, might be more invested in seeing it through than his successor might be. Even now, says one source, “the steam seems to have come out of [the DOJ’s prosecution of backdating cases) a bit.
That’s not to say the folks at Apple should be sleeping any easier. No doubt, a decision to charge Apple would create a steam whistle heard round the world, in no time flat. Still, my guess is that Ryan’s departure means the odds of criminal charges against Apple or Steve Jobs got a bit longer today.

Mac Pros sales are hampered by the grahics arts pros who are waiting for Adobe CS3 to be released. It is the version built for the intel chip whereas the current CS2 suite runs the power chip interpreted (much slower) version.
Should see a big jump in Pro sales the second quarter.

Apple has been the strongest brand in the education mmarket for a long time. The inverse relation relationship (versus dell, HP et al) between the 3rd and 4th qtrs (Apples 4th and 1st qtrs) is long standing as well.

Anyone: How would you dial the only comment Jobs made at MWSF about numbers. Paraphrasing from memory, "50% of every Mac sold this quarter (at Apple stores) was to someone new to the Mac."
How's that compare to previous qtrs?

I have a few AMDMT Jan $19 puts that did a fair job of protecting me this time around. I am planning to close 1/2 them on an expected dip Tuesday and hold the rest until wednesday. I'm long some calls that are under water for Jan and Jan 08 INTC Leaps and NQAD Jan $20s. I originally thought the Qtr woud have been stong enough for both AMD and INTC due to upgrade cycles but I think now INTC long and AMD net short is the way to go until we see the AMD NGA whenever that actually turns out to be.
