That is certainly not the case (i.e. "scaled down"), robotified. Nor was it "narrowed" in the strictest sense, either. Going from 95 claims to 89 doesn't even come close when some claims were redundant. Bottom line, the 89 claims is now much more stronger and clearer than the 95 claims previously. Nothing "narrowed" or "scaled down" about it. This is what Bulkely refusing to acknowledge. The claims are much more likely to be held up in court. I think Bulkely sees that already or else he wouldn't even mention the possibility of a (reasonable) licensing fee in Bena's interview with him. Remember, Scanbuy is up for treble damages.
jcg, then that is the case but we need to bring it up at the CC and for them to say it in plain English and on the record even though the 8-K said it. But not everyone can read nor understand those filings gobblygook and not understand that NEOM is not in danger of losing their IP.

We'd only need .121 cents to realize a market cap of $157 million, the same when Neom in 05 hit $157 million but at .38 cents or so. Any substantial news over the next few months and beyond wouldn't take much to push it past .12 cents.
Sandpeep, it'd be chump change once the licensing gets underway. Why would Yorkville Advisors (YA) give Neomedia access to several million dollars starting last year based on certain requirements before getting the next tranche of money? They have received the first and second tranche of money and yet have not heard of a 3rd tranche (we'll know in the 10-K very, very soon) which should've been dispersed (upon fulfilling a set of requirements) earlier this year in January. So, the money is coming from somewhere since then to support Neomedia's operations.

I think there are two persons involved against Neomedia to answer your question. Though I could be wrong.
Drmyske3, he won't apologize. His own ego will not let him do that. He won't even acknowledge that indirect encoded linking is superior that direct encoded linking due to the availability of metrics for companies to have. That's a gold mine for them to have. And that Neomedia owns that patented process.

From a practical commercial standpoint the '048 patent has clarified and strengthened, not narrowed.
EFF claims on its website that third parties can now design around the '048 patent, and purports to inform the pubic how to do so. Of course, any system that is not encompassed by the claims of any patent is a "design around" of that patent. That is true with respect to any patent. But the real issue to consider is - what is the commercial value of such a designed around system? Theoretical design arounds may be an interesting philosophical exercise in which to engage, but they provide no real commercial value. For example, one might be able to design around a patent on a four-wheeled car by producing a three-wheeled version, but the resulting product is unstable, unsafe, unmarketable and would certainly be unsuccessful. We believe the same would be true for an attempted design around of the '048 patent.

It is at best false to say that Neomedia's patent claim was narrowed but rather clarified and strengthened. I hope someday that EFF, as an organization, gets sued big time for making false and misleading statements.

Pay the piper or get out of the way while others pay for the license and see their own profits go up.
