Around 12 assets owned by Lehman Brothers in Asia are to be sold off within the next few months, the company's liquidators have said.

KPMG, which is carrying out the liquidation process, has already divested 31 of Lehman Brothers' principal investments, with 11 of the Asian assets turning in a profit.

Edward Middleton of KPMG China told Bloomberg: "We've been working these positions as any investment bank would.

"Progress in China has been refreshingly quick as well as producing better returns than I expected."

KPMG has settled $246 million worth of Lehman Brothers' real estate assets in China, with return rates of around 80 per cent on what the now-defunct financial institution paid.

The buoyant state of the property market in Asia has helped KPMG divest the assets quickly.

Last month, Chinese government economist Zhang Liqun, told the China Securities Journal that real estate investments in the country may increase by as much as 40 per cent in 2010.

LONDON (MarketWatch) -- Bank of New York Mellon Corp. /quotes/comstock/13*!bk/quotes/nls/bk (BK 29.58, +0.49, +1.68%) said Tuesday it will appeal the recent ruling by the U.S. Bankruptcy Court in Manhattan on a structured debt program called Dante, to which Lehman Brothers Holdings Inc. /quotes/comstock/11i!lehmq (LEHMQ 0.08, +0.00, +3.80%) was a counterparty.

Judge James Peck granted summary judgment to Lehman Jan. 25, ruling that a contract in question violates U.S. bankruptcy law. The contract allows investors in bonds issued under the Dante program to move ahead of the bank to grab assets backing the bonds.

"As a result of the conflicting court decisions in the U.S. and U.K. regarding the Lehman-sponsored Dante bond program, BNY Mellon, in its role as trustee, will appeal the recent ruling by the U.S. Bankruptcy Court," Bank of New York Mellon said in a statement.

"The U.S. court's ruling is likely to have implications beyond this specific case and we are hopeful the appeal will help clarify the issue."

I don't know about you guys... but I had a hard time bid whacking the last couple of days. I was trying to bid whack all of the preferred classes and ended up with 1000 shares for the last couple of days. I have a bunch of shares that I'm holding, but was trying to pickup some more on the bid for my IRA :P

I'm not going to lose sleep over the new requirement and if institutions are dumping shares I will pick them up as quickly as they drop them. I'm in this to win...

This is how I see the new requirement. They are trying to preserve the NOL and prevent a hostile takeover.

It sounds like you are concerned that institutions will dump shares to meet the new requirement. Is that correct? Can they do that to holders prior to the motion date? I would think it would be a new requirement after the motion date is approved.

I'm sure there are existing shareholders that loss tons of money and now they are required to meet this new requirement by selling their shares?
