The facts speak for themselves. If there is no appeal (and there wasn't) it's a bad sign. If DM is not around when and if they pull the trigger on something else (and I don't think they will be) it's a bad sign.
And as much as I respect Kool's background and opinions and success, it's one thing to say the opinion is bad, it's an entirely different conversation as to what is EDIG going to do about it and if they do anything how much time will it take and what result. Because EDIG ain't paying ANYone $$ out of their meager funds to do anything about this and I can't see anyone taking it on contingency. And if it's so bad, why didn't they appeal? And if they are waiting for re-exam then they've got to reload and find new lawyers.
At best a VERY long process and more probably a non-starter. JMO.

Never, you and I are one of the handful of investors on any EDIG board who think the markman was comprehensive, accurate, and presents a significant hurdle to ongoing "monetization." Many posters think it is a "non-ruling," inaccurate, doesn't truly grasp EDIG's "tech" and will be of no consequence if EDIG "wins" the re-exam. I believe they are incorrect on every count.

Well put. I had radically different experiences with EDIG, but I have waxed eloquent AND inelegant on all that many times.

I'm going to back away from this and let things calm down for awhile. I still have the same feelings about edig and the support for edig but it's probably not very healthy to continue babbling about it for as long as I have.
Last night I was thinking about this guy named Mike Mays who showed me the stock back in the late '90s. He had all this TI stock and there was some PR with TI, edig, and Liquid Audio and I bout about 3,000 shares. If he had never told me about it I would be about $275,000 better off today and would not have wasted so much of my time on message boards. I'm not sure I knew they even existed until then. And it clearly did not allow me to exercise my best qualities, regardless of whether I was posting postively and bashing Cassandra and MH or posting negatively and bashing you and Dischino.
Either way, I still feel the same about EDIG management, but that's not something that needs to be stated 700 times.

Never - I think you have articulated the only chance for any PPS upside. Munchie is BS. We'll see what happens. I think your timeline is a little optimistic by the way, having lived through the last one.

I think they knew all along. I also think it's just part of the game of keeping enough things in play keep the game going.
At one point they had some real opportunities. Odyssey was a great little device. EVU was a great device - the wireless EVU was REALLY nice, I got to see it in action several times.
I don't know when they decided to not push forward with all these things but I think it had to do with the expense involved in supporting all the sales and customer service efforts vs. the much lower expense of letting them dwindle while continuing to talk about them.
But I have decided I'm going to spend a lot less mental energy rehashing the past. I'll weigh in on new developments.

Right - I used to have an office next door to the USPTO when we ran one of the largest file history businesses as part of our IP offerings, so I have some familiarity with the "process". My point was that all the "excitement" about repairing the EDIG patent is silly, because, once repaired, they will have no ability to go back and enforce it against any who might have actually infringed in the past, and the window for prospective infringement becomes not only smaller, but not as clear.
Such alleged infringers will also not be nearly as disposed to "settle" (remember the raging arguments about settlements vs. judgments?) because they will have little at risk.
Which brings us back to "where is EDIG going to get any future revenues? Not EVU, not patents. Is it Munchie? Ha!

Am I mistaken, or did the markman and USPTO invalidation end any infringement from anyone for this patent? And if EDIG makes changes which are approved, isn't the patent only valid prospectively, not retroactively? And, don't we have to bring new infringement actions (with very short periods of alleged infringement) to see if the courts agree?
Doesn't look too bright to me.

I had forgotten how sophmoric the shuck and jive of EDIG responses are to serious investor questions.
We think we filed patents sometime in this 6 month window and we are not sure if anyone is using the technology. Maybe those were the elements we were promised by RP.

Well, if they said they filed them then I suppose they did. Of course, they "said" they had two successful trials in hospitals of EVU but they took themselves out of consideration after one of them and they "said" they had volume sales into healthcare when they had none and they "said" they had a bunch of opening orders of EVU to airlines when it appears they were really closing orders.

I would have answered " What IP?". Intellecctual property is protected by patents, not trademarks. I think it would be fair to ask EDIG to show the patent application. Have they been filed?
My father would have answered the "what if" question by saying "If a bullfrog had wings it wouldn't bump its behind so much." EDIG does not have any wings. Ot clothes.

Kool - EDIG is required by a special secret agreement of some sort to NOT make announcements about sales or licensing. The only such agreement in all of corporate america.

long standing joke - it was alleged at one point that Duane Morris was hiring 400 lawyers to work on all the EDIG patent litigation - hard as that may seem to believe. Of course, it was also being bandied about that there were 150 "infringers" and each would be paying EDIG $50M or so.
Amazing ideas that people have.
So I just moved the dial a lithe and aimed the 400 lawyers at someone's buying EDIG, or EDIG's buying someone, or something.
