Congress Will Hold A Marijuana Hearing One Week After Five States Vote On Legalization Ballot Measures
House lawmakers will hold a hearing next week to discuss bipartisan marijuana reform issues at the federal and state level.
The House Oversight Civil Rights and Civil Liberties Subcommittee posted a notice of the meeting on Tuesday, as voters in states across the country head to the polls to decide on cannabis legalization ballot measures.
The congressional meeting, titled, “Developments in State Cannabis Laws and Bipartisan Cannabis Reforms at the Federal Level,” will take place on November 15. Witness have not yet been announced.
It’s not clear if the hearing will focus on any specific pieces of federal marijuana reform legislation, but Rep. Nancy Mace (R-SC), who serves as the GOP ranking member on the panel, previously told Marijuana Moment that she had received a “promise” from leadership that her States Reform Act (SRA) would be taken under consideration in the panel.
That legislation would end federal marijuana prohibition while taking specific steps to ensure that businesses in existing state markets can continue to operate unencumbered by changing federal rules.
In April, the House already passed a separate cannabis legalization bill, the Marijuana Opportunity, Reinvestment and Expungement (MORE) Act, from Judiciary Committee Chairman Jerrold Nadler (D-NY) for the second time.
Rep. Jamie Raskin (D-MD), chair of the Oversight subcommittee, has also expressed interest in cannabis reform issues. For example, he filed a floor amendment to the MORE Act to require federal agencies to review security clearance denials going back to 1971 and retroactively make it so cannabis could not be used “as a reason to deny or rescind a security clearance.” That measure was narrowly defeated in a floor vote.
While details about the newly announced meeting are sparse, the panel will likely have new state developments to consider after Tuesday’s election, which will see five states deciding on marijuana legalization at the ballot, including several traditionally conservative states.
This month also marks the 10-year anniversary of the first state votes to legalize cannabis for adult-use in Colorado and Washington State.
To mark the occassion, Sen. John Hickenlooper (D-CO) recently announced that he will soon be filing a bill to direct the attorney general to create a commission charged with making recommendations on a regulatory system for marijuana that models what’s currently in place for alcohol.

LITTLE ROCK, Ark. (AP) — Voters approved recreational marijuana in Maryland and Missouri but rejected it in two other states, signaling support gradually growing for legalization even in conservative parts of the country.
The results mean that 21 states have now approved marijuana’s recreational use. Arkansas and North Dakota voters rejected legalization proposals in Tuesday’s elections. A similar initiative went before voters in South Dakota, but early Wednesday it was too early to call.
Advocates said the results send a message to lawmakers in Washington about support around the country for legalization.
“
A growing number of voters recognize that cannabis policy reform is in the best interest of public health and safety, criminal justice reform, social equity, and personal freedom,” Toi Hutchinson, president and CEO of the Marijuana Policy Project, said in a statement. “State-level legalization victories are what’s necessary to move the needle forward at the federal level.”
The state voting follows moves by President Joe Biden toward decriminalizing marijuana. Biden last month announced he was pardoning thousands of Americans convicted of simple possession of marijuana under federal law.
Advocates of the marijuana initiatives have said Biden’s announcement could give a boost to their efforts.
Missouri’s measure will legalize recreational marijuana for adults 21 and older and expunge records of past arrests and convictions for nonviolent marijuana offenses, except for selling to minors or driving under the influence.
“It just shows that this is not a partisan issue,” said John Payne, who led the Missouri campaign to legalize marijuana use. “This is something that transcends partisan divides.”
“Support for ending marijuana prohibition in the states is spreading much like it did at the end of alcohol prohibition,” said Mason Tvert, a partner at VS Strategies, a cannabis policy and public affairs firm. “
The five states that held votes on Tuesday have legal medical marijuana programs. That includes Arkansas, which in 2016 became the first Bible Belt state to approve medical marijuana. The state’s dispensaries opened in 2019, and more than 91,000 patients have cards to legally buy marijuana for medical conditions.

