If I would be in charge for public-relation in SPNG, I would wait another day. What better can you have, products in Wal-Mart and SPNG keeps silent, I think this will make some people thinking. The company is just doing the right think: Work hard and keep silent and if it is known then by everybody - Wal-Mart - okay make a press release. IMHO

Well said, and there is more to come; Dicon is the center as I would call "World of innovation". The potential of SPNG - just for beginners -
The USA have 115 Mio households. A majority of households has 2 cars, 2 kids, 1 Pet and some of them have a boat.
SPNG with its products covers them all through their product palette. (Cars, Pets, Kids, Yachts-Boats) If only 2 $,s per year per household would go into SPNG products, this would generate $ 230 Mio Revenue. Even the most pessimist would agree with me, that this $ 2.-- number is a rather pessimistic forecast. Well then, on this basis, you could build your own forecast, what kind of revenues SPNG will generate in 2010 and the years ahead. The Brand recognition is brilliant, the cartonic character worldwide on place 11, customers satisfaction Top, new products coming to the market to keep customers happy, well, this is the kind of a company ever businessman would dream to be part of it. Oh, I do know, some will now write back, that there are still hanging problems, most of it the financials. Roma was not build in one day. They are working on all of those, so that once and forever, those subjects are from the table. Remember Amazon (among plenty of others) they went through similar periods, but what doesn,t kill you makes you stronger and in my opinion, SPNG will come very strong out of this.

Well, if you see how much money the Pikes Fund had, you would have to assume that he has almost spend all the liquidity. End of the story.
Further, the world of buyers doesn,t only exist around Pikes, there are others around who smell a good business. Take 30 smarties and each of them buys 10 Mio shares - here you are with 300 Mio shares and so on.
Your story, like every story around SPNG, are based on assumptions, rumours and unhappy advertisers and will not lead anywhere. Some of the best Hedge-Fund managers have been quoted by saying: If we buy we are aware of the fact, that a counter-party will see it and make a story out of it. However, there is a difference between seeing something and knowing something. Again, wealth is made by using the brain and follow a strategy. Money is not made by getting right from the crowd, but by being right in its own decision. And Pikes -among others - doesn,t need the applause from this board.

That means that Sun Life had no other sponsor to put there. Nobody else to give them money to replace this advertising.
So, if this was a payment issue by SpongeTech, then the SpongeTech sign would still be there, and the parties would be in negotiations.

Well if one hears something, one better is sure from which source. Rumours, I would not repeat anything I would not put my signature on. To many "wishful-thinking- stories are flying around, so then, nobody should wonder about their outcome.
It is common sense if one circles in the business world.
I hoped, that the subject "checks" by now should be gone. Here as well, why not wait for the outcome? People get so obsessed by this subject, that I wonder, if one should de-code it.
Look hasher, the end justifies the means. When they signed the contracts, the market was in a dead-spiral, they got in really cheap. But every contract has an exit clause and besides an exit clause a litany of exhibits which leaves room to various possibiliets at both ends. We have seen advertisments in Tennis courts or horse racings in U.K. just to warm up a name and shortly after they were gone. They got what they wanted, brand recognition by advertisment and now they use their money to increase production. It is really that simple.
Do me all a favour; get hand on those advertising contracts and read them through and once you have done that, then everybody is welcome to give the input. Otherwise, the discussion builds itself a momentum of a Derwish Dance, which mostly ends in trance.
Jesus, what kind of level have we reached. SPNG can use their $,s better than put an add up there. I am glad, they saved their money to invest in increased production to satisfy the demand. At least they are in control of expenses.

As most may have witnessed, I try to see the positive where it is. And presently, the range of products being available in stores and online is a fact. Whoever suggests the contrary is negating hard facts. Those, who only want to see the negatives are repeating it to the dead end by twisting the story the way it fits them and not taking into consideration the so-called unknown. Common sense would dictate, that when in doubt, stay out but in the SPNG saga, the negative posters are not in doubt, even if they admitt from time to time about a rumour or if it fits just bend into shape what they have in mind to say, so that it shows up, like the story of the emperor in new clothes. Remember, a liar should have a good memory. The funny part about a lot of discussions here is, that the sense of achievment for a lot of posters is among others the Wells Notice, however, without touching the subject, that such notices reach the desk of AAA firms on a regular basis. Welcome to the Charles Schwab Club. But what is okay for those firms is denied for SPNG. Rather one-sighted presentation, indeed. The other posts, dancing around the share-problems remainds me of a famous quote from Confucius: When you know a thing, to hold that you know it; and when you do not know a thing, to allow that you do not know it - this is knowledge. In short: Nobody knows it - finish. The same could be said with reference to the story Mets and Madison Square Garden: Every deal is based on a major agreement, with a lot of possibilities for legal interpretation if certain criterias are not meet. Whatever behind the non-payment we will all find out early enough, because as always, the last word has the judge, but if it would be based on some of this board, we do not need a judge, because they already know it SPNG did wrong. Mostly such an agency has intermediate stores in various countries, so as the period of delivery and as well the delivery costs can be under control. SPNG will show explosive growth in the period ahead, thanks through their efficiency and the use of technicals which a globalised and virtual world offers. I do have an understanding for some people, who jump in their car and drive to one store to buy their goods and then think if a product is not there, it is not represented in the whole world. But hey, we are living in the 21th Century with golden opportunities for those who can understand it and SPNG saw them and took them, but again, for success you need a first class product and as we all do know, SPNG is a Top-Brand
It is almost impossible not to stumble over SPNG products. Looks like the whole world want,s to get this prime brand into their stores and online stores, but this is rather normal, consumer demand is so huge for these high-quality products that nobody can allow himself not to have it. Oh boy, imagine how much this company will make in 2010 and 2011. The already made it big in 2008 and 2009 but now, really momentum comes in.

