FIDELITY: Thanks. I got to do this! Altough I actually had only one buy order, no sell orders filled, it sounds like a very smart think to do. Gotta love Fidelity's customer service.
Any reply kodiak?
Click 'show board info' above.
Yes, several people have already sent their's in. I'm still waiting for my summons.
I think he means 'hurt' us by implicating the group as a whole in the lawsuit (where there may only be a few who are guilty), when in actuality this will in some way get our shares closer to trading. That's just my take on the email. Could be off.
So can I assume you have fraudulent certs in your possession and you admitted guilt to lawyer? Just askin.
>>>How does that help?
It should help prove your innocence, no?
Lot's of info in the ibox above, and a good response 'template' from a poster named Sir Charles. Also read as many posts as you can. I think most people here view this suit as a good thing, and is just another step towards getting our shares trading. You will most likely not need a lawyer, but it wouldn't be a bad idea to speak with one (this is still being debated). Either way take this seriously and make sure you get the summons in within 20 days (obviously).
Anybody get a returned call from the Attorney's Office yet? Left a message this morning, no call so far. I have not receive my summons.
Ok, you are right about that, but do you think the court can prove innocent (in actuality)shareholders guilty?
Yes, but he is giving us a chance to respond, and if he can't prove we are guilty of anything, then we are still innocent. What's the big deal if you haven't done anything wrong? I believe he is only after a few individuals here who truly committed an alleged crime as stated in the summons. It's just another step towards getting this trading, and there is no saying whether that's going to happen as far as I can tell.
Oops this was meant as a reply to backaway earlier:
Ok, I see now. You meant win the lawsuit, but only against the few guilty if any are listed (I would imagine only a few). Thinking this through I think you are spot on.
Once done, you'll be off the "defendants" list and onto the plaintifs catagory awaiting a potential short buyin the market will cite for years!!
Btw backaway, I just member-marked you. You seem to be one the best thinkers on this board. Your insight is greatly appreciated!
Ok, I see now. You meant win the lawsuit, but only against the few guilty if any are listed (I would imagine only a few). Makes sense. Thanks for input.

Not to mention since Megas/BCIT is the plaintiff and pretty much in control, this lawsuit may have been suggested to him by his attorneys as a sure way to prove something to whoever is keeping this from trading (DTC, NSS, Ameritrade, SEC, etc.). In others words, it's also like this suit is 'rigged' (so to speak) so that Megas can be sure to lose. Which of course it will be extremely beneficial to have us as shareholders. Unless, of course he has already been told that there is no way our shares can trade, or that we will be held up in the courts for years, and he needs to remove us so that he can move on with his merger. The latter seems much less likely given some of the questions I've read so far. It doesn't seem likely that Megas could win this judgment even if that was his intent. Anybody disagree?
This is what I'm thinking, but according to some posts, others are suggesting differently (there have been a few). Have any lawyers given insight on how the judgment will be made?
Also does anybody really think we have a chance of losing the judgment? Almost seems impossible.
Have we all agreed that the judgment will be made on the defendants as a group, rather than each of us individually? Just trying to get an idea of how long it will take. I'm thinking at least a month; possibly several.
And here's another incredibly well thought out post.

ai: you may want to check out this post from elitedb. Awesome summary, imo.

I believe the float becomes those few million March Indy shares. Just as if the Pino thing never happened.
Question for the board: Is the judgment made on each of our responses individually, or as a group as a whole. And surely there will be defendants who will fail to respond to the summons. Will they be left out of judgment if it's in our favor. Sorry, if all this was covered already. I really appreciate all the great posts lately!

And here's the case attorney's webpage:

According to this: http://www.oscn.net/applications/oscn/getcaseinformation.asp?submitted=true&number=CJ-2007-3181+...
Hopefully that leads you to who you need to talk to.
lakers: I would call the courthouse and make sure they have your current (out of country)address on file. If not, demand a new one sent out to you. I'm sure they'll know how to deal with it.
formality?
Thank you. That is a bit relieving to hear right now.
LOL.. you are listening to the wrong people.
Well it's been stated a 100 times already: This is NOT a lawsuit, it's a declaratory judgment. Why do people actually believe us shareholders are getting sued? That is freaking ridiculous. I have not seen anything to believe we are being sued other than the word 'defendent' listed with our names. Again, this a declaratory judgment, not a civil lawsuit. There's at least a dozen posts explaining the difference.
Cool thank you for posting that Weebie.
The majority of us still think he is.
It DOES make sense. I agree.
Megas still not replying to emails huh? Still tight lipped? I would love to hear his take on this Declatory Judgment. (duh)
Not a good idea, IMO. You will receive it with the summons coming in the mail. Just be patient. I would rather not have my name posted here, but that's just me.
Is there a reason why the "E" hasn't appeared and added to the ticker?
What makes you think it won't be settled on the open market?
Yup, I think you're dead-on mav.
Could somebody please scan and post the summons? TY
I think he meant 'why are they on that list'. LOL
for_three, please read this post->

I think you are misunderstanding the whole thing.
GREAT SUMMARY. THANK YOU!!
