USDA GIVES INDUSTRIAL HEMP GROWING THE GO-AHEAD IN RESPONSE TO GROWING CBD INDUSTRY

Farmers across the country will soon be able to grow hemp under the auspices of the U.S. Domestic Hemp Production Program, announced October 29 by the United States Department of Agriculture (USDA).
"At USDA, we are always excited when there are new economic opportunities for our farmers, and we hope the ability to grow hemp will pave the way for new products and markets," said U.S. Secretary of Agriculture Sonny Perdue. "We have had teams operating with all hands-on-deck to develop a regulatory framework that meets Congressional intent while seeking to provide a fair, consistent, and science-based process for states, tribes, and individual producers who want to participate in this program."
The new program would allow farmers to grow hemp in every state and on reservation land.
Requirements for licensing, records maintenance, testing for THC levels and the disposal of plants that do not meet the requirements will be established by the rules of the program.
Hemp production has resurged in the U.S. because of an increase in demand for products containing CBD (cannabidiol) oil, a side product of hemp, which is used for relieving pain, anxiety and the effects of certain medical conditions. Clinical trials have shown CBD to be effective in the treatment of epilepsy.
Included in the program will be the enactment of the 2018 Farm Bill, which reclassified hemp and allowed for its growth as an industrial product.
Hemp can be grown for fiber, processing (the extraction of plant resin), grain and seed according to the new government regulations.
Sales of CBD products are expected to exceed $20 billion in the U.S. by 2024, according to a financial study. CBD product sales in dispensaries shot up to 11 percent in 2018, a rise of six percent from 2017.
"We're witnessing CBD maturing from a cannabis sub-category into a full-blown industry of its own," said Roy Bingham, co-founder and CEO of BDS Analytics, a firm that provides data to the cannabis industry. "Our growth forecast for the CBD market, across all distribution channels, predicts a compound annual growth rate of 49 percent by 2024. This is a great opportunity for all involved, but it means the road ahead will include decisions that need to be informed by the best possible data."
While CBD is often associated with marijuana because they are both products of cannabis plants, CBD oil has zero to very low amounts of THC, the chemical in marijuana that gets users high. Studies from the World Health Organization indicate that CBD products are also non-addictive.

Schumer calls for FDA regulations for CBD

The Food and Drug Administration has been “woefully inadequate” in setting regulations for the cannabis compound cannabidiol, U.S. Sen. Chuck Schumer told the agency in a Wednesday letter.
In a Wednesday conference call about the letter, Schumer said FDA inaction is stalling job creation and commerce in New York, particularly in the mid-Hudson, which is fast becoming the epicenter for growing the hemp from which CBD is derived.
CBD has shown promise for treating pain, inflammation, psychiatric conditions, alcohol and opiate use disorders, among other maladies, though research is nascent.
CBD comes from hemp, which is cannabis, the same plant as marijuana, that has been bred to include nearly no THC, pot’s high-producing chemical.
With the 2018 Farm Bill’s passage, Congress legalized hemp for industrial purposes, while leaving it to the FDA to regulate CBD.
CBD is state-legal in New York for research and as medicine via state-licensed dispensaries. But it’s federally illegal for medicinal purposes, except for the anti-seizure drug Epidiolex, which is the only FDA-approved CBD medicine.
Schumer attributed the FDA not releasing CBD guidelines to under-staffing and the agency buying into the stigma surrounding hemp, despite it not being marijuana.
“Once the feds spell out the ABCs of CBD, we can sit back and watch this promising industry grow and create jobs from one end of New York to the other,” Schumer said.
America’s hemp-CBD market could grow to $2.5 billion or more in 2022 from $820 million in 2017, according to New Frontier Data, a research firm.
Currently, 18,000 acres of land are licensed for industrial hemp growing in New York, with 14,000 designated for CBD cultivation and extraction, according to Schumer’s office.
Many of those acres are in the mid-Hudson, particularly in Orange and Ulster counties. Few farms in the Town of Warwick lack hemp, in large part because of the Orange County Industrial Development Agency.
The nonprofit, which promotes economic growth, projects that by May it will have helped create 200 local CBD-related jobs.
The IDA has been swiftly attracting millions of dollars of investments for its Accelerator incubator to nurture a CBD and hemp business cluster at the former Mid-Hudson Correctional Facility in Warwick.
If the FDA decides to regulate CBD as a drug, the fledgling industry could be impeded because each new product would require copious, time-consuming research, said Vincent Cozzolino, managing director of the IDA and its Accelerator.
But if the FDA treats CBD as a supplement – like minerals, vitamins and other natural substances taken to augment a diet – the CBD industry could explode, Cozzolino said.
“Right now, people are worried that the FDA will do something that will keep the industry from taking its course,” Cozzolino said. “We can accommodate almost any (scenario). We just need to know” how the FDA wants to treat CBD.
Asked for a response to Schumer, an FDA spokesman emailed a Tuesday tweet from Dr. Amy Abernethy, the FDA’s deputy commissioner.
“The FDA’s working quickly to further clarify our regulatory approach for products with cannabis/cannabis-derivatives like CBD, while using all available resources to monitor the marketplace and protect public health by taking action as needed against companies” selling CBD, Abernethy tweeted.

CORVALLIS, Ore. -- This year's hemp harvest could be the largest in state history, experts at Oregon State University say.
According to Global Hemp Innovation Center director Jay Noller, the decriminalization of hemp farming has attracted more growers than ever to the industry.
The state said farmers were licensed to grow more than 46,000 acres of hemp in 2019, compared to about 8,000 in 2018.
"Even in the olden days, when we used to grow hemp in Oregon, I don't think we saw this many acres," said Noller.
Experts said that a wet September and October has created problems for the crop, washing away desirable compounds and inviting disease and mold. However, cooler temperatures have controlled levels of the psychoactive compound THC. According to federal law, hemp can only contain 0.03% of THC.
While farmers flock to the crop, Noller said producers are getting better at complying with regulations across the board. The Farming Bill of 2018 put the regulation of hemp by the U.S. Department of Agriculture into motion, but Noller predicted that it may not be a fully legal commercial crop until the 2020 growing season.
"It has an unpredictable sort of chaotic nature to it. In that chaos, there's opportunity, but there's also potential for losses," he said.
Increased supply might also give major retailers the confidence they need to get hemp products into their catalogs, Noller said.
As for popular hemp extract CBD, experts said the Food and Drug Administration could be years away from regulation, creating an unpredictable environment for retailers and investors.
Julie McKenzie is a co-owner of Your CBD Shop in Corvallis, which has been open for about a month. She said that she chose to open her shop as consumers are gaining confidence in hemp products.
"As the industry grows, there's more room for profit and more room for families to support themselves and get the message out there to people," she said.
Noller said the industry is poised for more growth in the 2020 growing season and that Oregon has gotten recognized as having the best conditions for hemp farming.
