Litigation Results
We have had a number of inquiries from people trying to determine the results of the recent litigation between AVGI and Cryogenic Solutions, Inc. (“CYGX”). Many of you have erroneously been told that CYGX won, or that the result was a “push”. That is simply not accurate, and to enable you to determine the truth for yourselves, we have made it possible for you to obtain a certified copy of the judgment entered in that case. When you review the judgment, simply note the findings of multiple breachs of contract by CYGX, the court's permanent injunctions against CYGX, the attorney fees and costs assessed against it, and then determine for yourself which party you believe prevailed in the suit.

As for the PP suit, bashers will use this last suit as an example of what to expect. They will pull out all stops.
A few pro PP people on this message board I am sure. Who they are I cannot say.
Just as there were one or two who stood to gain by AVGI "winning" the suit presented by CYGX. I'll let you all figure out the who and why.
So far all I have seen on this board lately is lots and lots of jealous and envious posts by a a couple of individuals.
Even saw someone throw something out there that was totally off the wall. Something that only he/she would know about and they want someone else to do DD on it when they themselves know it would be like getting blood from a stone. You can't google a thing like that dude and YOU KNOW IT!

An addendum to that post. While some will put the blame solely
on MS here they should remember that there are others who sit
on the BOD too. This decision was NOT made by just one person.
It needed approval by all.
THEY had better have had a good reason to sue and they need to let us know why they did IMO.
bigworld, I don't think trying to grill MS on the PP suit will do much good at next SHM. He will not and cannot really say anything except that it is proceeding blah blah blah.
In my opinion the thing to grill MS on this coming SHM is why
management chose to sue AVGI in the first place, and what the repercussions of the AVGI suit will be to CYGX other than the monetary.
Neo, why did they sue? Well. it wasn't because their tech does not work as advertised, quite the opposite IMO.
My take on this is that CYGX was trying to avoid exactly what AVGI was granted because Cytogenix has little or few resources to devote to providing another company the material that they need without taking away from their own priorities.
I have a hard time believing this was personal as in ego.
I think this was totally business. Looks like management took a chance to void the contract set up by another administration and lost. Now it looks as if Cytogenix will have to not only concentrate on their own work, but will have to abide by the courts decision to provide AVGI with the necessary materials AVGI will be needing for its experiments.
Not many folks on Cytogenix staff to handle both the R&D and
providing AVGI with their materials too.
Having done R&D work I can fully understand why management took this step IF this was the reason, but it looks as if CYGX management underestimated to possible cost that they could incur. Looks as though it backfired badly.
This is also another reason why folks with PHDs aren't always the best at running the business. What they have in book smarts they often lack in common sense.

As I posted once before, and I will repost. Many folks are missing the point with the herpes topical. If CYGX is successful in getting this cream to Phase 2 or Phase 3, and ultimately has something they can market the stock 2 will do fine, BUT it will prove to other pharmas/biotechs that CYGX has the ability to deliver the goods. It will also VALIDATE
the topical cream in use against Herpes.
Sure other companies will want to license the topical cream, but more importantly some of those same companies will be more eager to "dip into their pockets" much earlier to help
CYGX fund their R&D, maybe even helping CYGX with some R&D along the way.
Percy, that will be the kicker! Not the topical itself.

Not true Percy. You don't have a friggin clue as to how things work in this industry. Large companies like to see
an end result or close to it before they dip into their pockets. That means Phase 1 and Phase 2 will be on CYGX.If Phase 2 is successful then MAYBE they will get an interested party to fork up some dough to help CYGX out.

I think the only way to go about finding the answer to this question is to confront MS with it. Apparently you must have confronted someone with it, and were lied to.

Has anyone noticed that there is very little support for the current price of CYGX at $0.60? Would that mean that there is buying to maintain the price where it currently is? It does seem
odd that support is minimal and CYGX has not gone south yet.
Could it be some accumulation going on even though volume is not that much? About $45,000 exchanged so far today.
Thoughts? I just think it is very odd that support is at 2 and Cyto has not gone into the $0.50s yet.

thecure, hard to tell just how far along everything is. They have isolated genes specific to replication of the virus and production of the viral coat which hides the virus from the body's immune system.
My question would be, if they have isolated the gene that produces the viral coat in Herpes, how would this relate to other viruses including HIV, or would it even have ANY impact on other viruses. I know HIV is not your typical everyday virus, but I wonder if a finding like this may be useful.