The transaction comes after Cresco Labs earlier this year agreed to purchase rival Columbia Care in a $2 billion deal that would make Cresco the top U.S. cannabis producer. It was one of the biggest deals in the cannabis industry, and required Cresco to divest assets in limited-license markets such as New York.
The deal includes four retail stores and one production facility in New York state; three retail stores and one production facility in Massachusetts; and two retail stores and one production facility in Illinois.
“My mission has always been to create opportunities for Black entrepreneurs in industries where we’ve traditionally been denied access, and this acquisition provides the immediate scale and impact needed to create a more equitable future in cannabis,” Combs in a Friday press release.
The assets give Combs the ability to manufacture branded cannabis products and distribute the products to dispensaries in major metropolitan areas like New York City, Boston and Chicago. Combs will also be able to operate retail stores in the three states.

Marking the 10th anniversary since Colorado voters approved marijuana legalization at the ballot, Sen. John Hickenlooper (D-CO) announced on Thursday that he will soon be filing a congressional bill to set the country up for federal cannabis reform.
Specifically, the Preparing Regulators Effectively for a Post-Prohibition Adult-Use Regulated Environment Act (PREPARE) Act would direct the attorney general to create a commission charged with making recommendations on a regulatory system for marijuana that models what’s currently in place for alcohol.
The measure is identical to a House companion bill that Reps. Dave Joyce (R-OH), Hakeem Jeffries (D-NY) and Brian Mast (R-FL) filed in April. Hickenlooper’s staff told Marijuana Moment that the Senate version will be formally introduced when the chamber returns from recess in mid-November.
The senator sees the commission that would be created by the legislation as similar to a task force he empaneled when he was Colorado’s governor to steer implementation of legalization at the state level.

In the Czech Republic, hemp products like marijuana, hashish and cannabis oil have been available in pharmacies for years. Prague is now planning full legalization for 2023 and wants to coordinate the step with Berlin.
Tourists in Prague may get the impression that the Czech capital is also the cannabis capital of Europe. From stickers to posters, the iconic leaf of the intoxicating marijuana plant is all over the place. It also adorns the windows and facades of plenty of shops offering everything someone might need to grow the plant — from topsoil, seeds and fertilizer to lamps for growing the plant indoors. Many grocery stores also offer drinks as well as chocolate, ointments or creams containing cannabis.
But that first impression is slightly misleading. These products contain at most 1% of the psychoactive substance tetrahydrocannabinol (THC) and they won't get you high. THC is the bit that turns cannabis into an intoxicant. In addition to the dried flowers also known as "grass," "weed" or "marijuana," cannabis comes primarily as fermented and pressed flowers and oils, also known as "hashish."
And these are all still illegal in the Czech Republic if they contain more than 1% THC.
Europe's top cannabis users
Although still against the law, the consumption of substances containing THC is widespread in the Czech Republic. Around 30% of the adult population has tried marijuana, and 8% to 9% use it regularly, according to the Addiction Report released in August 2022 by the National Monitoring Center on Drugs and Addiction (NMS). According to the data, around 800,000 people in the country of 11 million use cannabis.
"We are one of the countries with the highest rate of people who have had at least one THC experience in their lifetime," Pavla Chominova, head of the observatory, told Pravo daily. According to the European Monitoring Center for Drugs and Drug Addiction (EMCDDA), the Czech Republic ranks first among all EU countries with 23% THC users in the 15-34 age group. When it comes to hard drugs, on the other hand, the country is somewhere in the middle of the European rankings.

