About those projected revenues: He did put out a retraction PR...of sorts. [{Vernon-(Gene}-Vernon)] did claim $22 million in projected rev. at 50% net. I don't think he realized that would put him at $11 million in cash assets and force him to file Quarterly Statements. EVERY company that has 10 million in assets MUST file Quarterly's. Indeed. All the materials for the system are readily available. And no, there are no patents to cover its' design. There are design elements, including operation of the valves, floats and general operation, that could be replicated.
That system, once built, would not be ETV verified, nor enjoy a pre-approved status with Montana and Idaho DEQ, and would not be the system that is permitted to be put in the ground at Peak Health and Wellness/Watson's Children Shelter or Homestake Meadows II. The only system going in the ground is the IWS system.
The building permits for Watson's and Homestake would not have been issued without the wastewater issue being resolved first. This is fact.
The nitrate problem in both Missoula and Butte was solved by the IWS system.
These projects could not be moving forward otherwise.

The system planned for Homestake Meadows is a series of treatment tanks that use bacteria to reduce nitrates, similar to a municipal wastewater treatment plant.
Individual septic systems were previously proposed and subsequently denied by the Montana Department of Environmental Quality because of nitrate concerns.
This treatment system has received the green light from the DEQ, and Ueland believes it will be the model for future development in the valley south of Butte.
All lots will be served by on-site wells, but waste would be treated at a centralized site before being discharged into a drain field.
"I think this is a major stride forward in showing other developers what can be done," said Dale Mahugh of NorthWestern Energy's economic development office.
Ueland described the system as among the most environmentally friendly on the market, and said it can be expanded to accommodate growth.
"This is where we had to jump out and lead the pack to get this done for the good of Butte," he said.
Homestake lots will be offered for sale from between $36,000 and $75,000.
More than 30 of the 58 lots would be offered at first and Ueland says the remaining property will be on the market in the future.

CTA has completed many "state of the art" MBR systems. They, nor Mostad, have been granted another permit for the project. The construction permit would not have been granted without a wastewater permit that firstly, addressed the high nitrate levels in the area. Construction is underway.
The approved, permitted design for the project is the IWS system. The GC cannot solicit bids for an alternate system.
The public notice I posted is the only document that is still being made available. The actual permit and environmental assesment, (no longer available) specifically mentions and outlines IWS's system.
This is Mostad's record of the project with the EPA. Montana has been granted authority over this "minor permit".

The wastewater discharge permit was issued in May for the Peak, Watson's project. The variance would not have been granted without the wastewater issue being cleared up. Construction on the project is underway.
But IWS, International Wastewater Systems, is supplementing or offering their system at a reduced rate just sort of for the publicity and the goodwill and good grace of what their doing, so I think they’re pretty much at cost for what they’re doing for the sewer treatment plant. As it turns out, the way the property is, I guess, being offered to Watson’s, there’s some availability of budget to help sewer budget side of things, I guess you’d say, there’s more money available for that side of the budget. And then with the additional development of the…it’s beneficial to the Peak; they can also increase their capacity for treatment, so. By adding this system, you actually get to reduce the drain field area in half. And so I want to move on and kind of keep things moving fast, I’m sure there will be some questions. Let’s go to the next slide real quick.

So, you can "hope" Newton puts out a "management release". I don't beleive we'll see one.

POINTE-CLAIRE, 29 September 2008 – The second installment of the Energotest 2008 trials took place from 2 to 12 September 2008 at the Motor Vehicle Test Centre at Blainville, Quebec. Energotest 2008 brought together fleets from SLH, Bison, Hervé Lemieux, Bourassa, Robert, and the SAQ to test a dozen technologies designed to reduce fuel consumption and the emissions of greenhouse-effect gases produced during road transportation.
Organized by FPInnovations — Feric Division, in collaboration with Quebec's Ministère des Transports, Quebec's Agence de l’Efficacité Énergétique, Transport Canada, and Natural Resources Canada, the Energotest program has provided reliable information on the performance of 12 technologies and a range of practices chosen by the members of PIT. In addition to these technologies (described below), both PIT members and others can learn the impact on fuel consumption of hauling containers, a panel trailer, or a trailer with an open bed; whether it's beneficial to add fairings (skirts) to a vehicle; and the impact of biodiesel on vehicle performance, to name just a few examples.

