Just by having a member of Activision on the board is slanting toward privy. I don't see them having a chance of getting an appeal.

I remember listening to the Audio where the judge was telling Bungie that the burden was wrongly placed on Worlds. I can't seem to find it otherwise I'd post it for Whitecoal to hear. Anyone got the link.
If I'm not mistaken, Didn't the court already tell Bungie that it was up to them to prove that they are not an RPI to Activision?

How do they discuss either (privy or control) now that discovery has been shelved? It was put back on Bungie to prove. How does one prove if that door is shut? Are they even allowed to argue this? Kinda like an episode of Scooby Doo. "I would have gotten away with it if it weren't for those pesky kids".
One thing we know for certain is that Bungie tried to settle with Worlds and Thom saw that it was written on bathroom tissue.

Doesn't look like he's here for lawsuits against other infringers. He will miss out on quite a bit more. You can lead a horse to water.
This one should be public. They already used "settlement" discussion in their last brief in which that part was sealed. I wouldn't expect Bungie to bring it up again this time unless there was some kind of progress/arrangement/agreement with Worlds. I'm betting those talks were insulting, seeing how hard Worlds came out swinging in their last brief.

Don't most patent lawsuits against (big money) infringers start out as a lottery ticket? Wasn't Vrng one of those against google? They won initially but got screwed in the end. I remember Vrng and don't fully trust the system. (I actually made money) People believe that we will win something based on the 6 claims that have already made it thru the PTAB. So I can understand why they here are cheering this little company on. (myself included) It only takes one claim to win.
Very well said. Gio needs to understand that the further this goes along with positive progress, the more confidence we have to stay with it.
If you've been here as long as the majority, you would know that most of us believed from the beginning that this is a lottery ticket. The further along this thing gets, the more our numbers are showing up slowly, one at a time. It's good to be cautious, but we all know what we signed up for.

Think about it. Atvi gave Destiny to Bungie with no strings attached as a peace offering so they wouldn't turn around and sue Activision for not disclosing to them that they could possibly be using Worlds patents. The owner of Worlds offered Activision a licensing deal and they blew him off. Was Destiny not Making money for Activision? It sure upset a lot of shareholders when the split was announced as the stock dropped almost $5 that day. The lawsuit wasn't supposed to get this far for Activision as it tried to bankrupt Worlds but failed.
I'm saying it's a peace offering. Atvi never told Bungie that Kindren asked them to sign a user agreement for his patents. Bungie would then sue Atvi for not disclosing that. I believe that by giving them Destiny is a way to appease that.
In your dreams. If you really think that has nothing to do with this case, then you haven't been paying attention. The timing is so obvious.
Like some are saying here. This can go on until 2020plus. Is the 3-4 grand you have vested in Worlds worth the wait? (you say you have 12,000 shares) Quilts analysis is his educated and researched opinion. Does he have to be absolutely spot on? Absolutely not. You really don't see too many people that own shares in a company that bash other long holders. Why the negativity?
Gio might be a swing Trader who bought in during high volume at a higher price and can't get anyone to buy his shares so he can get out. Now he's frustrated.
This is a cart before the horse question: Do you still believe in accepting shares from Atvi vs a lump sum in a Worlds win? Has the announcement of the shareholder lawsuit along with the lowered revenues from Destiny already been baked into the stock price? (they've already lost half their value)Or is the worst still yet to come for them? It would suck to receive shares and then have those shares fall off a cliff.
People on the Atvi board at Yahoo didn't seem phased when I commented on the lawsuit with Worlds. We need to do it in force if we want the message out. I would like a higher share price, But I also want more people fighting over the ask when the decision comes out.
Facts are facts. If you can point to some companies that were hurt when describing to a jury how they were taken advantage of, then we will be able to see for ourselves.
Perhaps Gio could share his knowledge of how he's seen some companies that were hurt in their lawsuits when explaining to a jury how they were wronged by a system that takes advantage of the little guy. It would be a learning experience for most of us that don't usually follow patent lawsuits. I do understand that the patents are the main focus, but jurors can and do use emotion in their decision making.
Why do you believe a jury shouldn't hear about how a wealthy company stole worlds patents and then thru collusion with another company, tried to bankrupt them. If worlds is successful (I think they will be) how else would they convince a jury of their damages for any kind of willful infringement?
Worlds should just pay Activision and Bungie's attorney fees and issue a huge apology. I am so ashamed I ever got involved in this company in the first place. I guess I'll try investing in real estate instead. Who wants my shares? Good luck on the apology tour.
Yep. After that, we wait for the decision. Is there a schedule of any kind for how long that usually takes? I haven't a clue.

Morgan Stanley Research has Destiny’s revenues in 2019 even higher, valuing it at $374 million.
“While it is not entirely clear if there will be a payment from Bungie to compensate ATVI for ending the publishing arrangement early, we believe that going forward, Bungie and the Destiny franchise will operate independently,” “In addition, we would expect investors to look through any payment as being one-time given Bungie is moving on.” That's quite a chunk of change for a year's worth. My guess is that there will be no payment.
Tension between the two? Maybe that's what they want the public to think. I find the timing of all this highly suspect.
Worlds was supposed to reply to Bungie's brief. (around Feb 11th, Due to a week delay) Someone had mentioned earlier that they saw old documents and thought that was part of Bungie's brief. I don't know I never was able to find it. But we do know something was sealed for settlement talks. Does Worlds still submit theirs if is it in limbo due to these talks? How does the PTAB proceed if in limbo?
If you read some of the comments on the Yahoo Activision board, some of the people say that Destiny just ran it's course so they decided to give it to Bungie. I don't know the real financials of the game but Even if it did run its course, I think it was still bringing in good money.