Senate Majority Leader Chuck Schumer (D-NY) says Congress is getting “very close” to introducing and passing a marijuana bill with provisions covering banking access for legal businesses and expungements of past convictions, citing progress he’s made in discussions with a “bunch of Republican senators.”
During a debate with his Republican reelection opponent Joe Pinion on Sunday, Schumer was asked about a separate broader cannabis legalization bill he filed this year and whether he felt it would make more sense to first promote more research into marijuana before ending prohibition.
While the top senator said that research is “very, very important,” he pointed out that “many states have approved legalization of cannabis,” and so the policy is already “upon us.”
“But we are getting very close,” Schumer said in the debate, which was hosted by Spectrum News. “I am working in a bipartisan way with Democrats and Republicans to take the SAFE Banking Act, which allows financial institutions to involve themselves in cannabis companies and lend money to them—but it also does some things for justice, such as expunging a record.”
He gave the example of a 15-year-old busted over a “small amount of marijuana” who was ultimately sentenced harshly in a manner that would be consistent with possessing and selling heroin and whose “life was ruined.”
“So, expunging the records is important, and we’re getting closer,” Schumer said. “We may be able to get something done rather soon. I’m working with a bunch of Republican senators, a bunch of Democratic senators, to get something passed.”
What the senator is talking about is the much-anticipated SAFE Plus package, which is expected to build upon a standalone cannabis banking measure that’s passed the House in some form seven times now but which has stalled in the Senate under both Democratic and Republican control.
The plan, according to several lawmakers, is to file the package of modest marijuana reforms some time during the lame duck session following next week’s midterm elections, pass it through both chambers and send it to the president’s desk before the end of the current Congress.

Health Minister Karl Lauterbach presented a cornerstone paper on planned legislation to regulate the controlled distribution and consumption of cannabis for recreational purposes among adults.
Acquiring and possessing up to 20 to 30 grams of recreational cannabis for personal consumption would also be made legal.
The coalition government struck an agreement last year to introduce legislation during its four-year term to allow the controlled distribution of cannabis in licensed shops.
Lauterbach did not give a timeline for the plan, which would make Germany the second European Union country to legalize cannabis after Malta.
Many European countries, including Germany, have already legalized cannabis for limited medicinal purposes. The use of cannabis for medicinal purposes has been legal in Germany since 2017. Others have decriminalized its general use, while stopping short of making it legal.
According to the paper, private self-cultivation would be permitted to a limited extent. Ongoing investigations and criminal proceedings connected to cases no longer illegal would be terminated.
The government also plans to introduce a special consumption tax, as well as developing cannabis-related education and prevention work.

Some 4 million people consumed cannabis in Germany last year, 25% of whom were between ages 18 and 24, Lauterbach said, adding that the legalization would squeeze out the cannabis black market.

The company said the creation of Canopy USA will help it reduce costs and tap into the U.S. market, which is projected to be more than $50 billion by 2026. Marijuana is not yet federally legal in the U.S.
“As the growth of the U.S. cannabis market continues rapidly at the state level, this strategy enables us to take control of our own destiny and capitalize on the once-in-a-generation opportunity in the largest cannabis market in the world,” said David Klein, CEO of Canopy Growth Corp.
Canopy said the move will allow it to complete its acquisition of New York-based Acreage Holdings, Colorado-based edibles specialist Wana Brands and California extracts maker Jetty. Those assets will be housed under Canopy USA.
Canopy’s shares were up 20% Tuesday morning.

Next year, when consumers in Florida pick up a soda, chips or a candy bar when they load up for gas at Circle K gas station stores, they’ll be able to add another new item – licensed medical weed.
Circle K, a Canadian convenience store and gas station operator, is teaming up with a leading cannabis packaged goods company, Green Thumb Industries, to sell marijuana at a limited number of locations in 2023.
The rollout of the pilot with begin with 10 locations where Green Thumb will set up its RISE Express dispensaries adjacent to the Circle K convenience stores. Circle K has 600 locations in the state.
“The opening of RISE Express stores at Circle K locations is a game-changer. Convenience is a strong channel in retail, and people want more access to cannabis,” Green Thumb CEO Ben Kovler, said in a statement.
“The new RISE Express model is a huge step forward in making it easier and more efficient for patients to purchase high-quality cannabis as part of their everyday routine when stopping by their local convenience store,” he added.
Selling marijuana is still illegal under federal law but Florida is among several states where its sale for medical use is legal. More than 700,000 Floridians are currently registered active cardholders in the state’s medical marijuana program, according to the Florida Department of Health.
This isn’t Circle K’s first expansion into the cannabis market. In 2021, Circle K’s parent company Couche-Tard expanded a pilot program with Canadian cannabis retailer Fire & Flower to open cannabis retail stores adjacent to its Circle K convenience stores in new markets across Canada.

