It's not obvious. If the judge has ex parte communications of any kind with the prosecution about the defendant that the defendant's attorney is not made aware of, that might violate courtroom etiquette, to say the least.
But if, as in this case, a now convicted felon demonstrates absolute and utter contempt for the court by totally ignoring the provisions of his own guilty plea, then I have to imagine that the judge could refer a complaint back to the prosecution in some manner on that score, but I have no idea what sorts of hoops they have to jump through to do it, nor what sort of transparency is mandated.
It will be interesting to see if the government has any counterargument to Foley's case that says they can't sentence him based on the loss to GlobalVR. Their initial response to his attempts to get the 9th Circuit to hear it at all is that of course they had the perfect right to do that, and that the convicted felon is blowing smoke to avoid a prison term that he justly deserves.
It all hinges on whether counts in the indictment that are dismissed under the plea bargain should be treated as events that didn't happen, or if they can come back at sentencing, like ghosts. The prosecution says they can come back, and that seems to have been a shock to Foley's apparently not especially competent original legal team.
Those guys were a sledgehammer, but this guy seems to be able to split hairs near to the atomic level.
Improper collusion? Pretty sure the US Attorney and the presiding Judge in the Foley case are fully capable of legally enforcing and following the letter of the law, right?
Hmmm, who knows, David Foley might even see some new charges...
Me thinks the US Attorney and the presiding judge have a plan.

So NTEK has no intellectual property, patent, trademark, or copyright protection whatsoever for the NP-1 or Ultraflix, right?