On December 24, 2009, the Staff of the U.S. Securities and Exchange Commission (the "Commission") sent a written Wells notice, which was received on December 28, 2009, to each of SpongeTech Delivery Systems, Inc. ("SpongeTech"), Michael L. Metter, SpongeTech's Chief Executive Officer, and Steven Y. Moskowitz, SpongeTech's Chief Financial and Chief Operating Officer. The Wells notices advised that the Commission Staff intends to recommend that the Commission bring civil injunctive actions against them alleging violations of the federal securities laws contained in Sections 5(a), 5(c) and 17(a) of the Securities Act of 1933, as amended ("Securities Act") and Sections 10(b), 13(b)(5) of the Exchange Act of 1934, as amended ("Exchange Act") and Exchange Act Rules 10b-5, 13b2-1, and 13b2-2 thereunder; and Sections 13(a), 13(b)(2)(A), and 13(b)(2)(B) of the Exchange Act and Exchange Act Rules 12b-20, 13a-1, 13a-11, 13a-13, and 13a-14 thereunder. The recommended actions would seek, among other things, permanent injunctions and civil penalties.
Under the Wells process established by the Commission, SpongeTech, Mr. Metter and Mr. Moskowitz have been offered the opportunity to submit a written or videotaped submission to the Staff setting forth any reasons of law, policy or fact why they believe that the civil injunctive action should not be brought or bringing forth any facts to the Commission's attention in connection with its consideration of these matters (a "Wells Submission") before the Staff makes its formal recommendation to the Commission regarding what action, if any, should be brought against them. SpongeTech, Mr. Metter and Mr. Moskowitz are consulting with their counsel with respect to these matters. There can be no assurance that the Commission will decide not to bring actions against them, nor can SpongeTech predict the outcome of any such action(s), if brought.
SpongeTech does not anticipate any material interruption in its business operations by virtue of the Wells notices or any action(s) that may be brought by the Commission. SpongeTech will continue to conduct its operations in the normal course of business, including receiving orders, shipping its goods and servicing its customers and suppliers.

It makes me happy to see, that you have such an "inside knowledge" of all their wrongdoings. By the way: I have seen many shareholders making a lot of money after the funeral of a company; being burried doesn,t mean you are gone. Even the Bear Stearns offer had to be bettered afterwards.
About me: Believe it or not, I am a shareholder but it never came to my mind to join a class action; decisions to buy are still made by myself and by the way, I am still buying down here as well. So, yes I stay and this on both feet.
At least you would agree with me, that their lawyers - especially Siegel - would know what kind of possibilites they would-could-and should have with the SEC. And with this knowledge at hand, they will do the right thing, not dictated by outsiders or whomsoever.
First, a lot of this insurances cover fraud, to protect the company, however afterwards the insurance company has a regess-right versus the individuals involved.
To the rest: This are plain and simply misleading statements I better do not go into it. If this kind of debate is accepted, you open a pandora box like: The Americans were never on the moon.

1.) Mets and MSG are related in the case. Not yet clear who is right or wrong, but this is an easy one.
2.) The cheque story is of course related to 1) and if the legal findings based on their agreement give a clear answer who is right and wrong then 2) will be solved as well.
3.) what do you mean with missing big customers?
4.) Gagging the TA isn,t a problem either. If a Transfer Agent can not tell you any info about the share structure such as the 0/S it could be by order of the company or their SEC lawyer. Reason with SPNG could be - see pressrelease from 2008 from Metter - that they had problems with stocks sold but not reported as shorts. Or RME who received restricted shares versus their financing lifted the restriction to early or whatever. Under this point actually the Wells Notice falls which demands for clarification securities related.
5.) If you clear point 4 - point 5 is settled.