The White House drug czar says that it’s key to ensure that any decision that’s made as part the federal scientific review into marijuana’s scheduling status directed by President Joe Biden “filters into criminal justice as well.” And when it comes to the science of cannabis, he said that there are “clearly” therapeutic benefits.
Rahul Gupta, director of the Office of National Drug Control Policy (ONDCP), talked about Biden’s mass pardons of people who’ve committed federal marijuana possession offenses and his scheduling directive during an interview with NPR last week.
He said that it’s “really important for us to look at how many people have been serving sentences and have been impacted for non-violent drug crimes,” emphasizing that Black people are significantly more likely to be arrested over cannabis than white people despite comparable rates of consumption. “So it’s really important to follow the science and, at the same time, ensure that our science and evidence filters into criminal justice as well.”
Gupta also acknowledged that he worked to implement a state medical cannabis program while serving as a West Virginia health commissioner, and he said “we know—and the president has as much said so—that clearly there are medical potential uses” of marijuana.
“Still, we need to make sure that we’re working to have a process through it, and that’s exactly why last week President Biden made these announcements,” he said. “It’s really important to follow these steps as the president has outlined because marijuana is currently scheduled as a Schedule I drug and it’s treated the same…as heroin and LSD and it’s important for us to take a look at that.”
The director also talked about the medical value of cannabis in a separate interview earlier this month. And while he’s statutorily obligated to advocate against legalizing Schedule I drugs, he declined the chance to do so when asked about the issue.
Before the president’s announcement, the drug czar said over the summer that the Biden administration is “monitoring” the state-level cannabis legalization movement.
During this latest interview, an NPR journalist pressed Gupta on the scientific review process that the Justice Department will be carrying out in concert with the U.S. Department of Health and Human Services (HHS), pointing out that the Schedule I status of cannabis has inhibited the very research that the agencies are supposed to depend upon to reach a scheduling determination.
He didn’t quite address the disconnect, but he said “the fact of the matter is that there is research and there continues to be research across states.”
“The simple fact is that you follow the research that you have, and you make decisions based on the science that is available to you,” Gupta said. “And we do know that, today, we have more research available than we had just simply 10 years ago. So it is time, as the president has asked for, to take a look at the scheduling of marijuana as a Schedule I drug.”
Asked about the practical implications of rescheduling cannabis to a lower classification, the official said that he didn’t want to “get ahead” of the Food and Drug Administration, DOJ or HHS.
“What I would suggest is that we let the science take its path and its course and have that decision be made by the experts in that area,” Gupta, who also previously provided consulting services to a cannabis company before joining the administration, said.
The drug czar is just one of several Cabinet officials to address Biden’s surprise marijuana announcement in recent weeks.
For example, Labor Secretary Marty Walsh said that officials will be working diligently to ensure that people who received a pardon for federal marijuana offenses under the presidential proclamation are not impeded from future job opportunities.
Secretary Xavier Becerra has also talked about the president’s directive to agencies to conduct an administrative review of cannabis’s scheduling status. The health secretary said officials will “work as quickly as we can” to complete the analysis.
DOJ, for its part, “will expeditiously administer the President’s proclamation, which pardons individuals who engaged in simple possession of marijuana, restoring political, civil, and other rights to those convicted of that offense,” a department spokesperson said following Biden’s announcement.
A series of polls have shown that Americans strongly support the president’s pardon action, and they also don’t think that marijuana should be federally classified as a Schedule I drug.
For her part, Vice President Kamala Harris said last week that voters should elect lawmakers who support marijuana reform so that Congress can enact a “uniform approach” to the issue in light of the president’s cannabis pardons.
Sen. Cory Booker (D-NJ), meanwhile, said that he appreciates the “significant” step that the president has taken, but there’s “more that we can do” to address the drug war and he’s “very hopeful” that additional reform can be enacted before the end of this Congress.
He reiterated that point in an interview published on Monday, adding that he thinks lawmakers have a “good shot” at enacting a package of increment marijuana proposals during the lame duck session after the midterms next month.