An open-doors day took place Wednesday 9 September, and more than 50 visitors had the opportunity to see how the tests were carried out, to talk to suppliers, and to share their thoughts with industry leaders and researchers.
"The cost of fuel and related environmental challenges are forcing managers to seek technologies capable of improving the energy efficiency of their fleets if they want to stay in business," emphasized Yves Provencher, Director of Business Development for FPInnovations — Feric Division. "The research program that just finished gave us an opportunity for the second consecutive year to offer the transportation industry concrete solutions capable of reducing their fuel consumption and increasing their competitiveness."

Big subdivision moving forward

A Butte family announced plans Tuesday to move ahead with Butte's first major sub-division serviced by an independent wastewater treatment plant.
"We're officially announcing that we're going forward," Ron Ueland told real estate agents and representatives of NorthWestern Energy and Dowl HKM Engineering Tuesday during a presentation at Metal's Bank restaurant.
Ueland Land Development of Butte plans to create and sell 58 home sites from 2 to 10 acres over 240 acres north of Warren Heights at Blacktail Canyon Road, south of Butte.
Known as the Homestake Meadows Phase 2 major sub-division, the development is among the largest proposed in Butte and is unlike any other with the construction of a community wastewater treatment system operating independently of Butte-Silver Bow infrastructure.
The proposal, along with other development south of Butte, had been delayed over high nitrate readings from septic tanks.
The system planned for Homestake Meadows is a series of treatment tanks that use bacteria to reduce nitrates, similar to a municipal wastewater treatment plant.
Individual septic systems were previously proposed and subsequently denied by the Montana Department of Environmental Quality because of nitrate concerns.
This treatment system has received the green light from the DEQ, and Ueland believes it will be the model for future development in the valley south of Butte.
All lots will be served by on-site wells, but waste would be treated at a centralized site before being discharged into a drain field.
"I think this is a major stride forward in showing other developers what can be done," said Dale Mahugh of NorthWestern Energy's economic development office.
Ueland described the system as among the most environmentally friendly on the market, and said it can be expanded to accommodate growth.
"This is where we had to jump out and lead the pack to get this done for the good of Butte," he said.
Homestake lots will be offered for sale from between $36,000 and $75,000.
More than 30 of the 58 lots would be offered at first and Ueland says the remaining property will be on the market in the future.
While one of the proposed routes for the proposed Mountain States Transmission Intertie, or MSTI, passes through the development, Ueland doesn't believe it will be the chosen route.
Still, he's withholding sale of the property where the line would run until a final decision is reached for the 500-kilovolt MSTI line.
If the line does pass through the land, Ueland said it would be placed in an existing utility corridor where power lines already are located.
Ueland said the property is former ranch land and admits there was uncertainty within the family whether to sell the property.
But with growth in south Butte, he says the property can't be used for ranching operations anymore, and said the new homes will benefit the area.
"Butte can't wait for this," Ueland said. "If we're going to keep pace with what the community needs, we need to do it now." — Reporter Justin Post may be reached at justin.post@lee.net.

froggy, I think you just made a very good case as to why that PR released by RCC Holdings was retracted and clarified. Does the retraction then keep the company in compliance?

They most certainly are. All of gpwild's grievances would be considered "civil matters".
IMO This doesn't look like a blanket statement sent out by the exchange, simply stating confidentiality. It seems gpwild's email was sent up and reviewed by an attorney. Why would they bother to review for a breach of Exchange Requirements if there was absolutely no connection b/w the TSX-V and RCC. Why would the Exchange even consider a future investigation?

Says right there in the "pre-clarified" PR how the exchange and the attorney were involved.
