The way I understand it is there is no appeal process en banc. Only request of re-hearing is allowed. If the odds of being granted en banc is low, I can only imagine the odds of being granted a re hearing.

That ship has sailed long ago. Govt had a chance early on with Fairholme/Berkowitz but they chose/choose to let the courts decide. Defendant is free to take corrective actions and settle all suits at any point on their own.

Your not being naive at all. Federal judges are not influenced by anyone, including govt representatives. Anyone even attempting to influence a case by making any type of contact with the presiding judge would be taking a colossal risk and in my experience unheard of. I can’t even imagine how that conversation would go. The federal court system operates and is held to/at the highest of standards and professionalism regardless of what some think

I don’t think congressional inaction will cause any meaningful delays. This administration appears to be dead set on moving forward with or without. The actions the admin wants or have made public so far at least are minimal compared to a sweeping overhaul. Looking forward to the next few weeks/months........BIG TIME