Cory Booker Says Congress Has A ‘Good Shot’ At Passing Marijuana Reform During Lame Duck Session

Sen. Cory Booker (D-NJ) says that Congress has a “good shot” of passing modest marijuana reforms—including banking and justice provisions—during the lame duck session after the midterm elections. He also stressed that lawmakers might not have the same opportunity if Republicans retake either chamber next year.
In an interview with NJ.com that was published on Monday, the senator said that leadership was engaged in “active negotiations” over a package of cannabis proposals before the August recess. And he recently discussed the legislation with Senate Majority Leader Chuck Schumer (D-NY) and felt that they’d made “progress” at the meeting.
“It’s very likely that during the lame duck—before the new Congress—we’re going to see a really good bipartisan attempt to move it,” Booker said. “Maybe it’s not the [legalization] bill I wrote with Schumer and [Senate Finance Committee Chairman Ron Wyden (D-OR)], but an effort to tie in restorative justice and some fair banking provisions.”
“I think it has a good chance because our Republican allies also understand that if one of the houses of Congress shifts to Republican, it will be very hard to do anything on marijuana,” he said. “We’ve got a good shot. I wouldn’t say it’s a great shot, but it’s on a good path.”
He also reiterated that he’s “still a little frustrated” that state-level legalization hasn’t seen the “democratizing effect” that advocates had hoped would come with reform with respect to industry equity. He pointed out that few New Jersey marijuana business licenses are owned by minorities.
“The Senate has got to move and pass a bill that deals with a lot of areas—restorative justice, making the banking industry equally available, and investing tax revenue to help with addiction and create economic opportunities and deal with the sins of the past,” Booker said.
The senator also weighed in on President Joe Biden’s recent move to issue mass pardons for people who’ve committed federal marijuana possession offenses, saying again that he feels that “there are more steps to be taken.”
“The fact that we are deporting parents of American children for marijuana possession should outrage every American,” he said, referencing one group that was left out of the president’s clemency action. “And obviously, the folks who have been doing these low-level sales, we should look as we move closer to a majority of states moving toward legalization.”
“But I can do nothing but celebrate Joe Biden,” Booker said. “He and I had conversations during those debates—off stage—that were meaningful to me. Because he committed to me to do the things he did this week. I just think that’s a powerful thing for your elected leader to say he’s gonna do something and then follow through.”
He made similar remarks in another interview the day after Biden’s pardon proclamation, stating that he’s “very hopeful” that additional reform can be enacted before the end of this Congress.
During his 2020 presidential campaign, Booker repeatedly pressed Biden over his opposition to adult-use legalization, criticizing him on the debate stage and elsewhere as being out of step with the majority of his party and emphasizing the racial justice imperatives of ending prohibition.
A series of polls have shown that Americans strongly support the president’s pardon action, and they also don’t think that marijuana should be federally classified as a Schedule I drug, which could change following Biden’s separate directive for federal agencies to carry out a scientific review of cannabis.
Meanwhile, Schumer separately spoke about marijuana banking issues at a recent White House event, reiterating that he was working on the problem, according to the House sponsor.
The conversation between Schumer and Rep. Ed Perlmutter (D-CO) happened at an event on inflation reduction and happened to coincide with the National Cannabis Industry Association (NCIA) lobby days, with over 100 marijuana business leaders on Capitol Hill to push for the passage of the SAFE Banking Act.

URBANDALE, Iowa — Cannabis reform is something the United States is seeing happen state-by-state.
On Saturday morning, the Campaign for Sensible Cannabis Laws hosted a reform event to hear from community leaders and politicians on what needs to be done.
“Where we are right now is we are trying to get a debate in the legislature and across the state frankly about cannabis reform,” said Bradley Knott, founder of Campaign for Sensible Cannabis Laws. “For whatever reason Republican leadership refuses to let us have that conversation. So what we are about is demonstrating that there is political support for cannabis reform.”
